Broadway, stated she would like to <br />see the South Main Street project complete by the year 2000. <br />&nbsp;She also stated her support for a rezoning request on North <br />Main and College Streets. &nbsp;<br /><br />Councilmember Robertson and Mayor Bellman arrived at 7:35pm.<br /><br />Citizens Comments closed at 7:36pm.<br /><br /><br />MAYOR&rsquo;S REPORT<br />The Mayor&rsquo;s Court Report for the month of November was <br />presented for review.<br />Councilmember Rader noted a jump in the number of drug abuse <br />arrests in the last year. &nbsp;<br />&nbsp;&nbsp; &nbsp;Vice Mayor McGowan directed the clerk to file the <br />report.&nbsp; A copy of that report is attached as part of these <br />minutes.<br /><br />&nbsp;<br />MANAGER&rsquo;S REPORT<br />&nbsp;&nbsp; &nbsp;The Manager&rsquo;s Report for the month of November was <br />presented for review.&nbsp; &nbsp;<br />Councilmember Rader noted an income tax revenue from this <br />time last year.<br /><br />Councilmember Wernet moved to accept the Manager&rsquo;s Report. &nbsp;<br />Councilmember Rader seconded.&nbsp; Motion carried.&nbsp; A copy of <br />said report is attached as part of these minutes.<br /><br /><br />COMMITTEE REPORTS<br />Councilmember Wernet noted that the Planning Commission made <br />recent decisions on two applications which have been <br />forwarded to Council.&nbsp; Council will introduce those <br />Ordinance during this meeting.<br /><br />&nbsp;&nbsp; &nbsp;JEDD<br />Jim Jump, JEDD Committee Member, reported on the last <br />meeting of the JEDD Committee.&nbsp; There was a discussion of <br />the need for a Planner and it was suggested that the Licking <br />County Planner be used.&nbsp;&nbsp; It was also suggested to create a <br />County Sewer District.&nbsp; This would mean the plan would now <br />include a Transportation District, an Economic Development <br />District&nbsp; and a County Sewer District.&nbsp; Mr. Jump feels there <br />is a need for Regional Planning to complete this project and <br />is concerned with a need for preservation during this <br />project.&nbsp; &nbsp;<br /><br />It was noted the selling point of the JEDD was for <br />industrial and commercial needs.&nbsp; It has since been <br />mentioned that there is a need for residential areas as <br />well.&nbsp; It was noted that this might drain service costs, <br />increase costs of schools, and traffic. &nbsp;<br /><br />Mr. Jump stated that it would be hard to recommend that the <br />Village of Granville invest serious funds into this project <br />based on what the Village is likely to get out of it at this <br />point.&nbsp; Mr. Jump will continue to report to Council.<br /><br />Truck Traffic Issues<br />Mayor Bellman noted disappointment that he hasn&rsquo;t heard from <br />Bob Howarth for two weeks with regard to thru truck traffic. <br /><br /><br />OLD BUSINESS<br /><br />&nbsp;&nbsp; &nbsp;Ordinance No. 24-98, An Ordinance To Amend Sections <br />313.11 Of The Codified Ordinances Of The Village Of <br />Granville was re-introduced by Councilmember Rader.&nbsp; Second <br />by Councilmember McGowan.<br /><br />There was a question as to whether there had been any <br />studies done on the number of pedestrian traffic at the <br />corner of Main Street and Broadway.&nbsp; It was noted that there <br />was a safety concern for children walking to school from the <br />west side of Granville and the posted signs are for their <br />safety.<br /><br />Roll Call Vote:&nbsp; &nbsp;Proposed Ordinance No.&rsquo;s 19-98 &amp; 20-98<br />In favor of these Ordinances, Councilmember Robertson stated <br />these Ordinances are to create legal recourse for citizens <br />views.&nbsp; She mentioned incidences in the past wherein <br />citizens had no recourse.&nbsp; She feels it is possible for this <br />body to make an illegal decision and would like to see the <br />"ordinary" citizen have more voice over what goes on in the <br />Village. <br /><br />Jim Jump, of 143 Thresher Street, noting he has met with <br />several members of Council and the Law Director stated this <br />proposal offers authority to Village citizens to attack <br />administrative decisions.&nbsp; He noted that by appointing an <br />Administrative Authority to make quasi-judicial decision one <br />is "stuck" with those decisions unless an appeal is made by <br />a citizen who has standing or is directly effected.&nbsp; This <br />proposal gives authority to the Manager to review all <br />administrative decisions and request the Law Director take <br />legal action should there be a need.&nbsp;&nbsp; If the Law Director <br />has a conflict, the Manager must appoint a Special Counsel <br />with which the Council would be responsible for funding.&nbsp; He <br />feels that if the Village refuses to act on a taxpayer&rsquo;s <br />written request, the taxpayer could take the challenge based <br />on their public right and not standing.&nbsp; Mr. Jump discussed <br />several additional ideas in which he proposes in this <br />ordinance. <br /><br />Law Director Hurst hopes Council would not&nbsp; adopt this <br />legislation as drafted.&nbsp; He feels a portion of it is ill <br />advised and will not withstand the type of judicial review <br />or attack that is inevitable.&nbsp; He stated that Mr. Jump and <br />himself had common philosophies, concerns, and similar <br />solutions in all sections except the section on standing. &nbsp;<br />He submitted a revision to Section 1109.12 which will <br />accomplish all components to attack or avoid which is one <br />goal of this proposed legislation.&nbsp; He noted that Section <br />1137 has an inherent weakness in making it clear that those <br />with standing, or directly effected, have the right to <br />participate in administrative hearings.&nbsp;&nbsp; Councilmember Rader <br />second.&nbsp; Motion carried.<br />&nbsp;&nbsp; &nbsp;&nbsp;&nbsp; &nbsp;<br />PUBLIC HEARING<br />&nbsp;&nbsp; &nbsp;A public hearing was held on Ordinance No. 26-98, An <br />Ordinance To Amend Ordinance No. 22-97 Providing For <br />Adjustments Of The Annual Budget For The Fiscal Year 1998 <br />And Revising Sums For Operating Expenses.<br />No one appeared to speak for or against Ordinance No. 26-98. <br />&nbsp;The public hearing closed at 7:34 pm.<br /><br />&nbsp;&nbsp; &nbsp;A public hearing was held on the 1999 Municipal <br />Budget. <br /><br />No one appeared to speak for or against the 1999 Municipal <br />Budget.<br />&nbsp;<br />1999 Municipal Budget Discussion (Council/Staff)<br />&nbsp;<br />Manager Hickman noted that with proposed projects, the net <br />balance in the budget at the end of 1999 will be $321,588. &nbsp;<br />He stated that he is looking forward to street improvements, <br />storm sewer, and curb and sidewalk extensions to South Main <br />Street.&nbsp; He stated that this project could be possible with <br />the Village and area merchants working together.&nbsp; He stated <br />that grant money is being requested for the area from Munson <br />Street to Broadway.&nbsp; He noted that this significant project <br />has been delayed the last two years due to the lack of grant <br />money.&nbsp; He recommends that Council consider bonding this <br />project if grant money is again not approved. &nbsp;<br />Noting that this is a state route, Service Director Zarbaugh <br />will look into the possibility of reimbursement from the <br />State of Ohio for pavement work on this project.<br />Mayor Bellman noted that he is not in favor of this project <br />unless merchants in the area update signage and building <br />facades to conform with Village zoning.&nbsp; Without that <br />cooperation, he feels that only improving the road will not <br />make things look nicer. <br /><br />Manager Hickman noted that the Tree &amp; Landscape Commission <br />is requesting a part-time/seasonal landscape person to work <br />under the supervision of the Service Director.&nbsp; As <br />suggested, Joe will look into automatic watering systems. &nbsp;<br />Council agreed this was a needed position.<br />&nbsp;<br />Manager Hickman noted that West Maple Street, one of the <br />last Village streets to be "overhauled", needs to be <br />re-done.&nbsp; He noted that the portion of Main Street to Cherry <br />Street will be funded by the General Fund.&nbsp; He then added <br />that the portion of Cherry Street to Shepardson will be <br />funded with $175,000 from the Road Improvement Reserve.&nbsp; He <br />noted that $200,000 will still be available in the Road <br />Improvement Reserve after funding of this project.&nbsp; He <br />stated that completing this project this year will put the <br />Village ahead of schedule. <br /><br />&nbsp;&nbsp; &nbsp;Service Director Zarbaugh stated that the Newark <br />Granville Road project is scheduled for completion in the <br />year 2002 of his long range plan. &nbsp;<br /><br />&nbsp;&nbsp; &nbsp;It was noted that E. Maple Street and Sunrise Street <br />are the only remaining streets in the Village without curb <br />and gutters.<br /><br />Manager Hickman advised that new light poles from Holophane <br />for the Broadway project were "lost" at the factory.&nbsp; These <br />poles will not be available until the spring of &rsquo;99 of which <br />funds have already been encumbered.&nbsp; He noted there have <br />been very few special appropriations from the 1998 Budget of <br />which he gave credit to the staff for their accurate <br />projected estimates.<br /><br />There was a discussion about the Strategic Land Reserve <br />Fund.&nbsp; Councilmember Robertson stated that recent surveys, <br />etc., reflected citizens desire to have things preserved and <br />she would like to see this fund receive additional funding <br />and possibly be renamed the Preservation Fund. &nbsp;<br />Mayor Bellman asked Council to consider possibilities for <br />this fund. <br />It was noted that the Park Land Reserve Fund could not be <br />combined with the Strategic Land Reserve Funds as the Park <br />Land Reserve Fund has statutory considerations limiting the <br />use of its funds.<br /><br />There was some discussion of the Bennett property and the <br />possibility of working out a temporary arrangement to close <br />off some openings to the lot and stripe the street to <br />accommodate more parking in that area.&nbsp; Mayor Bellman <br />volunteered to explore this idea.<br /><br />Manager Hickman asked if Council would approve the use of <br />funds from the Lands and Building Funds for improvement to <br />the Council Chambers.&nbsp;&nbsp; He noted the allotment of $10,000 <br />for this project.<br />&nbsp;&nbsp; &nbsp;Council agreed to this project and it was suggested <br />this room could be made available as a community meeting <br />space.<br /><br />Manager Hickman also noted that Keith Myers will do a review <br />of traffic flow and street light issues within the Village <br />which will be funded by the Engineering Fund.<br /><br />It was mentioned that there were alternatives to using funds <br />for a wage study in 1999.&nbsp; It was suggested that the <br />Personnel Committee, along with several members of Village <br />staff do a study of their own for an agreeable solution. &nbsp;<br />&nbsp;<br />There was discussion about funds allocated for computers. &nbsp;<br />Following a discussion, it was recommended that the staff <br />could possibly look into a silent bidding process to dispose <br />of discarded computers.<br /><br />Councilmember McGowan also raised the question of the use of <br />Education Funds.&nbsp; It was noted that conferences, seminars, <br />tax meetings, planning meetings, Hazmat, police training, <br />etc. is money well spent for training of Village employees. <br /><br />&nbsp;&nbsp; &nbsp;Mayor Bellman asked the Manager to look into the <br />issue of a truck weighting system in the Village.<br /><br />Planner Wimberger noted that the Design Review Standards <br />Committee is looking into the completion of this project. &nbsp;<br />She noted that the committee is still in the process of a <br />legal review of which changes are needed.<br /><br />REVIEW AND APPROVAL OF MINUTES<br /><br />The minutes of the regularly scheduled meeting of November <br />18, 1998, were presented for review.&nbsp; Councilmember Robertson moved to <br />approve the minutes.&nbsp; Councilmember Rader second.&nbsp; Motion <br />carried.&nbsp;&nbsp; &nbsp;<br /><br />COMMITTEE REPORTS<br /><br />Vice Mayor McGowan reported on the Recreation Commission. &nbsp;<br />He noted that rent for the Wildwood Shelter House has been <br />raised from $10 to $20 for Granville resident&rsquo;s due to the <br />increased usage of water and the new restroom facilities. &nbsp;<br />Non-profit Granville groups may use the shelter for free <br />with 30 days advance notice.&nbsp; All out of town groups are <br />required to pay $30 whether non-profit or not.&nbsp; He also <br />mentioned that the idea is being discussed to pave the old <br />ice rink on the south side of the bike trail for skate <br />boarding.&nbsp; He noted the idea was mentioned of paving an area <br />for a basketball court on the south side of the bike path. &nbsp;<br />He stated that flood plain dug outs at the new Raccoon <br />Valley fields should completed.<br /><br />&nbsp;&nbsp; &nbsp;Following a discussion, Law Director Hurst noted <br />that the Recreation Commission is required to request <br />Council&rsquo;s approval for such projects and they as a <br />Commission cannot do anything to Village owned property <br />without Council&rsquo;s permission.<br /><br />&nbsp;&nbsp; &nbsp;Mayor Bellman noted his attendance at the JEDD <br />meeting last evening.&nbsp; He noted the discussion related to <br />the area being developed as residential, multi-development. <br />&nbsp;He said that Charlie Greib stated that in order to make <br />sure the property is marketable, there is a need for mixed <br />use.<br /><br />&nbsp;&nbsp; &nbsp;Council discussed the fact that the original selling <br />point for this project was that it would not be residential <br />or retail but for commercial businesses only.&nbsp; Council feels <br />the JEDD is not going it the direction as originally <br />intended.<br /><br />&nbsp;&nbsp; &nbsp;Mayor Bellman noted other issues raised were <br />contributable water capacity, police services, and <br />maintenance services.&nbsp; He feels that the JEDD has had an <br />immediate benefit in that it has forced communities to sit <br />down together developing relationships.&nbsp; &nbsp;<br /><br />CITIZEN COMMENTS<br /><br />Clifton Crais, 234 N. Pearl Street noted that Mr. Howarth <br />has not contacted any of residents in regard to thru truck <br />traffic meetings.&nbsp;&nbsp; He said he is in favor of regional <br />discussions on this subject.&nbsp; She is <br />interested in pursuing and feels these letters should not be <br />ignored.<br />&nbsp;&nbsp; &nbsp;Council made the decision to meet with Village <br />employees in January, 1999 for a discussion regarding <br />staff&rsquo;s concerns. <br /><br /><br />Jim Harf - Keny Annexation<br />&nbsp;&nbsp; &nbsp;Mr. Harf, Granville School Board Representative, <br />advised Council of an agreement between the Granville School <br />District, Newark City Council, and Schottenstiens (developer <br />for the Keny property).&nbsp;&nbsp; He noted a commitment to the <br />School Board for 50% of the proceeds from the sale of <br />the14.8 condominium acres.&nbsp; He noted the density issue was <br />important noting 361 single family homes are projected.&nbsp; He <br />noted a 5.2mil has been set on each property for a period of <br />20 years.&nbsp; He said the feeling is that the goal of covering <br />all capital costs in the school district was met.&nbsp; &nbsp;<br />Schottenstien predicts that the first occupancy will be late <br />2000 with approximately 50 homes per year.&nbsp; He noted that <br />the Newark City Councilmembers have been most gracious <br />throughout this process, having been adamant that they would <br />address the problems and resented the fact that some people <br />didn&rsquo;t believe that.&nbsp; A Board will be formed consisting of <br />four members of the County Commission and three members <br />appointed by the Newark City Council and Granville School <br />Board, to perform administrative functions.<br />&nbsp;&nbsp; &nbsp;Councilmember Rader feels the citizens of Granville <br />owe Mr. Harf a great deal of gratitude for his efforts.&nbsp; He <br />asked if traffic issues generated by this development had <br />been discussed.<br />&nbsp;&nbsp; &nbsp;Mr. Harf stated that his perception is that the <br />Newark City Council understands this concern but felt this <br />discussion was not about trucks but about kids.&nbsp; Mr. Harf <br />stated "when push came to shove", Mr. Schottenstien, his <br />lawyer, and the Newark City Council acted honorably. <br />&nbsp;&nbsp;&nbsp; &nbsp;Mayor Bellman recognized the contribution from the <br />Newark City Council as they clearly acted honorable and <br />feels this leaves the foundation for the communities to work <br />together.&nbsp; He looks forward to the resolution of other <br />issues.<br />&nbsp;&nbsp; &nbsp;Mr. Harf stated that the School Board intends to <br />present a resolution to Schottenstien&rsquo;s, and Newark City <br />Council to formally thank everyone involved in this <br />resolution.<br />&nbsp;&nbsp; &nbsp;Vice Mayor McGowan suggested that Village Council <br />also entertain doing the same thing for the School Board, <br />Newark City Council, and Schottenstien&rsquo;s thanking them for <br />their efforts over this lengthy period.<br /><br /><br />Zoning Issues -<br /><br />&nbsp;&nbsp; &nbsp;Law Director&nbsp; Hurst noted two zoning issues that are <br />different from mainstream and asked Council for input.&nbsp; He <br />asked if Council would consider the construction and showing <br />of prefabricated modular homes as a permitted use within the <br />Community Service District, Section 1167.02(a)(1).&nbsp; He also <br />asked if a spa was considered a permitted use in Planned <br />&nbsp;<br /><br />Commercial Development District, Section 1171.02(b)(1)(a-g). <br />&nbsp;He reiterated that the issues at this time are strictly on <br />uses and not specifics.&nbsp; Council feels it is necessary to retain an expert to <br />work with that attorney toward the study of traffic flow in <br />the South Cherry Valley Road area.&nbsp; Council feels that it is <br />necessary to authorize reimbursement as necessary.&nbsp; Mr. <br />Doyle Clear of Barton-Aschman Associates, Inc. of Ohio was <br />present as a potential expert for this process.<br /><br /><br /><br />Special Council Meeting<br />November 23, 1998<br />Page 2<br />&nbsp;<br />Law Director Hurst advised that the Village should authorize <br />that attorney which has been hired by the Village, to retain <br />the services of an expert for the traffic study.&nbsp; He noted <br />that if the Village retains the expert, all information is <br />public information and not subject to any privilege.<br /><br />&nbsp;&nbsp; &nbsp;Mayor Bellman made a motion to authorize the Village <br />Manager, as a part of the current legal services that have <br />already been incurred, to authorize the expenditure of <br />certain expenses in support of the legal effort as directed <br />by the lawyer the Village has retained.&nbsp; Second by <br />Councilmember Wernet.<br /><br />&nbsp;&nbsp; &nbsp;Councilmember Wernet made a motion to amended the <br />Mayor&rsquo;s motion to specify a maximum dollar limit of $9,000. <br />&nbsp;Second by Mayor Bellman.<br /><br />&nbsp;&nbsp; &nbsp;Councilmember Rader noted his issue is that <br />Granville Village&rsquo;s involvement is only 3/10ths of a mile of <br />this road and Granville Township and Newark are also <br />involved.&nbsp; He feels it would be more appropriate to get <br />Newark and Granville Township Trustees involved because <br />their roads will be more affected than the Village roads. &nbsp;<br />He feels these three entities should sit down together, <br />split the costs so everyone is working toward the same goal. <br /><br />&nbsp;&nbsp; &nbsp;Councilmember Wernet feels the complexity of this <br />issue is that there have been threats from a representative <br />of Tamarack Farms and some in conjunction with the City of <br />Newark that the Village will be sued.&nbsp; He feels it is <br />appropriate that the Village have its own traffic people <br />working for its legal counsel given those sorts of threats.<br /><br />&nbsp;&nbsp;&nbsp; &nbsp;Council voted on the amendment for the $9,000 <br />clarification.&nbsp; Pearl Street stated he felt that <br />Ordinance No&rsquo;s. 19-98 and 20-98 seemed like wise, well <br />crafted Ordinances.<br /><br />Mayor Bellman closed the public hearing on Ordinance No&rsquo;s <br />19-98 and 20-98 at 7:32pm.<br /><br />&nbsp;&nbsp; &nbsp;A public hearing was held on Ordinance No. 21-98, An <br />Ordinance To Amend Section 145 Of The Village Of Granville&rsquo;s <br />Codified Ordinances By Adopting A New Personnel Policy.&nbsp; No <br />one appeared to speak for or against Ordinance No. 21-98.<br />&nbsp;<br />Hearing no comment, Mayor Bellman closed the public hearing <br />on Ordinance No. 21-98 at 7:35pm.<br /><br />Bob Howarth <br /><br />Mr. Howarth, legal representative for Tamarack Dairy Farms, <br />reported on the progress made with regard to the problem <br />that Ordinance No. 23-98 is aimed to correct.&nbsp; He noted that <br />he has met with several companies who currently use Cherry <br />Valley Road as a truck route.&nbsp; Having made numerous phone <br />calls which included a meeting with Elizabeth Welsh, Licking <br />County Chamber of Commerce, he feels there is still more <br />work to be done.&nbsp;&nbsp; He stated that due to time limitations, <br />he was only able to contact businesses that are&nbsp; affected by <br />this Ordinance.&nbsp; He mentioned an informal poll of the <br />sixteen companies he met with werein it was reported that <br />616 trips were made on a daily basis in and out of South <br />Cherry Valley Road.&nbsp; He stated that of those trips <br />approximately 68 used S.R. 661 through Granville.&nbsp; He feels <br />that Ordinance 23-98 will hurt business in the Cherry Valley <br />Road area and still not solve Granville&rsquo;s truck problem.&nbsp; He <br />estimates that only 10% of truck traffic generated by the <br />Cherry Valley access is using S.R. 661 through the Village. <br />&nbsp;He referred to a willingness by those business to try to <br />reduce truck trips through the Village and stated they are <br />actively working on results.&nbsp; He feels a lawsuit would not <br />solve the problem but only increase tension between <br />Granville and Newark.&nbsp; He asked Council for an extension of <br />Ordinance No. 23-98 so that this group can continue to work <br />toward a non-litigating solution to this problem.&nbsp; Mr. <br />Howarth stated that this Committee has agreed to provide a <br />third party mediator to facilitate a meeting between <br />Granville Village Council and Newark City Council.&nbsp; He feels <br />that such a meeting will resolve the macro differences which <br />will in turn take care of the smaller issue of truck access <br />on South Cherry Valley Road. <br /><br />&nbsp;&nbsp; &nbsp;Following a discussion, Council agreed that Mr. <br />Howarth&rsquo;s group was making progress and that a mediated <br />meeting with Newark would be worth the effort assuming both <br />sides came to the table in good faith.<br /><br />&nbsp;&nbsp; &nbsp;Bernie Lukco, of 343 E. College Street, feels that <br />the trucking companies have been authorized by this Council <br />to meet without citizen input.&nbsp; He feels it is appropriate <br />to have a citizens committee to study the same problem and <br />is concerned that the citizens are being excluded.<br /><br />Mayor Bellman noted that this Council had not sanctioned the <br />formation of the Committee.&nbsp; He feels strongly that a <br />citizens group would be welcome. &nbsp;<br /><br />Clifton Crais, experimented by driving an alternate route <br />down West Main Street to 21st Street (noting that the lights <br />on West Main Street are not timed), turning left on 21st <br />Street (noting that this turn is equivalent to the turn at <br />Broadway and Pearl St).&nbsp; He stated that this route was 1.2 <br />miles longer, and added 5 minutes to the trip.&nbsp; He stated <br />that his hope was that this legislation be drafted to look <br />at the existing problem as well as the future. &nbsp;<br /><br />Mayor Bellman noted that there was a "no through truck" sign <br />on 21st Street. It was noted that the Newark Advocate <br />reported that this was not enforced.<br />&nbsp;&nbsp; &nbsp; <br />Kim West, of River Road addressed Council with her concern <br />that the closing of Cherry Valley Road to through trucks <br />would increase truck traffic on River Road.&nbsp; She noted that <br />during the recent closing of South Cherry Valley Road for <br />construction, truck traffic on River Road&nbsp; increased <br />tremendously.&nbsp; She noted that a comment made during the last <br />Council meeting that the typography and layout of River Road <br />was not conducive to truck traffic was woefully inadequate. <br />&nbsp; She feels like River Road residents have been "thrown to <br />the wolves".&nbsp; She said she hoped they would get some <br />consideration although they are in the Township.&nbsp; She said <br />she had contacted Granville Police, State Highway Patrol, <br />and the Township Office with no results.<br /><br />Councilmember Robertson feels this is why these communities <br />need to come together.&nbsp; She added that this Council is not <br />causing the problem as they have not asked the trucks to use <br />River Road as their alternative route.<br /><br />Jim Jump, of 143 Thresher Street, warned Council against <br />heading in the direction of granting exemptions from <br />Ordinance No. 23-98 to a particular company.<br /><br />&nbsp;&nbsp; &nbsp;There was some discussion as to the legalities of <br />either delaying the enforcement or effectiveness of <br />Ordinance No. 23-98.&nbsp; Noting that one could refuse to <br />enforce, at this time, the Law Director expressed some <br />concern of altering the effective date of the Ordinance.&nbsp; He <br />will research this option. <br /><br />&nbsp;&nbsp; &nbsp;Mr. Howarth asked that a representative of this <br />Council contact a representative of Newark Council, assuming <br />there is a will on Newark&rsquo;s part, to agree to mediation and <br />a meeting date.&nbsp; He asked for help and involvement by this <br />Council.<br /><br />Bernie Lukco re-iterated that the issue to be raised during <br />mediation is a broader issue than just Cherry Valley Road.<br /><br />&nbsp;&nbsp; &nbsp;It was suggested that issues be written down so they <br />can be addressed.<br /><br />Clifton Crais stated he has a problem with Council reacting <br />to the initiatives of a representative of the people who <br />helped make the problem.&nbsp; He suggested Council keep the <br />initiative going while continuing to scrutinize the data <br />brought forth. &nbsp;<br /><br />&nbsp;&nbsp; &nbsp;It was decided that moving the effective date of <br />Ordinance No. 23-98 to January 11, 1999 was appropriate. &nbsp;<br />Mr. Howarth will report progress to Council during the month <br />of December.&nbsp; It was also noted that if the mediation was <br />not in the process in 60 days Council&rsquo;s position would be to <br />make Ordinance No. 23-98 effective at that time.<br /><br /><br />REVIEW AND APPROVAL OF MINUTES<br />&nbsp;&nbsp; &nbsp;<br /><br />Councilmember Rader questioned the status of the water loss <br />of several years ago.<br /><br />Manager Hickman noted that although there have been many <br />updates to the lines, the percentage of water loss is still <br />high and is still a concern.&nbsp; <br />Bernie Lukco thanked Council for its help in the resolution <br />of the "Old Middle School" parking lot situation.<br /><br />Jim Jump, Chairman of the JEDD noted that at their last <br />meeting he reviewed a map for the proposed "superhighway" <br />which run through the middle of Canyon Drive and Thornwood <br />Drive past Cherry Valley Lodge.&nbsp; He added that the theory is <br />to make the industrial and commercial development viable. &nbsp;<br />He also noted a proposed plan for a S.R.16 and 36 corridor <br />from I-77 will include a four lane highway for westbound <br />traffic coming from northwest Ohio to Granville.&nbsp; realistic cap is more successful if there <br />is an incentive structure.&nbsp; For example:&nbsp; If you have a <br />maximum on sick leave of 1500 hours, then there needs to be <br />a program that says between 1000 and 1500 hours, you will <br />allow for conversion of those hours to a formula of vacation <br />hours.&nbsp;&nbsp; &nbsp;Cherry Valley Road Traffic Study<br />&nbsp;&nbsp; &nbsp;Council discussed the idea of hiring a traffic <br />engineer for a South Cherry Valley Road study.<br />&nbsp;&nbsp; &nbsp;<br />&nbsp;&nbsp; &nbsp;Councilmember Rader was concerned with the cost of <br />hiring an engineer for such a project.&nbsp; He would like to see <br />an estimate before supporting this expense.<br />&nbsp;<br />Following a discussion, it was noted that Keith Myers had <br />suggested Doyle Clear of Columbus for such a review. &nbsp;<br />Manager Hickman will contact Mr. Clear for an estimate. &nbsp;<br /><br />&nbsp;&nbsp; Councilmember&rsquo;s Wernet and Robertson second.<br />&nbsp;&nbsp; &nbsp;<br />&nbsp;PUBLIC HEARING<br />&nbsp;&nbsp; &nbsp;A public hearing was held on Ordinance No. 19-98, An <br />Ordinance To Amend 1137.07 And To Enact Section 1137.09 Of <br />The Codified Ordinances Of The Village Of Granville, Ohio, <br />To Expand The Authority Of The Council, Law Director, And <br />Village Manager, To Prevent Violations Of The Zoning <br />Ordinance. <br /><br />A public hearing was held on Ordinance No. 20-98, An <br />Ordinance To Amend Sections 1135.01, 1137.01, 1137.02, <br />1137.05, 1137.07, 1139.04, 1139.05, 1141.04, 1141.05, <br />1147.04, And 1159.05, And To Enact Section 1137.09 Of The <br />Codified Ordinances Of The Village Of Granville, Ohio, To <br />Permit The Law Director And Taxpayers Of The Village To Take <br />Action To Prevent Unlawful Decisions And Orders Issued Under <br />The Zoning Ordinance.&nbsp; No one appeared to speak for or <br />against Ordinance No. 20-98. &nbsp;<br /><br />Clifton Crais, of 234 N. Pearl Street stated he felt that <br />Ordinance No&rsquo;s. 19-98 and 20-98 seemed like wise, well <br />crafted Ordinances.<br /><br />Mayor Bellman closed the public hearing on Ordinance No&rsquo;s <br />19-98 and 20-98 at 7:32pm.<br /><br />&nbsp;&nbsp; &nbsp;A public hearing was held on Ordinance No. 21-98, An <br />Ordinance To Amend Section 145 Of The Village Of Granville&rsquo;s <br />Codified Ordinances By Adopting A New Personnel Policy.&nbsp; No <br />one appeared to speak for or against Ordinance No. 21-98.<br />&nbsp;<br />Hearing no comment, Mayor Bellman closed the public hearing <br />on Ordinance No. 21-98 at 7:35pm.<br /><br />Bob Howarth <br /><br />Mr. Howarth, legal representative for Tamarack Dairy Farms, <br />reported on the progress made with regard to the problem <br />that Ordinance No. 23-98 is aimed to correct.&nbsp; He noted that <br />he has met with several companies who currently use Cherry <br />Valley Road as a truck route.&nbsp; Having made numerous phone <br />calls which included a meeting with Elizabeth Welsh, Licking <br />County Chamber of Commerce, he feels there is still more <br />work to be done.&nbsp;&nbsp; He stated that due to time limitations, <br />he was only able to contact businesses that are&nbsp; affected by <br />this Ordinance.&nbsp; He mentioned an informal poll of the <br />sixteen companies he met with werein it was reported that <br />616 trips were made on a daily basis in and out of South <br />Cherry Valley Road.&nbsp; He stated that of those trips <br />approximately 68 used S.R. 661 through Granville.&nbsp; He feels <br />that Ordinance 23-98 will hurt business in the Cherry Valley <br />Road area and still not solve Granville&rsquo;s truck problem.&nbsp; He <br />estimates that only 10% of truck traffic generated by the <br />Cherry Valley access is using S.R. 661 through the Village. <br />&nbsp;He referred to a willingness by those business to try to <br />reduce truck trips through the Village and stated they are <br />actively working on results.&nbsp; He feels a lawsuit would not <br />solve the problem but only increase tension between <br />Granville and Newark.&nbsp; He asked Council for an extension of <br />Ordinance No. 23-98 so that this group can continue to work <br />toward a non-litigating solution to this problem.&nbsp; Mr. <br />Howarth stated that this Committee has agreed to provide a <br />third party mediator to facilitate a meeting between <br />Granville Village Council and Newark City Council.&nbsp; He feels <br />that such a meeting will resolve the macro differences which <br />will in turn take care of the smaller issue of truck access <br />on South Cherry Valley Road. <br /><br />&nbsp;&nbsp; &nbsp;Following a discussion, Council agreed that Mr. <br />Howarth&rsquo;s group was making progress and that a mediated <br />meeting with Newark would be worth the effort assuming both <br />sides came to the table in good faith.<br /><br />&nbsp;&nbsp; &nbsp;Bernie Lukco, of 343 E. College Street, feels that <br />the trucking companies have been authorized by this Council <br />to meet without citizen input.&nbsp; He feels it is appropriate <br />to have a citizens committee to study the same problem and <br />is concerned that the citizens are being excluded.<br /><br />Mayor Bellman noted that this Council had not sanctioned the <br />formation of the Committee.&nbsp; He feels strongly that a <br />citizens group would be welcome. &nbsp;<br /><br />Clifton Crais, experimented by driving an alternate route <br />down West Main Street to 21st Street (noting that the lights <br />on West Main Street are not timed), turning left on 21st <br />Street (noting that this turn is equivalent to the turn at <br />Broadway and Pearl St).&nbsp; He stated that this route was 1.2 <br />miles longer, and added 5 minutes to the trip.&nbsp; He stated <br />that his hope was that this legislation be drafted to look <br />at the existing problem as well as the future. &nbsp;<br /><br />Mayor Bellman noted that there was a "no through truck" sign <br />on 21st Street. It was noted that the Newark Advocate <br />reported that this was not enforced.<br />&nbsp;&nbsp; &nbsp; <br />Kim West, of River Road addressed Council with her concern <br />that the closing of Cherry Valley Road to through trucks <br />would increase truck traffic on River Road.&nbsp; She noted that <br />during the recent closing of South Cherry Valley Road for <br />construction, truck traffic on River Road&nbsp; increased <br />tremendously.&nbsp; She noted that a comment made during the last <br />Council meeting that the typography and layout of River Road <br />was not conducive to truck traffic was woefully inadequate. <br />&nbsp; She feels like River Road residents have been "thrown to <br />the wolves".&nbsp; She said she hoped they would get some <br />consideration although they are in the Township.&nbsp; She said <br />she had contacted Granville Police, State Highway Patrol, <br />and the Township Office with no results.<br /><br />Councilmember Robertson feels this is why these communities <br />need to come together.&nbsp; She added that this Council is not <br />causing the problem as they have not asked the trucks to use <br />River Road as their alternative route.<br /><br />Jim Jump, of 143 Thresher Street, warned Council against <br />heading in the direction of granting exemptions from <br />Ordinance No. 23-98 to a particular company.<br /><br />&nbsp;&nbsp; &nbsp;There was some discussion as to the legalities of <br />either delaying the enforcement or effectiveness of <br />Ordinance No. 23-98.&nbsp; Noting that one could refuse to <br />enforce, at this time, the Law Director expressed some <br />concern of altering the effective date of the Ordinance.&nbsp; He <br />will research this option. <br /><br />&nbsp;&nbsp; &nbsp;Mr. Howarth asked that a representative of this <br />Council contact a representative of Newark Council, assuming <br />there is a will on Newark&rsquo;s part, to agree to mediation and <br />a meeting date.&nbsp; He asked for help and involvement by this <br />Council.<br /><br />Bernie Lukco re-iterated that the issue to be raised during <br />mediation is a broader issue than just Cherry Valley Road.<br /><br />&nbsp;&nbsp; &nbsp;It was suggested that issues be written down so they <br />can be addressed.<br /><br />Clifton Crais stated he has a problem with Council reacting <br />to the initiatives of a representative of the people who <br />helped make the problem.&nbsp; He suggested Council keep the <br />initiative going while continuing to scrutinize the data <br />brought forth. &nbsp;<br /><br />&nbsp;&nbsp; &nbsp;It was decided that moving the effective date of <br />Ordinance No. 23-98 to January 11, 1999 was appropriate. &nbsp;<br />Mr. Howarth will report progress to Council during the month <br />of December.&nbsp; It was also noted that if the mediation was <br />not in the process in 60 days Council&rsquo;s position would be to <br />make Ordinance No. 23-98 effective at that time.<br /><br /><br />REVIEW AND APPROVAL OF MINUTES<br />&nbsp;&nbsp; &nbsp; The minutes of the regularly scheduled meeting of <br />November 4, 1998, were presented for review.&nbsp; Councilmember <br />Wernet&nbsp; moved to approve the minutes as amended. &nbsp;<br />Councilmember Robertson second.&nbsp; Motion carried.&nbsp;&nbsp; &nbsp;<br /><br />MAYOR&rsquo;S REPORT<br />The Mayor&rsquo;s Court Report for the month of October was <br />presented for review.<br /><br />&nbsp;&nbsp; &nbsp;Vice Mayor McGowan directed the clerk to file the <br />report.&nbsp; A copy of that report is attached as part of these <br />minutes.<br />&nbsp;<br />MANAGER&rsquo;S REPORT<br />&nbsp;&nbsp; &nbsp;The Manager&rsquo;s Report for the month of October was <br />presented for review.&nbsp; &nbsp;<br /><br />Councilmember Rader questioned the status of the water loss <br />of several years ago.<br /><br />Manager Hickman noted that although there have been many <br />updates to the lines, the percentage of water loss is still <br />high and is still a concern.&nbsp; As mentioned, he will check <br />the water fountain on Broadway.<br /><br />Councilmember Wernet moved to accept the Manager&rsquo;s Report. &nbsp;<br />Councilmember Ben seconded.&nbsp; Motion carried.&nbsp; <br />Bernie Lukco thanked Council for its help in the resolution <br />of the "Old Middle School" parking lot situation.<br /><br />Jim Jump, Chairman of the JEDD noted that at their last <br />meeting he reviewed a map for the proposed "superhighway" <br />which run through the middle of Canyon Drive and Thornwood <br />Drive past Cherry Valley Lodge.&nbsp; He added that the theory is <br />to make the industrial and commercial development viable. &nbsp;<br />He also noted a proposed plan for a S.R.16 and 36 corridor <br />from I-77 will include a four lane highway for westbound <br />traffic coming from northwest Ohio to Granville.&nbsp; He feels <br />this is the ideal way to shunt traffic away from Granville <br />and south to I-70.&nbsp; He also noted the need for information <br />on the present water and sewer capacity which he will <br />request from Manager Hickman. &nbsp;<br />&nbsp;<br />COMMITTEE REPORTS<br />&nbsp;<br />Councilmember Wernet noted that the Planning Committee <br />lacked a quorum therefore there was no voting during the <br />last meeting.<br /><br />Councilmember McGowan noted that the Lighting Committee <br />hopes to meet before the end of the year to address the <br />placement of 1999 lights.<br /><br />OLD BUSINESS<br />&nbsp;<br />Ordinance No. 19-98, An Ordinance To Amend 1137.07 And To <br />Enact Section 1137.09 Of The Codified Ordinances Of The <br />Village Of Granville, Ohio, To Expand The Authority Of The <br />Council, Law Director, And Village Manager, To Prevent <br />Violations Of The Zoning Ordinance.&nbsp; &nbsp;Resolution No. 98-46, To Award The Bid For The <br />Purchase Of Water Treatment Chemicals, was introduced was <br />introduced and read in full by Councilmember McGowan. &nbsp;<br />Second by Councilmember Rader. &nbsp;<br /><br />&nbsp;<br />MEETING ANNOUNCEMENTS<br />&nbsp;<br />&nbsp;&nbsp; &nbsp;Cherry Valley Road Traffic Study<br />&nbsp;&nbsp; &nbsp;Council discussed the idea of hiring a traffic <br />engineer for a South Cherry Valley Road study.<br />&nbsp;&nbsp; &nbsp;<br />&nbsp;&nbsp; &nbsp;Councilmember Rader was concerned with the cost of <br />hiring an engineer for such a project.&nbsp; He would like to see <br />an estimate before supporting this expense.<br />&nbsp;<br />Following a discussion, it was noted that Keith Myers had <br />suggested Doyle Clear of Columbus for such a review. &nbsp;<br />Manager Hickman will contact Mr. Clear for an estimate. &nbsp;<br /><br />&nbsp;&nbsp; &nbsp;Councilmember Wernet made a motion to direct the <br />Village Manager to go forth and get an estimate as promptly <br />as possible, and then have the information regarding the <br />estimate distributed to Councilmembers and hold a special <br />meeting thereafter.&nbsp; &nbsp;Spellman/Granger Intersection -<br />&nbsp;&nbsp; &nbsp;Councilmember Wernet relayed a constituent&rsquo;s concern <br />for the need of a stop sign at the corner of Granger and <br />Spellman Streets.&nbsp;&nbsp; &nbsp;&nbsp;&nbsp; &nbsp;<br />PUBLIC HEARING<br />Councilmember Rader made a motion to table the public <br />hearings on Ordinances No. 19-98, 20-98 and 21-98 until the <br />Council meeting of November 18, 1998.&nbsp; Second by <br />Councilmember Lucier.&nbsp; Motion Carried. &nbsp;<br /><br />&nbsp;&nbsp; &nbsp;A public hearing was held on Ordinance No. 23-98, An <br />Ordinance To Prohibit "Thru-Truck" Traffic Through The <br />Village Of Granville.<br /><br />&nbsp;&nbsp; &nbsp;Mayor Bellman stated there would be a 2 minute time <br />limit on public comments.&nbsp; &nbsp;<br /><br />It was noted that Council has a "revised draft" which draws <br />upon Ordinances already in the Granville Codified, which has <br />the same general effect and goals and this is intended to <br />return the Village to a peaceful community as it is thought <br />to be. <br /><br />Councilmember Rader voiced a concern that some of the <br />traffic traveling through the Village on S.R. 661 is <br />originated by the access of South Cherry Valley Road but <br />also feels an arrangement might be made for shippers to use <br />an alternate route.<br /><br />Councilmember Wernet noted that this issue was significant <br />in the last campaign.&nbsp; He also stated that such issues were <br />not already addressed as there was hope of reaching a mutual <br />agreement with neighboring communities on infrastructure <br />related issues.&nbsp; He mentioned the lack of response from <br />neighboring communities to resolve infrastructure issues and <br />feels that developers should also pay their fair share of <br />infrastructure improvements.<br /><br />Mayor Bellman noted that the message sent out by Newark City <br />Council was that they will only do what is good for them and <br />not necessarily for the entire community.&nbsp;&nbsp; Although not the <br />preferred way, it appears Granville will need to solve its <br />own problems in a similar fashion. &nbsp;<br /><br />Commenting on the disregard for infrastructure, <br />Councilmember Wernet quoted a constituent as saying that "we <br />don&rsquo;t want to use up all our road capacity to basically <br />benefit development which occurs in a different community." <br />&nbsp;<br /><br />Bob Howarth, a Columbus attorney representing The Kroger <br />Company, noted that Tamarack Farms Dairy has supplied milk <br />throughout the stated of Ohio for 28 years. He stated that <br />restricting Tamarack Dairy trucks from this &frac14; mile section <br />of South Cherry Valley Road could effectively shut down milk <br />distribution in the state of Ohio.&nbsp; Adding that Kroger is a <br />community minded company, he asked that the Council not take <br />away its distribution system.<br /><br />Clifton Crais, of 234 N. Pearl Street,&nbsp; stated that the <br />voters are asking for legislation to control unwanted truck <br />traffic.&nbsp; He feels this Ordinance would improve public <br />safety by reducing the volume truck traffic on Village <br />streets adding that these streets cannot support large <br />tractor trailer traffic.&nbsp; He feels that the narrowness of <br />Village streets poses a significant risk to Village <br />residents.&nbsp; He noted that legislation enhances public health <br />as diesel emission is responsible for much of the air <br />pollution and disease in this country, and that the control <br />of trucks will reduce noise, pollution, and protect historic <br />homes which are literally being knocked off their <br />foundations.&nbsp; He feels that this Ordinance would enhance the <br />commercial vitality of the downtown area. <br /><br />Bill Englefield, Chairman of the Board of Englefield Oil <br />Company, residing at 2352 Hankinson Road, agreed that it is <br />commendable to try to reduce truck traffic thorough the <br />Village, however, he feels that prohibiting this type of <br />traffic on that section of Cherry Valley Road will only hurt <br />local business.&nbsp; He feels there is another agenda behind <br />this issue. <br /><br />Allen Frye, a professional truck driver from Danville, Ohio, <br />noted he has driven over 5 &frac12; years and has over 500,000 <br />accident and ticket free miles.&nbsp; He voiced a concern with <br />the closing of South Cherry Valley Road as this section is <br />used as an access road to S.R. 16 going east and west and <br />that this closing will not decrease the number of trucks <br />traveling through Granville.&nbsp; He noted that truck traffic <br />traveling out of their way causes more road time and <br />therefore more pollution, adding rerouting would add an <br />additional 1 &frac12; hours to his route.&nbsp; He also feels that law <br />enforcement would be taken away from the Village area to <br />enforce this &frac14; mile section. <br /><br />&nbsp;&nbsp; &nbsp;Mayor Bellman asked Mr. Frye what route he currently <br />took and what a alternate route might be. <br /><br />&nbsp;&nbsp; &nbsp;Mr. Frye said he drives out of Mt. Vernon on S.R. <br />661 to S.R. 16 and Cherry Valley Road.&nbsp; He stated another <br />route would take him from S.R. 13 to S.R. 79 to access his <br />terminal which is located in the area of the Air Force base.<br /><br />Don Contini, 315 N. Pearl Street, referring to the speakers <br />before him stated that he pays taxes in Granville and wants <br />maintain the quality of life in Granville.&nbsp; He doesn&rsquo;t want <br />trucks coming within his historical Village.&nbsp; He stated he <br />doesn&rsquo;t care if trucks have to go out of their way by <br />driving extra miles and polluting the countryside.&nbsp; He <br />doesn&rsquo;t want trucks going through Granville Village.&nbsp; He <br />feels that Granville is becoming a truck route.<br /><br />Deder Herem of Columbus, Principal Officer of Universal <br />Veneer, voiced the same concern as Tamarack Dairy (Kroger). <br />&nbsp;He stated it would be a devastating blow to have to divert <br />truck traffic from Cherry Valley Road.&nbsp; He feels that <br />Universal Veneer has been a good neighbor and can appreciate <br />the comments of support for the Ordinance.&nbsp; He stated that <br />70% of their production is export and taxes are being paid <br />in Licking County.&nbsp; He feels the economical impact will be <br />severe.<br /><br />&nbsp;&nbsp; &nbsp;Councilmember Robertson questioned the economic <br />benefit to Granville by the use of that portion of Cherry <br />Valley Road.&nbsp; Mr. Herem stated he would research and provide <br />Councilmember Robertson with a breakdown of economic <br />benefits to Granville.<br /><br />&nbsp;&nbsp; &nbsp;Mr. Englefield noted that the economic value to <br />Granville is in the numerous employees working for these <br />companies that live in Granville and pay their share of <br />income taxes.&nbsp; He stated that having a business in a <br />community helps the whole community. <br /><br />Mr. Herem stated that few Universal Veneer trucks travel <br />S.R. 661 through Granville as the majority use the Cherry <br />Valley Road access to S.R. 16 east or west and onto other <br />destinations.<br /><br />It was also noted that Tamarack&rsquo;s incoming raw milk comes <br />south on S.R. 661 (from farms around the county) however, no <br />trucks exit through the Village of Granville. <br /><br />Mr. Englefield stated that less than 2% of truck traffic in <br />the Village belonged to&nbsp; Englefield Oil.<br /><br />Jeff Wintermute, Sales Manager for Van Wey Sand and Gravel, <br />and also a resident of Granville stated that he pays an <br />extra 3 cents per gallon for fuel tax that goes for roads <br />such as S.R. 661.&nbsp; He stated that the residents of North <br />Pearl Street knew it was a state route before buying there. <br />&nbsp;He noted that truckers aren&rsquo;t using roads through this <br />Village just because they want to.&nbsp; He also stated that it <br />is not safe to travel West Main Street in Newark as there <br />are two school zones and a hospital zone on that street. &nbsp;<br /><br />Steve Cramer, of 235 E. Broadway, and pastor of the Untied <br />Methodist Church of Granville, noted that he lives in the <br />church parsonage and had no choice where his family would <br />live.&nbsp; Although he loves the Granville community he didn&rsquo;t <br />bargain for all the traffic.&nbsp; He feels that by closing <br />Cherry Valley Road it would help the surrounding community <br />see the need to address the North/South traffic issue. &nbsp;<br /><br />Vivian Ashbaugh, of 121 N. Pearl Street, stated that the <br />maintenance and upkeep of Cherry Valley road is paid by the <br />Village of Granville adding that the taxes paid by those <br />Companies represented here this evening are paid to the City <br />of Newark.&nbsp; She expressed concern with additional traffic <br />that will be generated by the Keny development.<br /><br />Patty Myers, of 229 E. College Street, finishing Mr. Crais&rsquo; <br />statement, noted that large trucks are responsible for the <br />wear and tear which destroys our roads.&nbsp; She asked any <br />member of Council not supporting the substance of this <br />Ordinance to explain why public safety and public health are <br />not important. She stated that most of the truck traffic <br />through the Village has its origin in Newark. &nbsp;<br /><br />Judy Handle, of River Road, noted that the last time Cherry <br />Valley Road was closed for construction, all the trucks and <br />traffic used River Road.&nbsp; She stated that there are also <br />historical homes on River Road that should be taken into <br />consideration as part of the same community as the Village. <br />&nbsp;She asked that Council exclude this &frac14; mile of S. Cherry <br />Valley Road from this Ordinance. <br /><br />&nbsp;&nbsp; &nbsp;It was noted that the Ordinance allows Council to <br />earmark truck routes.<br /><br />Ted Handle, also of River Road, is concerned with the way <br />the Keny property was annexed into Newark.&nbsp; He stated the <br />intersection of Cherry Valley Road and S.R. 16 was created <br />and paid for by the State Of Ohio and the only reason <br />Granville has it is because it was annexed.&nbsp; And feels this <br />is going to hurt all the businesses and feels Council is <br />taking a very hard nose to this issue.<br /><br />John Castle, of 216 E. College Street, expressed a concern <br />with traffic that is diverted onto College Street from <br />Broadway.&nbsp; He stated that the large amount of traffic on <br />College Street is speeding and not stopping at stop signs. &nbsp;<br />He stated that his historical home was falling apart because <br />of traffic.<br /><br />Ken Blair, of 2545 North Street, stated he had moved here in <br />1995 because of the school system.&nbsp; He is concerned with the <br />affects of this ordinance in the access of trucks to&nbsp; his <br />farm. <br /><br />Maxine Montgomery, of 2450 Newark Granville Road, asked what <br />the implementation and enforcement of this plan might be and <br />if there would be additional costs to enforce this <br />Ordinance?<br /><br />It was noted that signs would be posted and the identifiable <br />trucking companies would be notified along with several days <br />of warnings issued by the Police Department.&nbsp; It was also <br />noted that there would be additional costs due to increased <br />law enforcement.<br /><br />Judith Thomas, of 4 Sheppard Place, noted that although she <br />is not affected by trucks she feels this is the right thing <br />to do.&nbsp; She also feels that this is a temporary "stop gap" <br />measure.&nbsp; She also feels that the general idea is to find <br />alternative north/south routes.<br /><br />Bernie Lukco, of 343 E. College Street, states that he <br />supports this Ordinance.&nbsp; He then asked the trucking <br />representatives in attendance where they have been over the <br />years as this issue has been discussed in the past.&nbsp; He <br />thinks it is time to step up and take action as these trucks <br />are causing damage and problems within our Village.<br /><br />Melanie Shot, of&nbsp; N. Pearl Street, also feels the truck <br />traffic in Village is excessive and something should be <br />done.<br /><br />Carl Wildrop, 224 Fairfield in Newark, and owner of a <br />trucking company near Cherry Valley Road, stated that the <br />last thing his company wanted to do was cause problems for <br />any community.&nbsp; He questioned the legality in closing S. <br />Cherry Valley to truck traffic referencing an article he <br />read that deals with trucks being allowed to travel up to <br />one mile off of State Routes. &nbsp;<br /><br />Constance Barsky, 221 E. Elm Street, supports the Ordinance. <br />&nbsp;She feels that as a society we have been dominated by the <br />automobile and the increase of trucks on roads is due to the <br />inability of the railroad to respond to new technology.&nbsp; She <br />noted that until these businesses have been threatened there <br />has been no willingness to negotiate. &nbsp;<br /><br />Jeff Wintermute noted that material things are made possible <br />only by trucks.&nbsp; He&nbsp; feels this is being hard on truck <br />drivers and is concerned that this might upset truck drivers <br />which could cause retaliation. &nbsp;<br /><br />Clifiton Crais noted he found the gentlemen&rsquo;s threat <br />disturbing but not surprising.&nbsp; He stated that he had called <br />Tamarak Farms and was told there were a number of <br />alternative roads that could be used but Cherry Valley is <br />the most convenient.&nbsp; He feels the argument that businesses <br />will be destroyed is bogus. <br /><br />Kevin ? , General Manager of Tamarack Farms, stated there <br />were alternative routes however they are inconvenient.&nbsp; He <br />noted that Mr. Crais may have called Tamarak Farms however <br />he hadn&rsquo;t spoke to him.&nbsp; He again noted that Cherry Valley <br />Road is used by his company for access to east or west S.R. <br />16, and that only raw milk coming from Licking County <br />Farmers is routed on S.R. 661, where these trucks will <br />continue to use this route whether Cherry Valley Road is <br />closed or not. &nbsp;<br /><br />Bill Englefield hopes this doesn&rsquo;t turn into "you against <br />us".&nbsp; He feels what the Village is trying to accomplish is <br />good and the trucking industry should help.&nbsp; He also stated <br />he has been working on S.R. 157 since 1972.&nbsp; He asked that <br />Council consider passing this legislation with the exemption <br />of S. Cherry Valley Road.&nbsp; He stated no one is against <br />Granville, and the truck drivers aren&rsquo;t mad at anybody.<br /><br />Bob Howarth asked what Granville had to gain by closing S. <br />Cherry Valley, and how this will help the problems Village <br />streets.<br /><br />&nbsp;&nbsp; &nbsp;Mayor Bellman noted it is not the intention to hurt <br />businesses whether they are in Newark or not.&nbsp; He questioned <br />why people weren&rsquo;t asking the Newark City Council why it did <br />not consider Granville by the actions Newark has taken. &nbsp;<br />Newark has said they are going to do what is good for them <br />and that Granville will have to deal with their own <br />problems.&nbsp; With this attitude by Newark, he questioned why <br />we should be overly concerned about the impact of the <br />current legislation on Newark.<br /><br />&nbsp;Deder Harram questioned how the members of this Council <br />would justify to the River Road citizens the increased truck <br />traffic to eliminating through trucks on S. Cherry Valley.<br /><br />&nbsp;&nbsp; &nbsp;Councilmember Wernet stated that he does not <br />anticipate that a trucking firm would be reckless enough to <br />take that sort of route. &nbsp;<br />&nbsp;<br /><br /><br style="font-size: 120%;" />&nbsp;&nbsp; &nbsp;Ordinance No. 23-98 <br />Vice Mayor&nbsp; McGowan asked the Law Director to expand on his <br />current knowledge of this subject.<br /><br />Law Director Hurst advised that an individual with the area <br />of expertise in transportation regulation, corridor access, <br />etc., has been contacted.&nbsp; He noted that this individual has <br />agreed to make a comprehensive listing and regulation of the <br />streets and intersections in the areas of concern.&nbsp; He noted <br />that this gentlemen should be able to report back to Council <br />with a list of options and regulations with 2 or 3 weeks.<br /><br />Vice Mayor McGowan re-iterated that he is more comfortable <br />with getting more than one opinion before casting a vote on <br />something that could be taking us to court on issues or <br />addressing something that could terminate businesses <br />severely.&nbsp; He is not in favor of an emergency dealing with <br />this ordinance.<br /><br />Councilmember Minklei is convinced that the right thing to <br />do is to pass this Ordinance.&nbsp; She feels this needs to be <br />the start of more discussion and is afraid that if this <br />Ordinance is not passed, everyone will go away and not <br />return as there would be no reason to.&nbsp; She made it make <br />clear that this is not a matter of revenge for what Newark <br />has done with Keny but it is only the ultimate frustration. <br />&nbsp;She also feels there is need for a comprehensive approach <br />to the north/south issue. &nbsp;<br /><br />Councilmember Robertson stated she was in agreement with Ms. <br />Minklei, however should would like this Ordinance to pass <br />and simultaneously create a committee to review. &nbsp;<br /><br />There was discussion about enacting the Ordinance and <br />delaying the enforcement of Cherry Valley Road. <br /><br />Bob Howarth committed Kroger (Tamarack Dairy) and Universal <br />Veneer to this issue and will do his best to contact a list <br />of companies supplied by the Village and invite them to <br />these meetings.&nbsp; He asked for 30 days to put together a <br />committee and some discussion about this issue.&nbsp; He said <br />that this committee will put together a plan.&nbsp; He asked that <br />anyone in attendance could sign up to be a part of an ad hoc <br />committee.&nbsp; He will contact these individuals and to <br />effectuate a plan and return to Council in 2 weeks with a <br />report.<br /><br />It was noted that the ordinance will not take affect for 30 <br />days.&nbsp; Within that time if a solution to the truck traffic <br />problem is going well the grace period could be extended. &nbsp;<br />It was noted that the need for an emergency clause has been <br />eliminated. &nbsp;<br />&nbsp;&nbsp; &nbsp;<br />&nbsp;&nbsp; &nbsp;Councilmember Robertson moved the question.<br /><br />Councilmember Wernet made a motion to amend Ordinance No. <br />23-98 as follows:&nbsp; Delete the title and insert "An Ordinance <br />To Amend Sections 301.38, 301.44 through 301.53, 303.99, <br />305.02, And 339.02, And To Enact Section 331.44 Of The <br />Codified Ordinances Of The Village Of Granville, Ohio. To <br />Provide Uniform Regulation Of Truck Traffic In The Village <br />Of Granville", make insertion into the Section I to conform <br />with the title, and remove the emergency clause.&nbsp; Second by <br />Councilmember Minklei.&nbsp; All ayes.&nbsp; Motion carried.<br /><br />Roll call vote to adopt Ordinance No. 23-98:&nbsp; Robertson yes, <br />Minklei yes, Lucier yes, Rader yes, McGowan yes, Wernet yes, <br />Bellman yes.&nbsp; Seven yes votes.&nbsp; Ordinance No. 23-98 is <br />adopted. &nbsp;<br /><br /><br />CITIZENS COMMENTS<br /><br />Bernie Lukco, of 343 E. College Street, reported to Council <br />on the "Old Middle School" parking issue.&nbsp; He noted that the <br />neighbors have no objection to using this lot as a parking <br />lot but that the area should be defined, graveled so there <br />is no run-off, and that posts with a chain connection be put <br />at the entrance with School Administration responsible for <br />making sure it is locked.&nbsp; He noted that the Board of <br />Education has given the impression that they are not <br />interested in working with this group.<br /><br />Rochelle Steinberg, of 425 E. College Street, read a letter <br />with concerns.&nbsp; She stated that the site plan approval was <br />given to the School Board by the Planning Commission and the <br />BZBA and that the School Board has not complied to date. &nbsp;<br />She mentioned a "temporary" arrangement which had been <br />agreed to and expressed concern of such an agreement.&nbsp; She <br />feels there is no legal basis to vary from the approved plan <br />which she feels sets a risky precedent for the Village.&nbsp; She <br />asked that until property drainage and proper screening was <br />provided that parking on the lot not be permitted.&nbsp; She also <br />asked that the Police Department be authorized to enforce <br />the no parking policy and ticket/tow vehicles on the lot.<br /><br />Robin Bartlett, of 410 E. Broadway, also reading a statement <br />to Council, stated she is the most directly affected by a <br />temporary parking lot.&nbsp; She stated that headlights, noise of <br />engines, car doors, and people conversing will be an undue <br />burden to her.&nbsp; She asked that the Village Council visit her <br />property and investigate how important screening is in this <br />situation. &nbsp;<br /><br />Clifton Crais stated he feels it is a good idea that the <br />Village hire an expert to research traffic issues.&nbsp; He asked <br />that this expert speak with the community for input but be <br />directed to not participate in the ad hoc committee.<br /><br />Law Director Hurst Rufus stated that this person was not a <br />consultant.&nbsp; He noted that this is a lawyer who will define <br />for only this Council what its regulatory options are, <br />notwithstanding what the various parties wishes may be.&nbsp; He <br />will tell this Council what the law says it can do.<br /><br />&nbsp;&nbsp; &nbsp;John Castle, of 216 E. College Street, feels other <br />things need to be done in regard to the traffic.&nbsp; He again <br />stated his concern with the amount of traffic on College <br />Street.&nbsp; He suggested signs saying all through traffic must <br />use state routes. <br /><br />Jim Jump, of 143 Thresher Street, explained that the Manager <br />had asked for his input on Ordinance No. 23-98.&nbsp; He stated <br />he does support consulting a true motor vehicle lawyer.&nbsp; He <br />also reminded that the Licking County Planning Commission <br />has offered to donate $10,000 for a traffic study with <br />regard to the Thornwood project.<br /><br />Don Contini, of 315 N. Pearl Street, feels this Council <br />should sit down with the School Board to address the Old <br />Middle School parking lot issues. <br /><br />Jim Harf, a member of the School Board, stated that he was <br />unaware of the magnitude of this problem.&nbsp; He stated that <br />there were things being done, like putting railing up on the <br />entrance, grading, putting cement barriers to define the <br />parking, posts and a chain.&nbsp; He mentioned the possibility of <br />using a snow fence to deter parking.&nbsp; He feels the School <br />Board has acted in good faith in working with the Village <br />Manager and Planner.&nbsp; He noted that Village Police do not <br />have authority to tow vehicles illegally parked in the <br />parking lot.&nbsp; He noted that the Board had instructed the <br />Superintendent that all violators are to be towed.&nbsp; He noted <br />that the lots are to be put up for sale as soon as possible.<br /><br />Manager Hickman noted that a permit has been issued to allow <br />for a temporary lot with a chain.&nbsp; He suggested that the <br />snow fence be added and they need to be responsible for <br />towing.<br /><br />&nbsp;&nbsp; &nbsp;David Bussan, of 420 E. Broadway, stated he has 128 <br />ft of property line that is contiguous to where the Middle <br />School used to be.&nbsp; He noted that since the demolition the <br />ground has not been graded away from his property and water <br />drains into the back of his lot.&nbsp; He voiced a concern that <br />the permit allows 2 years before the parking lot must be <br />complete and asked who will be responsible for drainage <br />problems on these lots if they are sold in the mean time.<br /><br />Jim Harf stated that the School Board would solve the <br />drainage problem to the satisfaction of the Village.&nbsp; He <br />stated that future property owners will be responsible for <br />solving the water drainage on their property.&nbsp; He said the <br />school board is trying to get this issue resolved as soon as <br />possible.<br /><br />&nbsp;&nbsp; &nbsp;Councilmember Robertson remarked that the lights on <br />the side of the new elementary school were too bright and <br />suggested they be adjusted.&nbsp; She also asked if the new <br />railing was temporary and if it had been approved.<br /><br />&nbsp;&nbsp; &nbsp;Mr. Harf stated that he would look into the bright <br />light issue.&nbsp; He does not remember whether there was a <br />railing approved.<br /><br />Don Contini suggested that volunteers put up concrete posts <br />with chains around the lot as a temporary measure to block <br />traffic from parking in the lot.&nbsp; He suggested that the <br />School Board pay for the supplies. <br /><br />&nbsp;&nbsp; &nbsp;Jim Havens committed to talking to the School Board <br />to get a clearer idea of what is to happen on a temporary <br />basis and work on the problems from that point.<br /><br />&nbsp;&nbsp; &nbsp;David Bussan, of 420 E. Broadway, noted that the <br />speed limit is not being enforced along E. Broadway.<br /><br />&nbsp;&nbsp; &nbsp;It was suggested that the Manager get a report from <br />the Chief of Police with regard to E. Broadway enforcement.<br /><br />Maxine Montgomery also reminded Council and Citizens to <br />remember that there has been a shuffling of responsibilities <br />in the Village Offices.&nbsp; She hopes that Council evaluates <br />that situation closely because if people are spread too <br />thin, money may be saved but productivity is reduced. She <br />then asked if the Law Director had given an opinion on <br />Ordinances No. 19 and 20-98.&nbsp; &nbsp;<br /><br />&nbsp;&nbsp; &nbsp;Councilmember Wernet noted that Council would take <br />into consideration the Law Directors thoughts on these <br />Ordinances.&nbsp;&nbsp; He also stated that this Council was very <br />please with what the staff has been able to accomplish with <br />reduced cost.&nbsp; He stated that was one of the factors that <br />led to the 1.52% "bonus" to Village employees.&nbsp; He stated <br />that the Personnel Committee has been looking very carefully <br />to make sure things aren&rsquo;t stretched too thin.<br /><br />CHERRY VALLEY ROAD<br /><br />&nbsp;&nbsp; &nbsp;Mayor Bellman questioned why the Village was putting <br />in five lanes on S. Cherry Valley Road if it is going to be <br />consumed by another community.&nbsp; He noted that this section <br />of road was under construction and Council needs to make a <br />decision.&nbsp; He questioned why Granville would build five <br />lanes for other community&rsquo;s to benefit.&nbsp; He feels that if <br />we&rsquo;re concerned about overburdening our schools why are we <br />facilitating the sale of those lots (Keny) by improving the <br />road that leads to them.<br /><br />&nbsp;&nbsp; &nbsp;Councilmember Rader noted that this road improvement <br />was approved by the Planning Commission during the Bob Evans <br />site plan approval.&nbsp; It was noted that it is too late to <br />change that plan.<br /><br />Manager Hickman noted a provision had been made in next <br />years budget to work with Keith Myers, and others, in the <br />review of traffic patterns and parking.<br />&nbsp;<br />COMMITTEE REPORTS<br /><br />Councilmember Lucier reported that the Union Cemetery Board <br />met with legal advisers today and are moving ahead on the <br />Cemetery boundary dispute.<br /><br />She also thanked Manager Hickman for his efforts in <br />organizing the Council picnic, and congratulated Jim Jump <br />for his appointment as chairman of the Joint Economic <br />Development District Committee.<br /><br />ADJOURNMENT<br /><br />Councilmember Lucier moved to adjourn the meeting at <br />11:30pm.&nbsp; Councilmember Wernet second.&nbsp; Motion carried.<br />&nbsp;<br />&nbsp;&nbsp; &nbsp;&nbsp;&nbsp; &nbsp;<br /><br /><br /></span></p>]]></content></entry><entry><title>Council Minutes 10/21/98</title><id>http://www.granville.oh.us/council-minutes-1998/2012/1/9/council-minutes-102198.html</id><link rel="alternate" type="text/html" href="http://www.granville.oh.us/council-minutes-1998/2012/1/9/council-minutes-102198.html"/><author><name>GranvilleVillage</name></author><published>2012-01-09T20:16:28Z</published><updated>2012-01-09T20:16:28Z</updated><content type="html" xml:lang="en-US"><![CDATA[<p><span style="font-size: 120%;">&nbsp;Thru Truck Traffic Ordinance -<br />Councilmember Wernet requested an Ordinance with an <br />emergency clause be drafted to prohibit thru truck traffic <br />within Village boundaries. <br /><br />Councilmembers Rader, Lucier, and Vice Mayor McGowan were in <br />favor of introducing an Ordinance relating to thru truck <br />traffic, however they would not support an emergency clause. <br />&nbsp;The feeling is that the public deserves the opportunity for <br />review and input of this Ordinance.<br /><br />Councilmembers Wernet and Minklei stated they had heard <br />significant input for some time and support the emergency <br />clause based on what the public has requested this evening.<br /><br />Councilmember Robertson stated she would like to see <br />Ordinance language before making a decision on the support <br />of an emergency clause.<br /><br />Mayor Bellman feels that all governments in Licking County <br />need to take a community wide approach to these problems. &nbsp;<br />However, in light of Newark City Council&rsquo;s failure to take a <br />community wide approach on other recent issues, perhaps <br />Granville is justified in taking a similar approach here and <br />look at what is good for Granville.&nbsp; He volunteered to draft <br />an Ordinance this evening.&nbsp; He then asked citizens in <br />attendance for additional comments based on this topic.<br /><br />George Wickler, 223 E. College Street, a tractor/trailer <br />driver, feels Council should act promptly.&nbsp; He also feels <br />there is no common ground between Newark and Granville.&nbsp; He <br />noted that truck sizes are increasing and have outgrown the <br />intersections.<br /><br />Clifton Crais feels consideration should be given to <br />delivery trucks doing legitimate business in the Village and <br />asked how this Ordinance will be enforced.&nbsp; He noted that he <br />had been personally working on this problem for five years.<br /><br />Bernie Lukco also feels the Ordinance should be passed as <br />soon as possible and feels signs should be posted and <br />strictly enforced.<br />&nbsp;<br />Don Contini stated he had been complaining about this <br />problem for years.&nbsp; He feels it is time this Council help <br />the citizens protect their homes in this Village.<br /><br />&nbsp;&nbsp;&nbsp; &nbsp;Rusty Fletcher, 201 N. Pearl Street, stated he is <br />new to this community and is shocked that this problem has <br />been put off for so long. &nbsp;<br /><br />There was discussion with regard to the timetable of <br />enforcement if this Ordinance is adopted.&nbsp; It was decided <br />that announcements in local papers and letters to area <br />carriers would be needed.&nbsp; It was also suggested that <br />warnings be issued for several days after posted.<br /><br />Councilmember Rader stated he would prefer that this type of <br />legislation be done in a more calculated manner, such as <br />identifying major truck traffic offenders and sending <br />notification for cooperation.<br /><br />&nbsp;&nbsp; &nbsp;Manager Hickman made note that enforcement would <br />more than likely take more police time.<br /><br />At this time Vice Mayor McGowan presided over the Council <br />meeting as Mayor Bellman excused himself from Council <br />Chambers to work on a draft for Ordinance No. 23-98.<br /><br />Village Brewing Company <br />Jerry Martin, owner of Village Brewing Company (Brews) <br />addressed Council with regard to his request of the Ohio <br />Division of Liquor Control for an extension of hours.&nbsp; He <br />implied that there were certain nights of the week which he <br />would like to remain open until 2:30am. He noted this idea <br />was based on patron&rsquo;s frequent requests. He noted that this <br />was considered an addendum to the his present D-3 liquor <br />license and was an extension of privileges. He added that <br />the establishment would remain open until 2:30am based on <br />demand.<br /><br />Councilmember Rader stated that with this day and age of <br />alcohol abuse, underage drinking, DWI&rsquo;s, and the crackdown <br />on alcohol offenses, he feels the State Department of Liquor <br />Control is remiss in not reducing hours.&nbsp; He expressed <br />concern that this establishment is in a residential area and <br />cautioned that there are some obligations on the part of the <br />owner to make sure that there are no problems in the <br />neighborhood.&nbsp; He stated this was a privilege that could be <br />taken away. &nbsp;<br /><br />Councilmember Wernet, citing problems with another <br />establishment of this type in the downtown area, voiced a <br />concern that this would allow for a greater volume of <br />incidents at 2:30am, noting that there would now be two <br />locations requiring police patrol at 2:30am.&nbsp; He asked that <br />the interest of the overall community be considered. <br /><br />There was discussion about the steps being taken to <br />discourage underage drinking and false identification.&nbsp; Mr. <br />Martin noted that his employees are required to check <br />identification adding that he was also looking at purchasing <br />a bar encoder which is a more error proof way for checking <br />ID&rsquo;s.&nbsp; He also stated that he had been notified by Chief <br />Cartnal that there had been no complaints against this <br />establishment and assured Council that a year from now this <br />would remain the same.<br /><br />&nbsp;&nbsp; &nbsp;Councilmember Rader stated that should there be an <br />increase in the need for law enforcement during the 2:30pm <br />closing, Council may ask Mr. Martin to reciprocate.<br /><br />&nbsp;&nbsp; &nbsp;Vice Mayor McGowan directed the clerk to file the <br />report.&nbsp; A copy of that report is attached as part of these <br />minutes.<br />&nbsp;<br />MANAGER&rsquo;S REPORT<br />&nbsp;&nbsp; &nbsp;The Manager&rsquo;s Report for the month of September was <br />presented for review.&nbsp; &nbsp;<br /><br />Councilmember Rader brought up the question of Alexandria <br />water usage.&nbsp; Manager Hickman will report to Mr. Rader.<br />There was some question about the hours worked on Elm <br />Street. &nbsp;<br />&nbsp;&nbsp; &nbsp;Following a question by Councilmember Robertson with <br />regard to the number of hours spent sealing cracks, it was <br />noted that as there are two to three employees working on <br />such a project, hours quickly add up. <br /><br />Councilmember Robertson moved to accept the Manager&rsquo;s <br />Report.&nbsp; Councilmember Wernet seconded.&nbsp; Motion carried.&nbsp; A <br />copy of said report is attached as part of these minutes.<br /><br />MEETING ANNOUNCEMENTS<br />&nbsp;Vice Mayor McGowan announced that the GBPA is sponsoring a <br />parade and costume contest downtown on trick or treat night.<br /><br />Councilmember Wernet noted that during discussion of the <br />Comprehensive Plan&nbsp; at a recent GBPA meeting, Gib Blackstone <br />voiced a concern about the lack of parking in the village. &nbsp;<br />Mr. Blackstone also spoke of Taylor&rsquo;s proposed plan to <br />relocate to a building where they would have more parking. &nbsp;<br />He is concerned with how many businesses will remain in the <br />downtown area without sufficient parking.<br /><br />Vice Mayor McGowan mentioned some consideration might be <br />given to 30 minute parking in some areas of downtown.<br /><br />Councilmember Robertson noted a discussion with the Streets <br />&amp; Sidewalks Committee wherein it has been suggested that an <br />aerial photograph might be beneficial to reconfigure areas <br />for parking efficiency.&nbsp; Manager Hickman will coordinate an <br />aerial photograph with Keith Myers.<br /><br />&nbsp;&nbsp; &nbsp;There was a brief discussion on the idea of a <br />bus-type service making periodic trips around the Village to <br />provide accessible transportation. <br /><br />Councilmember Minklei again mentioned the idea of a <br />handicapped parking space at the crosswalk to provide access <br />for some citizens.<br /><br />&nbsp;&nbsp; &nbsp;The Streets and Sidewalks Committee will address <br />these issues and make a recommendation to Council.<br /><br />&nbsp;&nbsp; &nbsp;Ordinance No. 23-98<br /><br />&nbsp;&nbsp; &nbsp;Mayor Bellman returned to the table with a draft of <br />Ordinance No. 23-98<br /><br />&nbsp;&nbsp; &nbsp;Following a discussion and amendments to the draft, <br />Councilmember Wernet introduced Ordinance No. 23-98, An <br />Ordinance To Prohibit "Thru-Truck" Traffic Through The <br />Village of Granville, by reading its title.&nbsp; Councilmember <br />Wernet then moved to introduce the emergency section which <br />he read in full.&nbsp;&nbsp; Councilmember Minklei second.<br /><br />&nbsp;&nbsp; &nbsp;Several Councilmembers continued to discuss the need <br />to pass this Ordinance with an emergency clause stating that <br />amending and "fine tuning" could be done at a later date.<br /><br />&nbsp;&nbsp; &nbsp;Following discussion among Council, it was decided <br />that the emergency clause of Ordinance No. 23-98 did not <br />have enough affirmative votes to be adopted.<br /><br />&nbsp;&nbsp; &nbsp;Law Director Hurst advised that after an Ordinance <br />is introduced with an emergency clause, but not passed by <br />emergency measure, the Charter takes over and the Ordinance <br />is to be scheduled for a public hearing in two weeks.&nbsp; He <br />noted that the Ordinance could be reintroduced at that time <br />with an emergency clause thus allowing for the Ordinance to <br />become effective immediately if the emergency clause is <br />adopted at that time. <br /><br />&nbsp;&nbsp; &nbsp;Council asked that Manager Hickman order appropriate <br />signs in preparation for the passage of this Ordinance.<br /><br />&nbsp;&nbsp; &nbsp;Law Director Hurst suggested that Ordinance No. <br />23-98 be put into final form to include an emergency clause, <br />and scheduled for a public hearing and action at the <br />November 4, Council meeting.&nbsp; &nbsp;Special Meeting, September 30, 1998.&nbsp; Councilmember <br />Wernet moved to approve minutes as submitted; Councilmember <br />Rader seconded, and minutes were unanimously approved.<br /><br />CITIZENS COMMENTS<br />&nbsp;&nbsp; &nbsp;Bernard Lukco, 343 East College, is confused and <br />concerned about some of the parking issues at the old middle <br />school.&nbsp; Con-struc-tion has not begun on the lot, and people <br />are parking there haphazardly and without authorization. &nbsp;<br />Steve Cartnal told him he could not ticket cars because that <br />was a private lot, and the Acting Superintendent of Schools <br />is&nbsp; not familiar with all the issues.&nbsp; There should be a way <br />to enforce the parking restrictions.&nbsp; and erect a sign. It <br />will be a worse problem with rain and snow, and the School <br />Board ought to expedite construction.<br />&nbsp;&nbsp; &nbsp;Manager Hickman said this was new to him and he <br />wanted time to study the situation. Vehicles parking on the <br />sidewalk have been ticketed, and the school is responsible <br />if cars need to be towed.&nbsp; The Acting Superintendent should <br />be informed of the background here. Mr. Lukco will keep an <br />eye on this.<br /><br />&nbsp;&nbsp; &nbsp;Mary Fellabaum, 310 West Elm, would like to thank <br />Village Manager for his help in making the Antique Show a <br />success in spite of the rain.&nbsp; They had 41 wet dealers; it <br />was well attended and the new location was successful. &nbsp;<br />Councilmember Lucier did receive a call from an upset <br />resident and she will come and speak for herself later.<br /><br />&nbsp;&nbsp; &nbsp;Bob Kent, 100 Pinehurst, on behalf of his family, <br />who own 100&plusmn; acres on 16/661, wants to develop this area. &nbsp;<br />It's in the township but involves the Village also. He is <br />asking Council to appoint one or more people to an ad hoc <br />committee to discuss the best way to approach this.<br />&nbsp;&nbsp; &nbsp;Mayor Bellman thought this matter raised a lot of <br />concerns that go beyond this property and may involve water <br />and sewer issues. He thought this was a big enough situation <br />to seek involve-ment of the Comprehensive Plan group and our <br />whole game plan for the future. Others wanted <br />representatives from Township Trustees, Village Council, the <br />Comprehensive Plan group, Township Zoning, and School Board. <br />&nbsp;Mr. Kent preferred a small group just to offer guidance at <br />this time.&nbsp; &nbsp;<br /><br />&nbsp;&nbsp; &nbsp;Three members were selected for Mr. Kent's group: &nbsp;<br />Councilmembers Minklei, Rader, and Wernet<br /><br />COMMITTEE REPORTS<br />&nbsp;&nbsp; &nbsp;Personnel Committee.&nbsp; The committee would be glad to <br />answer questions from the Council. They did not vote on <br />anything.<br /><br />&nbsp;&nbsp; &nbsp;Recreation Commission.&nbsp; They did plant grass at the <br />new park in the Village by the driving range.&nbsp; The Rec. <br />Commission is offering basketball from Grade one up.<br /><br />&nbsp;&nbsp; &nbsp;Cemetery Board.&nbsp; Councilmember Lucier requests <br />clarification from Council and Law Director as to who is our <br />legal counsel.&nbsp; This is still pending.<br /><br />&nbsp;&nbsp; &nbsp;Granville Planning Commission.&nbsp; Councilmember Wernet <br />said that Kobunski was going to be on the agenda again but <br />Mr. Hersam requested tabling until the next meeting.<br /><br />&nbsp;&nbsp; &nbsp;John Thornborough brought up a rezoning question for <br />NW corner of Main and College.&nbsp; Members wanted to postpone <br />any discussion until they saw an application.&nbsp;&nbsp; GPC wants a <br />public hearing for rezoning, and Council wants its own <br />public hearings. &nbsp;<br /><br />&nbsp;&nbsp; &nbsp;Streets and Sidewalks.&nbsp; Councilman Rader presented <br />priorities for next year's budget:<br />&nbsp;&nbsp; &nbsp;1.&nbsp; South Main Street, with Ameriflora added, and a <br />welcome sign. Mayor Bellman likes the idea of involving <br />property owners in a partnership and getting some money from <br />them. Councilmember McGowan stated that the South Main <br />project was approved by a former Council and one suggestion <br />was a turn lane at the IGA. Dan Freytag opposed this idea. &nbsp;<br />&nbsp;Some people want the current Council to re-visit this <br />thought.&nbsp; Mayor Bellman wondered whether traffic was of real <br />concern at this point. Do we really want to make it easier <br />for visitors to go through town? Maybe it's good to stop <br />instead.&nbsp; Mr. Wernet wondered why pay for something that may <br />not have real benefit. <br />&nbsp;&nbsp; &nbsp;Councilmember Rader said Streets and Sidewalks <br />Committee wanted to recommend a turn lane, and Councilmember <br />Wernet thought there was to be discussion with property <br />owners first.&nbsp; Council-member Rader added that a grant would <br />affect Munson to Broadway, 80/20, and a turn lane would be <br />in the non-grant area.<br />&nbsp;&nbsp; &nbsp;2.&nbsp; West Maple to Cherry, with curbs and work with <br />residents about parking.<br />&nbsp;&nbsp; &nbsp;3.&nbsp; Engineering on east side of Village in relation <br />to impact fees on new building in that area to help pay for <br />Cherry Valley Road improvements.&nbsp; Manager Hickman will give <br />us a resolution to have improvements done. <br />&nbsp;&nbsp; &nbsp;4.&nbsp; David Longaberger has the driveway cut in.&nbsp; They <br />will make a pathway also.<br />&nbsp;&nbsp; &nbsp;5.&nbsp; Pathway on Newark/Granville Road.&nbsp; It will be an <br />8' bike-path going from western drive of the church to Bryn <br />Du and a 6' path from the Catholic Church to Clear Run. &nbsp;<br />Mayor Bellman said that where a sidewalk is close to houses, <br />the style is concrete, but the disadvantage is that it would <br />only be 6' and would be more costly.&nbsp; Members agreed to use <br />asphalt instead of concrete.<br /><br />PUBLIC HEARING AND OLD BUSINESS<br />&nbsp;&nbsp; &nbsp;Ordinance No. 17-98, an Ordinance to Amend 22-97 <br />Providing for Adjustments of the Annual Budget for the <br />Fiscal Year 1998 and Revising Sums for Operating Expenses, <br />as introduced by Councilmember Robertson during the <br />September 16th meeting. By roll call, every member voted for <br />the Ordinance.<br /><br />NEW BUSINESS<br />&nbsp;&nbsp; &nbsp;ORDINANCE NO. 18-98, An Ordinance to Revise the <br />Codified Ordinances by Adopting Current Replacement Pages <br />and Declaring an Emergency. Manager Hickman said this <br />ordinance needs to be intro-duced and have further <br />discussion.&nbsp; It does not need to be an emergency basis. &nbsp;<br />Councilmember Rader introduced this Ordinance, and there <br />will be a public hearing October 21.<br /><br />&nbsp;&nbsp; &nbsp;RESOLUTION NO. 98-34, a Resolution to Authorize the <br />Village Manager to Advertise for Bids for the Sale of a 1986 <br />Ford 350 Truck, which has already been replaced through the <br />state bid process and is now surplus that needs to be sold. <br />&nbsp;Councilmember McGowan introduced this Resolution and <br />Councilman Rader seconded.&nbsp;&nbsp; Manager Hickman said there is <br />another vehicle to add to this as sealed bid.&nbsp; The Law <br />Director said this could be amended or add to it later. &nbsp;<br />It's a 1987 Chrysler LeBaron acquired through court order on <br />a forfeiture.&nbsp; The Village does not want it and it is <br />accumulating storage fees at M and P in addition to the <br />original $600 fee. In a contract the Law Director could <br />state that the Village is not responsible for the $600. &nbsp;<br />&nbsp;&nbsp; &nbsp;Mayor Bellman moved to amend this by saying: "The <br />Manager is authorized to dispose of another vehicle, namely <br />a 1987 LeBaron notwithstanding provisions of 125.11.&nbsp; The <br />amendment was unanimously approved.&nbsp; The Resolution was <br />unanimously approved.<br /><br />&nbsp;&nbsp; &nbsp;{As an aside, Mr. Hickman wants Ms. Wimberger to <br />look at the new River Road sign.}<br />&nbsp;&nbsp; &nbsp;<br />&nbsp;&nbsp; &nbsp;RESOLUTION NO. 98-35, a Resolution to Approve <br />Submittal of an Update of the District Solid Waste <br />Management Plan.&nbsp; Carol Philipps, District Coordinator of <br />the Solid Waste District, stated this was to reduce <br />landfills, encourage recycling, and discourage littering. &nbsp;<br />This plan needs to be updated every five years and look <br />toward 15 years ahead. You recently received information <br />from her group and will get more.&nbsp; She wants to add to <br />recycling sites.<br />&nbsp;&nbsp; &nbsp;Councilmember Robertson asked what assurances there <br />were that the recycling actually gets to the plant, and Ms. <br />Philipps said&nbsp; monitoring was impossible.<br />&nbsp;&nbsp; &nbsp;Councilman Rader moved to introduce this Resolution <br />and Vice Mayor McGowan seconded.&nbsp; It was approved by <br />majority with one Abstention vote (Mayor Bellman).<br /><br />&nbsp;&nbsp; &nbsp;RESOLUTION NO. 98-36, Resolution Accepting the <br />Amounts and Rates as Determined by the Budget Commission and <br />Authorizing the Necessary Tax Levies and Certifying Them to <br />the County Auditor.&nbsp;&nbsp;&nbsp; Manager Hickman explained that these <br />are funds we will receive from the County for 1999.<br />&nbsp;&nbsp; &nbsp;Mayor Bellman moved to introduce this Resolution and <br />read the Resolution to the group. Councilmember Wernet <br />seconded and it was unanimously approved.<br />&nbsp;&nbsp; &nbsp;Councilmember Wernet thought these forms could be <br />updated, and members agreed that the penned-in figures with <br />"strikeovers" obscured the correct figures.<br /><br />MATTERS OF INTEREST<br />&nbsp;&nbsp; &nbsp;Jim Jump has proposed an ordinance and explained it <br />to the group.&nbsp; He asked what would happen if a bad error of <br />law occurs and nobody follows up. What could the Village do <br />to prevent this.&nbsp; His proposal has three main points: (1) <br />the municipality may not attack or void decisions of its own <br />authority unless it gives itself authority to do so.&nbsp; (2) <br />Finding a procedure to allow this.&nbsp; What you are looking for <br />is where the decision clearly constitutes abuse of power, <br />corruption, or misrepresentation.&nbsp; (3) Let the citizens send <br />a letter to the Law Director voicing their complaints.&nbsp; Some <br />say the SuperAmerica decision represents an abuse of <br />corporate power and a clear disregard of law. <br />&nbsp;&nbsp; &nbsp;The Law Director said we already have a procedure in <br />existence {1139.07 and 1109.12}.&nbsp; He has serious <br />reservations about this proposal.<br />&nbsp;&nbsp; &nbsp;Councilmember Wernet suggested that the Law Director <br />and Jim Jump get together and give us results of that <br />discussion.<br />&nbsp;&nbsp; &nbsp;Councilmember Robertson introduced both proposals, <br />19-98, An Ordinance to Amend 1137.07 and to Enact Section <br />1137.09 of the Codified Ordinances of the Village of <br />Granville, Ohio, to Expand the Authority of the Council, Law <br />Director, and Village Manager, to prevent Violations of the <br />Zoning Ordinance, and 20-98, An Ordinance to Amend Sections <br />1135.01, 1137.01, 1137.02, 1137.05, 1137.07, 1139.04, <br />1139.05, 1141.04, 1141.05, 1147.04, and 1159.05, and to <br />Enact Section 1137.09 of the Codified Ordinances of the <br />Village of Granville, Ohio, to Permit the Law Director and <br />Taxpayers of the Village to Take Action to Prevent Unlawful <br />Decisions and Orders Issued under the Zoning Ordinance. <br />Councilmember Rader seconded. Councilmember Robertson wants <br />a public hearing November 4. &nbsp;<br />&nbsp;&nbsp; &nbsp;The Law Director said this will take a lot of time <br />to study.<br /><br />&nbsp;&nbsp; &nbsp;Comments from the Mayor.&nbsp; The Mayor noticed it was <br />unusually quiet down-town when Cherry Valley was closed. &nbsp;<br />Chief Cartnal was going to check on Westerville, etc., to <br />see how they managed to control noise.&nbsp; Mayor Bellman also <br />stated that other towns have restric-tions on JAK brakes and <br />wondered whether Granville could also. Manager Hickman will <br />work out some language.<br /><br />&nbsp;&nbsp; &nbsp;A letter from a resident on South Main complains <br />about speed-ing traffic.&nbsp; There are also violations on <br />College between Granger and Broadway.&nbsp; Should we look at <br />other areas to see how they control speed through the <br />village?<br /><br />&nbsp;&nbsp; &nbsp;He has also received comments about skateboards. &nbsp;<br />Manager Hickman said if they are a nuisance, they will be <br />cited.&nbsp; Officers do patrols.&nbsp; Councilmember Robertson valued <br />the idea of interaction between police and young people. <br />Councilmember Rader recommended calling parents on the <br />phone.&nbsp; Manager Hickman will talk to Chief Cartnal about <br />this.<br /><br />&nbsp;&nbsp; &nbsp;The idea of Alexandria and water agreement raises a <br />possible opportunity: Acquire Land Conservancy easements <br />along the bike path.&nbsp; We want understanding about <br />development.&nbsp; See about alter-nate truck routes.&nbsp; The ODOT <br />says if you want trucks out of the village, give them an <br />alternate truck route.<br /><br />&nbsp;&nbsp; &nbsp;Liquor Permit. Law Director Hurst needs to be <br />advised whether or not Council requests hearings before Ohio <br />Liquor Control regard-ing Village Brewing Company's request <br />for a new permit for D-3-A, an extension of issued permit <br />privileges until 2:30 a.m. in addition to its other <br />permissions already received.
