ORDINANCE NO. 05-09
AN ORDINANCE APPROPRIATING FUNDS FOR THE PEDESTRIAN BRIDGE OVER RACCOON CREEK AND AUTHORIZING THE VILLAGE MANAGER TO ENTER INTO A CONTRACT FOR THE PROJECT
The following Ordinance enacted by the Village of Granville, Ohio, hereinafter referred to as the Legislative Authority/Local Public Agency or "LPA", in the matter of the stated described project.
WHEREAS, on the 5th day of September, 2007, in Resolution 07-46, the LPA enacted legislation consenting to and proposing cooperation with the Director of Transportation for the following described project:
Construction of 570' of a 10' wide pedestrian path on a new alignment and profile grade including a three-span structure over Raccoon Creek, lying within the Village of Granville.
WHEREAS, the LPA shall cooperate with the Director of Transportation in the above described project as follows:
The Village agrees to assume and bear one hundred percent (100%) of the entire cost of the improvement, less the amount of Federal-aid funds set aside by the Director of Transportation for the financing of this improvement from funds allocated by the Federal Highway Administration, U.S. Department of Transportation, and further, the Village agrees to assume and bear one hundred percent (100%) of the cost of Preliminary Engineering and Right-of-Way, excluding in-house preliminary engineering and Right-of-Way charges incurred by the State.
The share of the cost of the LPA is now estimated in the amount of Two Hundred Ninety Eight Thousand Five Hundred Dollars, ($298,500.00), but said estimated amount is to be adjusted in order that the LPA's ultimate share of said improvement shall correspond with said percentages of actual costs when said actual costs are determined;
WHEREAS, The Director of Transportation has approved said legislation proposing cooperation and has caused to be made plans and specifications and an estimate of the cost and expense for improving the above described highway and has transmitted copies of the same to this legislative authority;
WHEREAS, The LPA desires the Director of Transportation to proceed with the aforesaid highway improvement; and
WHEREAS, The Village Manager has recommended an amendment to the annual budget of the Village of Granville to provide funding for the project.
NOW, THEREFORE, be it ordained by the Council of Granville, Ohio, that:
SECTION I. The LPA hereby requests the Director of Transportation to proceed with the aforesaid highway improvement.
SECTION II. The annual budget of the Village of Granville, as established by Ordinance No. 17-08, is hereby amended by the Council to include the additional appropriations recommended by the Village Manager for the construction of the Pedestrian Bridge over Raccoon Creek.
SECTION III. To provide for Operating Expenditures during the fiscal year ending
December 31, 2009, the following additional appropriations are hereby made for the General Fund for the construction of the Pedestrian Bridge over Raccoon Creek:

SECTION IV. The Village Manager be, and is hereby authorized to execute said contract,
providing for the payment of the LPA the sum of money set forth herein above for improving the described project, attached hereto as Exhibit A and incorporated herein.
SECTION V. The LPA shall transmit to the Director of Transportation a fully executed copy of this Ordinance.
SECTION VI. This Ordinance shall take effect upon the earliest date permitted by law.
