Traffic Code

301.19 Definition of Motorcycle.  (Adds "seat" to first line of definition.)

301.20 Definition of Motor Vehicle.  (Deletes certain types of agricultural machinery from the definition of a motor vehicle.)

333.01 Driving or Physical Control While Under the Influence.  (Increases fines that may be levied in subsection (h)(1)A.3., B.3., and C.3. for violation or this section.  Adds "continuous alcohol monitoring" to subsection (q)(4).)

333.08 Operation Without Reasonable Control.  (Adds operation of an agricultural tractor to the prohibition contained therein.)

335.031 Driving With Probationary License; Curfew.  (Adds prohibition on a person less than seventeen years of age operating a motor vehicle with more than one person who is not a family member unless accompanied by a parent, custodian, or guardian.  Adds restriction on permittee who has not attained the age of eighteen years from operating a motor vehicle between midnight and six a.m.)

335.05 Wrongful Entrustment of a Motor Vehicle.  (Specifies that wrongful entrustment of a motor vehicle applies when a vehicle is subject to a vehicle immobilization order and a subject person is prohibited from operating the vehicle.)

335.072 Driving Under Financial Responsibility Law Suspension or Cancellation.  (Amends subsection (c) to make immobilization of a vehicle and impoundment of its license plates discretionary when the offender has no previous conviction in the preceding five years.)

337.10 Lights on Slow-Moving Vehicles.  (Requires farm machinery that is designed by its manufacturer to operate at a speed greater than 25 miles per hour to display a speed identification symbol and a slow-moving vehicle emblem when operated on a street or highway.)

337.18 Motor Vehicle and Motorcycle Brakes.  (Adds subsection (a)(5) pertaining to brakes for watercraft trailers, manufactured or assembled after January 1, 2008, and renumbers subsections.)

337.26 Child Restraint System Usage.  (Requires a child who is between four and fifteen years of age to be restrained in either an approved child restraint system or seat belt; eliminates the nonresident exemption and establishes a mandatory fine of at least $25.00 for a first offense.  Eliminates requirement for operators of vehicles under the control of a kindergarten to use a child restraint system when transporting any child.)

339.03 Maximum Width, Height and Length. (Changes subsection (c)(1) from 60 to 66 feet; changes subsection (c)(2) from 40 to 45 feet; adds new subsection (c)(5)A.; adds new subsection (f) and renumber section.)

339.05 Wheel Protectors.  (Requires wheel protectors to have a ground clearance of not more than one-third of the distance from the center of the rearmost axle to the center of the flaps under any conditions of loading of the vehicle.  Former requirement was one-fifth of the distance.)

339.11 Use of Studded Tires and Chains.  (Permits the operation of a motor vehicle with retractable studded tires at any time of the year as long as the studs are extended only during the period from November 1 to April 15.)

341.03 Prerequisites to Operation of a Commercial Motor Vehicle.  (Clarifies application of commercial drivers' licensing requirements.)

373.02 Riding Upon Bicycle and Motorcycle Seats.  (Clarifies language in subsection (b) regarding sitting upon or astride a bicycle or motorcycle seat and adds new subsection (g) which permits the carrying of a child in a seat or a trailer designed for carrying children and which is firmly attached to a bicycle.)

General Offenses Code

501.06 Limitation of Criminal Prosecution.  (Adds new subsection (c) a person who is not a public servant but whose offense is directly related to the misconduct in office of a public servant.)

509.06 Inducing Panic.  (Adds "an institution of higher education" to a public place in which inducing panic is classified as a felony to be prosecuted under State law.)

513.01 Drug Abuse Control Definitions.  (Adds definitions of "lawful prescription," and "deception and theft offense."

513.03 Controlled Substance Possession and Use.  (Increases penalty in subsection (c)(1) from a misdemeanor of the third degree to a misdemeanor of the first degree and eliminates violation pertaining to anabolic steroids.)

513.12 Drug Paraphernalia.  (Changes the intext references in subsection (e) to Ohio Revised Code Chapter 2981.)

513.14 Offender May be Required to Pay Costs fro Controlled Substance Test.  (Adds new section authorizing a court to require a drug abuse offender to reimburse a law enforcement agency for the cost of test that determine if a substance involved in the offense contained a controlled substance.)

517.01 Gambling Definitions.  (Modifies the definitions of "slot machine," "skill-based amusement machine," and "gambling offense.")

517.06 Methods of Conducting a Bingo Game.  (Adds exception for sale of instant bingo tickets.)

517.08 Raffles.  (Requires charitable organization that conducts a raffle to distribute at least 50% of the profit to a charitable purpose.)

517.15 Skill-Based Amusement Machines.  (Creates a limit on the redemption value of prizes associated with skill-based amusement machines and clarifies regulatory authority pertaining to the machines.)

525.02 Falsification.   (Changes intext references in subsection (a)(13) to Ohio Revised Code Chapter 173.)

525.10 Having an Unlawful Interest in a Public Contract.  (Adds subsection (g) making any public contract in which a public official has an interest in violation of this section to be void and unenforceable; makes stylistic changes throughout section.)

529.07 Open Container Prohibited.  (Adds subsections (c)(3) and (e) permitting a person to have an opened container of wine on D-2 liquor permit premises and exempts an opened bottle of wine from the restrictions contained in Section 529.07 under certain conditions.)

533.01 Obscenity and Sexual Offenses' Definitions.  (Changes "cavity" to "opening" in Section 533.01(a).)

533.06 Voyeurism.   (Clarifies that the prohibitions set forth that refer to conduct involving the photographing of another also apply to conduct involving the videotaping, filming or other recording of another.)

537.02 Vehicular Homicide and Manslaughter.   (Adds imposition of a mandatory jail term under Ohio Revised Code 2903.06(E) at the end of (b)(1).)

537.03 Assault.  (Adds "an investigator of the Bureau of Criminal Identification and Investigation" to those assault offenses constituting felonies to be charged under State law.)

537.051 Menacing by Stalking.  (Enhances penalty for offenses committed with a sexual motivation as defined in Ohio Revised Code 2971.01.)

537.08 Unlawful Restraint.   (Adds prohibition of restraining another with a sexual motivation as defined in Ohio Revised Code 2971.01.)

537.14 Domestic Violence.   (Enhances the penalty for domestic violence when the offender knows the victim was pregnant at the time of the offense.)

537.15 Temporary Protection Order.   (Adds provision to authorize a court to require that certain persons convicted of violating a protection order that requires electronic monitoring be electronically monitored.)

537.17 Criminal Child Enticement.  (Adds prohibition of criminally enticing a child with a sexual motivation as defined in Ohio Revised Code 2971.01.)

545.01 Theft and Fraud Definitions.  (Adds "rental services" to definition of services in subsection (e).)

545.05 Petty Theft.  (Adds authorization for a court to order an offender who steals rental property to pay for the cost of repairing or replacing the stolen property and any loss of revenue resulting from the deprivation of the property due to theft.)

549.01 Weapons and Explosives Definitions.   (Revises definition of explosive as contained in subsection (m).)

549.02 Carrying Concealed Weapons.  (Expands the restrictions imposed upon persons issued a license to carry a concealed handgun who are carrying a concealed handgun and are stopped for a law enforcement purpose.)

549.04 Improperly Handling Firearms in a Motor Vehicle.  (Adds exceptions in subsection (d)(3) for persons possessing a permit for and being in or on an electric-powered all-purpose vehicle.  Clarifies when carrying a concealed weapon does not apply to transporting or storing a firearm in a motor vehicle.)

549.07 Underage Purchase of a Firearm.  (Adds qualification for a member of the armed services or the Ohio National Guard who is between the ages of 18 and 21 to purchase a handgun if the person has received firearms training.)
