Traffic Code

331.01    Driving Upon Right Side of Driveway.  (Modifies requirement in subsection (b) that any vehicle proceeding at less than the lawful and prevailing speed be driven in the right hand lane.)

331.07    Hazardous or No Passing Zones.  (Adds new subsection (b) permitting a vehicle to cross an auxiliary yellow line when passing a slow-moving vehicle.)

331.14    Signals Before Changing Course.  (Modifies turning signal requirements as contained in the second paragraph of subsection (a) for the operator of a bicycle.)

333.01    Driving Under the Influence.  (Prohibiting the operation of a vehicle if a specified concentration of amphetamine, cocaine, cocaine metabolite, heroin, heroin metabolite (6-monoacetyl morphine), L.S.D., marihuana, marihuana metabolite, methamphetamine, or phencyclidine is present in the operator’s blood or urine, subject to certain exceptions.)  (Expands the circumstances in which evidence on the concentration of alcohol, drugs of abuse, or a combination of them in a person’s blood, breath or urine may be admitted in evidence.)

333.04    Stopping Vehicle; Slow Speed.  (Adds provision in subsection (c) that the trier of fact, in determining whether the vehicle was being operated at an unreasonably slow speed, shall consider the capabilities of the vehicle and its operator.)

335.03    Driving With Temporary Instruction Permit; Curfew.  (Changes the age limitation in subsection (b) to “eighteen” years and the time restrictions to “midnight to six a.m.”.)

335.031Driving With Probationary License; Curfew.  (Adds prohibition on a person less than seventeen years of age operating  a motor vehicle with more than one person who is not a family member unless accompanied by a parent, custodian or guardian.  Adds restriction on permittee who has not attained the age of eighteen years from operating a motor vehicle between midnight and six a.m.)

337.26    Child Restraint System Usage.  (Requires a child who is between four and fifteen years of age to be restrained in either an approved child restraint system or seat belt; eliminates the nonresident exemption and establishes a mandatory fine of at least $25.00 for a first offense.)

337.29    Bumper Heights. (Adds definition of “wheel track distance”.)

373.01    Code Application to Bicycles.  (Adds provisions on issuance of citations to operators of bicycles; precluding the assessment of points against an operator’s driver’s license for bicycle violations; and authorizes a trier of fact to require the operator of a bicycle violating any provision of the Traffic Code to complete a bicycling skills course.

373.02    Riding Upon Bicycle and Motorcycle Seats.  (Clarifies language in subsection (b) regarding sitting upon or astride a bicycle or motorcycle seat and adds new subsection (g) which permits the carrying of a child in a seat or a trailer designed for carrying children and which is firmly attached to a bicycle.)

373.05    Signal Device on Bicycle.  (Eliminates requirement that a bicycle has to be equipped with a device capable of giving a signal audible for a distance of 100 feet.)

373.06    Lights and Reflector on Bicycle.  (Substantially rewrites the requirements for lights and reflectors on bicycles contained in subsection (a) and adds new subsection (b).)

373.07    Riding Bicycle on Right Side of Roadway.  (Adds new subsection (b) which provides that a person is not required to ride a bicycle at the right edge of the roadway when it is unreasonable or unsafe to do so.)

General Offenses Code

501.01    Definitions.  (Expands the definition of “contraband” to include any property that is illegal for a person to acquire or possess under a statute, ordinance or rule, or that a trier of fact determines to be illegal to possess.)

501.06    Limitation of Criminal Prosecution.  (Adds new subsection (I) specifying when the period of limitation shall begin to run for a violation involving a wound or injury indicating abuse or neglect of a child.)

525.02    Falsification.   (Changes in text references in subsection (a) (13) to Ohio R.C. Ch. 173.)

525.03    Impersonation of a Peace Officer.  (Adds prohibition of impersonating a federal law enforcement officer or investigator of the Bureau of Criminal Identification and Investigation.)

525.15    Assaulting a Police Dog or Horse or Assistance Dog.  (Changes “service dog” to “assistance dog”.  Adds “or hearing impaired” when referring to a person for whom a dog is providing assistance.  Deletes phrase “person with a seizure disorder”.)


529.02    Sales to and Use by Underage Persons.  (Changes the term “accompanied” to “supervised” when referring to a parent, spouse or legal guardian.)

529.07    Open Container Prohibited.  (Adds subsections (c)(3) and (e) permitting a person to have 
an opened container of wine on D-2 liquor permit premises and exempts an opened bottle of wine from the restrictions contained in Section 529.07 under certain conditions.)

529.08    Hours of Sale or Consumption.  (Adds hours of sale or delivery by B-1, B-2, B-4, B-5, D-5K, D-8, F, F-1, F-2, F-3, F-4, F-5, F-6, G and I permit holders.)

533.01    Definitions.  (Changes “cavity” to “opening” in Section 533.01(a).)

533.07    Public Indecency.   (Increases the penalties for public indecency when the victim is a minor and the offender has a previous public indecency conviction.)

537.03    Assault.  (Adds “an investigator of the Bureau of Criminal Identification and Investigation” to those assault offenses constituting felonies to be charged under State law.)

537.07    Endangering Children.  (Adds a “controlled substance” or the “metabolite of a controlled substance” to subsection (c) which lists the prohibited concentration of certain substances in the operator of a vehicle.)

537.16    Illegal Distribution of Cigarettes or Other Tobacco Products.  (Changes intext reference in subsection (g) to Ohio R.C. Ch. 2981.)

541.11    Trespass on a Place of Public Amusement.  (Creates new offense of trespass on a place of public amusement and, as a result of that conduct, interrupting or causing the delay of any activity taking place therein.)

545.01    Theft and Fraud Definitions.  (Adds definition of “assistance dog”.)

545.05    Petty Theft.  (Changes “service dog” to “assistance” dog in Section 545.05(b)(7).)

549.02    Carrying Concealed Weapons.  (Expands the restrictions imposed upon persons issued a license to carry a concealed handgun who are carrying a concealed handgun and are stopped for a law enforcement purpose.)

549.04    Improperly Handling Firearms in a Motor Vehicle.  (Revising the penalty for the offenses of carrying concealed weapons and improperly handling firearms in a motor vehicle when committed in certain circumstances.)

549.12    Defacing Identification Marks of a Firearm; Possessing a Defaced Firearm.  (Adds new section prohibiting the defacing of identification marks of a firearm, or possessing a defaced firearm.)
