ORDINANCE NO.  10-08

AN ORDINANCE AUTHORIZING THE VILLAGE MANAGER TO PROVIDE SANITARY SEWER SERVICES FOR THE NEW MAINTENANCE BUILDING TO BE CONSTRUCTED BY GRANVILLE TOWNSHIP ON COLUMBUS ROAD

WHEREAS, the Village of Granville has an established policy of not providing sanitary sewer utility services to any property located outside of the corporate boundaries of the Village, and it hereby restates that policy; and

WHEREAS, the Board of Trustees of Granville Township has requested that the Village provide sanitary sewer services for the new maintenance building that is to be constructed by the Township on Columbus Road; and

WHEREAS, the Council is committed to not providing sewer services outside the Village limits to stimulate or encourage development that would adversely impact the economic vitality and quality of life of the community, and the proposed maintenance building would be consistent with that commitment; and

WHEREAS, the Village presently has surplus sanitary sewer services that it can provide to the new maintenance building on an exclusive basis; and

WHEREAS, the new maintenance building would provide more effective and efficient services to the residents of Granville Township, of which the Village is a part; and

WHEREAS, the Village Council hereby finds and determines that it is in the best interest of the Village to extend sanitary sewer services to the new maintenance building.

NOW, THEREFORE, BE IT ORDAINED by the Council of Granville, State of Ohio, that:

Section 1. The Village Manager is hereby authorized to sign the sanitary sewer service agreement between the Village and the Board of Trustees of Granville Township, a copy of which is attached hereto as Exhibit A and made a part hereof.

Section 2. The Village Manager is hereby authorized to execute the agreement and to take whatever actions are necessary to implement the terms and conditions of the agreement, including the issuance of a permit to allow the Board of Trustees of Granville Township to make connections from the new maintenance building to the sewer main that is adjacent to the property on which the maintenance building is to be constructed.  

Section 3.  This ordinance is contingent upon the dedication to and acceptance by the Village of Granville of the sewer improvements constructed by Kendal at Granville pursuant to the Sanitary Sewer Agreement Between the Village of Granville, Ohio and Kendal at Granville, Ohio, dated September 8, 2003. If, for unanticipated reasons, the dedication or acceptance of said sewer improvements is unreasonably delayed, then a letter from Kendal at Granville authorizing Granville Township to connect to the Kendal sewer improvements would also satisfy this contingency.

Section 4. This Ordinance shall take effect upon the earliest date permitted by law.
