ORDINANCE NO. 12-08

AN ORDINANCE ADOPTING PERMANENT ZONING (OPEN SPACE DISTRICT) FOR THE 514 ACRES +/- THAT WERE ANNEXED TO THE VILLAGE IN 2007

WHEREAS, the Village Council, through Ordinance No. 06-07, accepted the annexation of 514 acres +/- into the Village; and

WHEREAS, that Ordinance provided that the township zoning regulations that were in effect for the 514 acres +/- at the time of annexation would remain in effect until the Village Council adopted new regulations; and

WHEREAS, through Resolution No. 08-30 initiated a zoning amendment to establish a permanent zoning classification of "Open Space District" for the 514 acres +/-; and

WHEREAS, the regulations within the Open Space District are similar to those within the "Agricultural District" and "Conservation District", which were the zoning regulations in effect in Granville Township at the time of annexation; and

WHEREAS, the regulations within the Open Space District are also similar to those within the "Agricultural District" of Union Township, which were also in effect at the time of annexation; and

WHEREAS, the Granville Planning Commission, after conducting a public hearing on the permanent zoning proposal, has recommended that the 514 acres +/- be zoned as "Open Space District"; and

WHEREAS, the Granville Planning Commission believes that this property is suitable for the zoning classification of "Open Space District".  

NOW, THEREFORE, Be it ordained by the Council of Granville, Ohio that:

Section I: Upon the recommendation of the Planning Commission and after a public hearing by the Village Council, the proposal to rezone the 514 acres +/- that were annexed to the Village in 2007 as "Open Space District" is approved and the property is zoned in accordance with Section II of this Ordinance.

Section  II: The Official Zoning Map of the Village of Granville, Ohio, is hereby amended and revised to designate the permanent zoning classification for the 514 acres +/- that were annexed to the Village in 2007, which are described in Exhibit A that is attached hereto and made a part hereof, as "Open Space District";

Section III: The Village Manager is hereby authorized and directed to make this change on the Zoning Map maintained under Section 1155.02 of the Codified Ordinances.

Section IV: This Ordinance shall take effect and be in full force and effect upon the earliest date allowed by law.
