Ordinance 09-02

 AN ORDINANCE TO ACCEPT THE DONATION OF 32.24 ACRES OF
LAND ON NEWARK GRANVILLE ROAD

WHEREAS, the Longaberger Company desires to donate 32.24
acres of land located on Newark Granville Road to the
Village of Granville, and

WHEREAS, an agreement to accept the donation has been
negotiated between the Longaberger Company and the Village
of Granville,

NOW THEREFORE BE IT ORDAINED by the Council of Granville,
Ohio, a majority of its elected members concurring, that:
    

Section 1.  Council hereby accepts the donation of the
32.24 acres of land described in the Contract attached
hereto and incorporated herein in accordance with the
terms and conditions of said Contract, and subject to the
contingencies set forth in said Contract.  The said land
shall be maintained for the use and benefit of the general
public.

Section 2.  Council hereby approves on behalf of the
Village said Contract attached hereto and incorporated
herein.

Section 3.  Council hereby authorizes and directs the
Manager on behalf of the Village to take whatever
additional actions, and to execute whatever documents, are
needed to carry out the acceptance of said property in
accordance with the Contract attached hereto and
incorporated herein and the terms of this Ordinance.

Section 4.  This ordinance shall take effect and be in
force from and after the earliest date permitted by law.

Ordinance 08-02

 AN ORDINANCE TO AUTHORIZE THE PURCHASE OF 18.040 ACRES
AND 2.5 ACRES OF LAND LOCATED AT 537 JONES ROAD

WHEREAS, the Village of Granville desires to purchase the
Longaberger Estate located at 537 Jones Road, and

WHEREAS, a purchase agreement has been negotiated between
the Longaberger Company (Seller) and the Village of
Granville,

NOW THEREFORE BE IT ORDAINED by the Council of Granville,
Ohio, a majority of its elected members concurring, that:
    

Section 1.  Council hereby approves, authorizes, and
directs the purchase of the 18.040 acre tract of land and
the 2.5 acre tract of land described in the Real Estate
Purchase Contract attached hereto and incorporated herein
for the sum of Two Million Four Hundred Thousand Dollars
($2,400,000), in accordance with the terms and conditions
of said Purchase Contract, and subject to the
contingencies set forth in said Purchase Contract.

Section 2.  Council hereby approves on behalf of the
Village said Real Estate Purchase Contract attached hereto
and incorporated herein.

Section 3.  Council hereby authorizes and directs the
Manager on behalf of the Village to take whatever actions,
and to execute whatever documents, are needed to carry out
the purchase of said property in accordance with the Real
Estate Purchase Contract attached hereto and incorporated
herein, and to effectuate the closing of the purchase
thereof in accordance with the terms of this Ordinance.

Section 4.  Council hereby authorizes and directs the
Manager on behalf of the Village to take whatever action,
and to execute whatever documents, are needed to cause all
contingencies set forth in the Real Estate Purchase
Contract attached hereto and incorporated herein to be
satisfied so that the purchase of said property can take
place as soon as possible.

Section 5.  This ordinance shall take effect and be in
force from and after the earliest date permitted by law.

Ordinance 07-02

 AN ORDINANCE TO AMEND ORDINANCE NO.  39-01 PROVIDING
FOR ADJUSTMENTS OF THE ANNUAL BUDGET FOR THE FISCAL
YEAR 2002 AND REVISING SUMS FOR OPERATING EXPENSES.

    WHEREAS, pursuant to the provisions of Section 2.08
of Article II of the Charter of the Village of Granville,
Ohio, the Village Council is authorized to adopt the
Municipal Budget for the fiscal year beginning January 1,
2002 and ending December 31, 2002, and;

    WHEREAS, the Manager has recommended appropriations
to supplement previously made appropriations.

    NOW, THEREFORE, be it ordained by the Council of
Granville, Ohio, that:

Section    I:    The annual budget of the Village of
Granville, as established by Ordinance No. 39-01, be
amended by the Council, as recommended by the Manager, and
is hereby adopted.

Section   II:    To provide for Operating Expenditures
during the fiscal year ending December 31, 2002, the
following appropriations are hereby made in the General
Fund:

Ordinance 06-02

 AN ORDINANCE TO AMEND ORDINANCE NO.  39-01 PROVIDING FOR

Ordinance 05-02

 AN ORDINANCE AUTHORIZING THE VILLAGE OF GRANVILLE TO ENTER
INTO A GROUND LEASE WITH THE CENTENARY UNITED METHODIST
CHURCH IN ORDER TO ALLOW THE CHURCH TO EXPAND ITS CURRENT
FACILITIES.

    WHEREAS, the Centenary United Methodist Church has
informed the Village of Granville (“Village”) that it
wishes to obtain construction and permanent mortgage
financing for the expansion of its current church building
located on public square in the Village; and the Church has
also informed the Village that its lenders have requested
that the Village provide the Church with an acknowledgment
that the Church will be able to continue to occupy its
current and expanded site during the anticipated term of
the loan;

    WHEREAS, a Congregational Church was first erected
on public square in 1808, as the first building on public
square, and a Methodist Church was erected on the portion
of public square now occupied by the Centenary United
Methodist Church as early as 1826 by the congregation that
was the predecessor to that Church; and

    WHEREAS, the Village believes that it is
appropriate under these circumstances to enter into a
ground lease with the Centenary United Methodist Church,
subject to the terms and conditions hereof, in order to
permit the Church, to the extent legally possible, to
obtain the necessary financing for its planned expansion as
has been described to the Village;

    NOW, THEREFORE, BE IT ORDAINED by the Council of
Granville, Ohio, that:
    
    Section 1.  Pursuant to Section 3.01 of the Charter
for the Village of Granville and Section 105.01of the
Ordinances of the Village, and for the reasons set forth
above, the Village Manager is hereby authorized to execute
on behalf of the Village the ground lease, a copy of which
is attached hereto, with the Centenary United Methodist
Church.  The Village Manager is also authorized to take
whatever action is necessary to carry out the terms and
conditions of the ground lease.

    Section 2.  This Ordinance shall take effect and be
in full force from and after the earliest date permitted by
law.
