The Village of Granville Board of Zoning and Building Appeals will hear the following application at its meeting on Thursday, September 9, 2010 at 7:00 p.m. in the Village Council Chambers, 141 East Broadway:

New Business:

Application #2010-129, submitted by Ralph McGrath for the property located at 118 Colomen Gwen Circle.  The request is for a variance to reduce the required rear yard setback from forty (40') feet to twenty-one (21') feet to allow for the construction of an eight foot nine inch (8'9") wooden arbor.  The property is zoned Planned Unit Development (PUD).

Application #2010-130, submitted by Todd and Robin Feil for the property located at 575 West Broadway.  The request is for the following variances:
1) To reduce the required side yard setback from ten (10') feet to nine (9') feet on the western  property line to allow for the construction of a rear deck;
2) To reduce the required side yard setback from ten (10') feet to two (2') feet on the eastern  property line to allow for the construction of an attached garage; and
3) To reduce the required driveway side yard setback from five (5') feet to one (1') foot on the  eastern property line to allow for the expansion of an existing driveway to the new attached  garage. 
The property is zoned Suburban Residential District-C (SRD-C).

Application #2010-131, submitted by Michael & Wendy Duffey for the property located at 335 West Elm Street.  The request is for a variance to reduce the required side yard setback from ten (10') feet to zero point three (0.3') feet on the western property line and from ten (10') feet to seven (7') feet on the eastern property line to allow for the construction of a new 24' x 24' detached garage.  The property is zoned Village Residential District (VRD) and is located in the Architectural Review Overlay District (AROD).

Public Hearings - Village Council - Wednesday, September 1

VILLAGE OF GRANVILLE - NOTICE OF PUBLIC HEARING 

At its regular meeting on August 18, 2010, the Granville Village Council scheduled a public hearing and request for public comment for September 1, 2010 at 7:30pm in the Granville Village Council Chambers, 141 East Broadway, for the following:

Ordinance No. 13-10, An Ordinance to Amend Section 921.07 of the Codified Ordinances to Adjust Sewer Regulations and Charges

This ordinance would adjust the base sewer rate from $3.90 to $6.00 per thousand gallons.  That rate adjustment would be effective for wastewater usage beginning on or after October 1, 2010.  This ordinance would also provide for an additional adjustment that would be effective for wastewater usage beginning November 1, 2011.  At that time the rate would be adjusted from $6.00 to $6.55 per thousand gallons.

Ordinance No. 14-10, An Ordinance to Amend Section 925.18 of the Codified Ordinances to Adjust Water Regulations and Charges

This ordinance would adjust the base water rate from $3.40 to $3.85 per thousand gallons.  That rate adjustment would be effective for water usage beginning on or after October 1, 2010.  This ordinance would also provide for an additional adjustment that would be effective for water usage beginning November 1, 2011.  At that time the rate would be adjusted from $3.85 to $4.25 per thousand gallons.

Ordinance No. 15-10, An Ordinance to Amend Ordinance No. 20-09 to Provide for Adjustments to the Annual Budget for the Fiscal Year 2010 and to Revise Sums for Operating Expenses for Legal Expenses and Mayor’s Court

This ordinance would increase the appropriations for legal services in the Mayor’s Court account and in the Law account.  Village staff was too conservative in preparing the 2010 budget for general legal services for 2010.  In the 2010 budget, only $65,000 was budgeted for the Law account.  Legal services are running higher than anticipated this year because of the police negotiations that carried over into 2010.  Staff is recommending an increase in the Law account budget of $30,000.  There will also be a deficit in the Mayor’s Court account without increasing the budget by $18,000.

Adopted Legislation - Village Council - Wednesday, August 18

PUBLIC NOTICE
VILLAGE OF GRANVILLE

The Granville Village Council adopted the following legislation at the August 18, 2010 regular meeting:

a. Resolution No. 2010-34, A Resolution to Award the Contract for Towing and Impound for Services for the Police Department to M & P Towing LLC, and to Authorize the Village Manager to Enter into an Agreement Therefor

This resolution awards the contract for police impound and towing to M & P Towing LLC for the next three years.  M & P’s bid was lower on the basic towing fee and daily storage fee.  This information was reviewed by the Police Chief and has his recommendation.

b.  Resolution No. 2010-35, A Resolution to Establish the Annual Compensation Adjustment for the Fiscal Year 2010

This resolution provides a wage adjustment for non-union employees for 2010 retroactive to July 1, 2010.  No adjustment was given to the non-union employees in December or January due to the incomplete status of the police negotiations.  The compensation adjustment would include a 2% increase for those employees below the top step of their pay range.  The total cost of the increases would be approximately $4300, including related benefits.

c. Resolution No. 2010-36, A Resolution to Appoint a Member to the Planning Commission Representing the Board of the Granville Exempted Village School District

This resolution affirms the appointment of Robert Steven Hawk as the Village School District’s representative to the Planning Commission.

Application #2010-125, submitted by Hugh Price for the property located at 238 East Broadway.  The request is for architectural review and approval of the refacing of a 12 square foot freestanding panel sign located on East Broadway.  The property is zoned Village Business District (VBD) and is located in the Architectural Review Overlay District (AROD).

Application #09-55, AMENDED, submitted by Hugh Price for the property located at 238 East Broadway.  The applicant previously received approval for the removal of the existing wood louvered shutters and replacement with polycarbonate louvered shutters on the front, back and eastern side of the home.  The applicant is requesting an amendment to the original approval which would not require the applicant to replace the shutters.  The property is zoned Village Business District (VBD) and is located in the Architectural Review Overlay District (AROD).

The Granville Village Council adopted the following legislation at the August 4, 2010 regular meeting:

a. Ordinance No. 11-2010, An Ordinance Adopting Permanent Zoning (Village Gateway District) for the Mill District Properties Located on Lancaster Road (South Main Street)

This ordinance establishes permanent zoning for the Mill District properties owned by Mill District, LLC and 1919 Lancaster Road, LLC and located on Lancaster Road (South Main Street).  The property owners requested that the properties be zoned as Village Gateway District.  The Granville Planning Commission, after conducting public hearings on the request, has determined that the properties are suitable for the Village Gateway zoning designation and have recommended that they be zoned accordingly.

b. Ordinance No. 12-2010, An Ordinance to Amend Sections 1173.02 of the Codified Ordinances of the Village of Granville to Allow Restaurants as a Permitted Use Within the Village Gateway Zoning District

This ordinance amends the Village Gateway District zoning regulations to allow restaurants as a permitted use rather than a conditional use.  This amendment was agreed to as part of the pre-annexation agreement with the owners of the Mill District properties.  This proposed amendment does not affect the prohibition against drive-up, drive-through, or drive-in facilities for fast food enterprises or enterprises involving the sale of beverages.

c. Resolution No. 2010-32, A Resolution Authorizing the Village manager to Enter into an Agreement with the Board of Granville Township Trustees to provide Police Services to the Raccoon Valley Park and Certain Parcels Owned by Denison University

In December 2008, the Village Council adopted a resolution that authorized the Village Manager to enter into an agreement with the Township Trustees to provide police services to the Granville Intermediate School, other parcels owned by the Granville School District, and other parcels owned by Denison University that were located in Granville Township to add clarity and consistency to police services. The Township Trustees have now requested that the Village extend police services to the entirety of Raccoon Valley Park.  The eastern portion of the park was annexed into the Village in 2007, but the western portion of the park remains in the Township and outside of the Village.  In order to maintain clear and uniform coverage of Raccoon Valley Park, the extension of police jurisdiction by the Granville Police Department was requested.  There were also some Denison parcels that were inadvertently left out of the agreement that was approved in 2008.  This resolution corrects that oversight and brings those additional Denison parcels into the Village’s law enforcement jurisdiction.

At its regular meeting on July 21, 2010, the Granville Village Council scheduled a public hearing and request for public comment for August 4, 2010 at 7:30pm in the Granville Village Council Chambers, 141 East Broadway, for the following:

The Granville Village Council adopted the following legislation at the July 21, 2010 regular meeting:

a.    Ordinance No. 10-2010, An Ordinance Accepting an Application for the Annexation to the Village of Certain Real Properties Located on Lancaster Road (South Main Street)

This ordinance accepts the application for annexation to the Village of 9.89 acres located along Lancaster Road.  In accordance with a pre-annexation agreement approved by Village Council on November 18, 2009 for the Mill District LLC property, Metropolitan Partners prepared an Expedited Type II Petition for the annexation of the Mill District properties, the Kiwanis properties, the Village of Granville properties, a small parcel owned by Granville Township, and related rights-of-way along Lancaster Road and River Road.  That petition for annexation was approved by the Licking County Commissioners on April 15, 2010.   

b.    Resolution No. 2010-31, A Resolution to Endorse and Authorize the Village Manager to Submit the Final School Travel Plan for the Safe Routes to School Program Through the Ohio Department of Transportation

This resolution approves and endorses the School Travel Plan that was developed by Village staff, Granville School District staff, and a traffic/alternative transportation consultant supplied by the Ohio Department of Transportation.  The submission of a School Travel Plan allows the Village, Township and School District to apply for federally funded school-related alternative-transportation improvements such as sidewalks, pathways, crosswalks, bike racks, etc.

Application #2010-49, AMENDED, submitted by Forrest Blake for the property located at 226 South Mulberry Street.  The request is for architectural review and approval of the removal of four-inch (4") exposure wood siding and five-inch (5") exposure aluminum siding and replacement with four-inch (4") exposure Hardie-Plank siding, Hardie-Plank trim to match the front elevation and Hardie-Plank vented soffits.  The property is zoned Village Residential District (VRD) and is located in the Architectural Review Overlay District (AROD).

Application #2010-116, submitted by Brian and Dana Krieg for the property located at 226 East Maple Street.  The request is for architectural review and approval of the installation of several sections of four (4') foot white picket wood fencing.  The property is zoned Village Residential District (VRD) and is located in the Architectural Review Overlay District (AROD).
