RESOLUTION NO. 08-33

A RESOLUTION AFFIRMING THE DECISION OF THE COUNCIL OF THE VILLAGE OF GRANVILLE TO REMAND TO THE PLANNING COMMISSION THE APPLICATION FOR AN EXTERIOR LIGHTING PLAN FOR BURKE HALL AND ADOPTING DECISION FINDINGS AND CONCLUSIONS OF FACT.  

WHEREAS, on May 12, 2008, the Village Planning Commission approved, with conditions, the application submitted by Denison University for an exterior lighting plan for Burke Hall located on the University campus; and

WHEREAS, the decision of the Village Planning Commission was appealed and a hearing was conducted before Council on June 18, 2008; and

WHEREAS, on June 18, 2008, Council decided to remand the application submitted by Denison University to the Planning Commission upon the agreement of the applicant and the appellant, Jack Thornborough, to reconsider the Planning Commission decision in light of the changes in the application and to address the standing issue of anyone who appears before the Planning Commission hearing on the remand; and

WHEREAS, Council has made decision findings and conclusions of fact supporting its decision, attached hereto and incorporated herein as Exhibit “A.”

NOW, THEREFORE, be it resolved by the Council of the Village of Granville, Ohio, that:

Section   I:    Council hereby affirms its decision to remand to the Village Planning Commission the application of Denison University for an exterior lighting plan for Burke Hall located on the University campus to reconsider the Planning Commission decision in light of the changes in the application and to address the standing issue of anyone who appears at the Planning Commission hearing on remand, and hereby adopts the decision findings and conclusions of fact attached hereto and incorporated herein as Exhibit “A.”

Section II:    This Resolution shall take effect and be in force immediately upon passage.
