Resolution 04-19

A RESOLUTION TO CREATE THE GRANVILLE ARTS COMMISSION
(GAC).

    WHEREAS, the Granville Arts Commission (GAC) will
be a community based organization dedicated to the
enhancement of cultural arts, community character, and
interaction for the Village of Granville and all of its
residents; and
 
    WHEREAS, the goal of the GAC is to enrich the
Granville community through community based events,
activities, and programs with funds being made available
to those organizations that coordinate these types of
activities; and

    WHEREAS, the GAC shall be comprised of nine
members appointed from the following organizations:
Granville Village Council, Granville Township Trustees,
Granville Chamber of Commerce, Granville Historical
Society, Bryn Du Governing Committee, Granville Recreation
Committee, Granville Foundation, and two volunteers from
the community, and one non-voting representative of
Denison University.

        
    NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF
GRANVILLE, OHIO, that:
Section   I:    There is hereby created the Granville Arts
Commission pursuant to Section 2.08(7) of the Charter of
the Village of Granville.
Section II:    The purpose of the Commission shall be to
enhance cultural arts, community character and interaction
for the Village of Granville and its residents.
Section III:    The Commission shall be comprised of nine
(9) members appointed by Granville Village Council.  
Voting members shall be appointed from the following
organizations:  Granville Village Council (1), Granville
Township Trustees (1), Granville Chamber of Commerce (1),
Granville Historical Society (1), Bryn Du Governing
Committee (1), Granville Recreation Committee (1),
Granville Foundation (1), and the Community-at-Large (2).  
One non-voting member shall be appointed by Village
Council from Denison University.
Section IV:    The Commission shall be led by four
elected officers: Chairperson, Vice-Chairperson, Treasurer
and Secretary elected by the voting members of the
Commission and serving one year terms with no limit to the
number of terms.
Section V:    Village funding of the Commission shall be
based upon criteria established by the Village Council.   
Section VI:    This Resolution shall take effect
immediately upon passage.

Resolution 04-18

 A RESOLUTION TO AWARD THE BID FOR MISCELLANEOUS STORM
SEWER IMPROVEMENTS AT BRYN DU, AS PER SPECIFICATIONS, TO
TLV SERVICES AND TO AUTHORIZE THE VILLAGE MANAGER TO ENTER
INTO AN AGREEMENT THEREFORE.


BE IT RESOLVED by the Council of Granville, Ohio that:

Section      I:    The bid award for Miscellaneous Storm
Sewer Improvements at Bryn Du, as per specification, be
awarded to TLV Services for a total contract price of
$73,138.

Section     II:    The Manager should be and hereby is
authorized on behalf of the Village of Granville to enter
into an agreement with for Miscellaneous Storm Sewer
Improvements at Bryn Du in the Village of Granville.

Section    III:    This resolution shall take effect
immediately upon passage.

Resolution 04-17

 A RESOLUTION TO AWARD THE BID FOR MISCELLANEOUS STORM
SEWER IMPROVEMENTS, AS PER SPECIFICATIONS, TO L. E. KING &
SON EXCAVATING AND TO AUTHORIZE THE VILLAGE MANAGER TO
ENTER INTO AN AGREEMENT THEREFORE.


BE IT RESOLVED by the Council of Granville, Ohio that:

Section      I:    The bid award for Miscellaneous Storm
Sewer Improvements, as per specification, be awarded to L.
E. King & Son Excavating for a total contract price of
$252,774.75.

Section     II:    The Manager should be and hereby is
authorized on behalf of the Village of Granville to enter
into an agreement with for Miscellaneous Storm Sewer
Improvements in the Village of Granville.

Section    III:    This resolution shall take effect
immediately upon passage.

Resolution 04-16

 Amended and Restated Resolution Of The Council Of The
Village of Granville Of Licking County, Ohio.

The Council of the Village of Granville, Licking County,
Ohio met at a duly called and authorized meeting of the
Council on the date set forth below, such meeting being
duly called pursuant to a notice stating the time, place
and purpose of the meeting received by all Council
members, and the following resolutions were made seconded
and adopted by those present at the meeting.

    Whereas, the eligible employees of the Granville
Police Department participate in the Ohio Police and Fire
Pension Fund (“OP&F”); and
    
    Whereas, the Granville Village Council has
previously adopted to pick-up all of the ten percent (10%)
mandatory contributions required under by Section 742.31
of the Ohio Revised Code for participating employees of
the Granville Police Department who are members of the
OP&F; and
    
    Whereas, OP&F has adopted new procedures for
reporting picked up contributions in order to properly
prepare 1099-R forms for its members; and

    Whereas, the Granville Village Council wishes to
reaffirm and amend and restate its prior resolution in
order to continue the pick-up under the new procedures.

    BE IT RESOLVED BY THE COUNCIL OF GRANVILLE, OHIO,
that:

Section   I:    Effective March 3, 2004, the Granville
Village Council has determined to continue to pick-up all
ten percent (10%) mandatory contributions by the employees
who are members of the Ohio Police and Fire Pension Fund
through a payroll
deduction.                                        
Section  II:    Said picked up contributions paid through
payroll deduction, even though designated as employee
contributions for state law purposes, are being paid by
the Granville Village Council in lieu of said
contributions by the employee.

Section III:    Said picked up contributions will not be
included in the gross income of the employees for tax
reporting purposes, that is, for federal or state income
tax withholding taxes, until distributed from the Ohio
Police and Fire Pension Fund.

Section IV:    Said picked up contributions will be
included in the gross income of the employees, for
employment tax purposes, as the contributions are made to
the Ohio Police and Fire Pension Fund.

Section V:    Said employees shall not be entitled to
any option of choosing to receive the contributed amounts
directly instead of having them paid by the Village of
Granville to the Ohio Police and Fire Pension Fund.

Section VI:    This resolution shall take effect
immediately upon passage.

Resolution 04-14

 A RESOLUTION TO CREATE A BRYN DU GOVERNANCE COMMISSION.

    WHEREAS, the Bryn Du Advisory Committee has
recommended to Council that a Bryn Du Governance
Commission (“Commission”) be formed to manage the everyday
operations of the Bryn Du property; and

    WHEREAS, the purpose of the Commission shall
include, but not be limited to, the management of the Bryn
Du property, implementation of the development plan and
any future planning for the Bryn Du property, and
coordination with Village and Township officials to ensure
that the public purpose remains a priority; and  

    WHEREAS, the Granville Village Council will retain
the essential elements of control over the property,
including, but not limited to, establishing and approving
all major uses of the property, establishing and approving
all user fees, and controlling any improvements made to
the property; and

    WHEREAS, the Bryn Du Advisory Committee has
recommended that the Commission be comprised of seven
members appointed by the Granville Village Council,
including three (3) members directly appointed by the
Council, two (2) members appointed  upon recommendation
and nomination of the Granville Township Trustees, and two
(2) members appointed upon recommendation and nomination
of the Granville Area Chamber of Commerce; and

    WHEREAS, the Council desires to establish such an
advisory Commission pursuant to Section 2.08(7) of the
Charter for the Village of Granville.

    NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF
GRANVILLE, OHIO, that:

Section I:    There is hereby created a Bryn Du
Governance Commission (“Commission”) pursuant to Section
2.08(7) of the Charter of the Village of Granville.

Section II:    The Commission will be created for the
purpose of managing the everyday operations of the Bryn Du
property, including, but not limited to, implementing the
development plan and any future planning of the Bryn Du
property and coordinating with Village and Township
officials to ensure that the public purpose remains a
priority.

Section III:    The Granville Village Council will retain
the essential elements of control over the property,
including, but not limited to, establishing and approving
all major uses of the property, establishing and approving
all user fees, and controlling any improvements made to
the property.

Section IV:    The Bryn Du property is and will remain
public property and public money will be spent to maintain
and operate the facility.

Section V:    The Commission shall be comprised of three
(3) members directly appointed by  Council for an initial
term of three years, two (2) members appointed by the
Council upon the recommendation and nomination of the
Granville Township Trustees for an initial term of two
years, and two (2) members appointed by the Council upon
the recommendation and nomination of the Granville Area
Chamber of Commerce for an initial term of one year.  Upon
expiration of an initial term, a member shall be appointed
for a term of three years.

Section VI:    The Commission shall report biannually to
the Council and Granville Township Trustees.

Section VII:    This Resolution shall take effect
immediately upon passage.
