Mayor Eisenberg called the meeting to order at 7: 30 p.m..
Responding to roll call were:

Councilmember Avery moved to excuse absentee member Rader.
Motion seconded by Councilmember Malcuit. Motion carried.
Walter Forsythe Appeal -Members asked Mr. Forsythe if he would
like to present his appeal. Mr. Forsythe stated that he submitted
a letter outlining his reasons for appealing the Board of Zoning
Building Appeals' decision to grant him a six foot setback to
construct a room addition behind his home at 129 South Cherry
Street. He said that he didn' t have any more to say in addition
to his letter dated May 30, 1988 to Village Council, but would be
happy to answer any questions.
Council then conducted a lengthy question and answer
session, reviewing the plat drawing attached to Mr. Forsythe' s
letter, outlining existing structures and his proposed room
addition, and; setbacks of both his lot and his neighbors the
Fellabaums'.Mr. Forsythe explained that when the Fellabaums
built their room addition, they originally sought to construct it
on the lot line. He had objected, because they would have had to
encroach onto his property for construction and maintenance of
the addition. At that time, there were no setback requirements
in the zoning ordinance for properties in the Village Residential
District, so requests such as the Fellabaums were left to the
discretion of the Development Commission. When Mr. Forsythe
applied for his room addition, a ten foot setback requirement for
building additions, etc.,in this district, had been included in
amendments to the Granville Codified Zoning Ordinance.
Councilmember Schnaidt questioned why it had gone from zero
to ten feet? He remembered that when Council was first dealing
with the old architectural review area, it was the odd sized lots
in the Village Residential District that prompted the decision to
exclude setbacks in the ordinance, to give the Development
Commission some area in which to use their discretion.

Councilmember Avery commented that even with recent amendments
to the Zoning Ordinance, the Development Commission has
the power to vary the ten foot setback requirement, but chose not
Mr. Forsythe said the Commission told him that he would
need to apply for a variance from the Board of Zoning &Building
Mayor Eisenberg stated that at this point the ordinance
stands, and that Council must come to some decision on the
Councilmember Avery said that the Board of Zoning &Building
Appeals had already made a compromise by stating that they had
no problem with the six foot set back. Members reviewed a letter
to the Board of Zoning &Building Appeals from Jan Packard,
Granville' s Fire Prevention Officer.
David Neel, attorney for the Fellabaums' stated that Mr.
Forsythe hadn' t presented good reason for building his addition
that close to the lot line and to the Fellabaums' building, and;
that a six to ten foot setback safety separation was necessary.
It was also noted during discussion that the Fellabaums'
home was built on the mutual lot line and that their property
faced West Elm Street and Mr. Forsythe' s property faced South
Cherry Street. Thus, his proposed room addition would be to his
rear lot and the Fellabaums side lot line, and that both the
Fellabaums' building and Mr. Forsythe' s proposed room addition
were one story additions. Too, if fire control were needed, there
would be other ways to access both properties. Public hearing
closed at 8: 00 p.m.,with action on this appeal held for Old
Ordinance No. 5-88 -An Ordinance To Amend Ordinance No. 32-87
Providing For Adjustments Of The Annual Budget For The Fiscal
Year 1988 And Revising Sums For Operating Expenses.
No one appeared to speak for or against Ordinance No. 5-88.
Public Hearing on this ordinance closed at 8: 02 p.m..

First to speak was Kate Kenah, on behalf of the Plum and West
Maple Street residents. Ms. Kenah stated that residents were very
grateful for their new water line, and understood that until the
sanitary sewer line is put in, no major road construction would
be done. They did however have several requests, put into letter
form with signatures. The requests were as follows: 1) the dust
cloud hovering in their immediate area is a constant problem for
most of the residents; they requested that the traffic be limited
to residents only, and that a 10 mph speed limit sign be posted
until the road is repaved. 2) that a light coat of asphalt or oil
be applied to the exposed dirt surfaces to help with the dust,
and; 3) that Council begin seeking engineer work and EPA approval
for the sanitary sewer line now, so that the street may be
improved as soon as possible.
Betty Grudin, 125 South Plum Street, mentioned that the
heavy machinery that was used for the water line broke up a lot
of the road' s surface.
Manager Plunkett explained to the Plum Street residents
that the traffic on Plum Street could not be limited to just
residents because of it being a public street. However, the speed
limit could be reduced. Plans to asphalt the strip at a cost to
the Village of $1, 0001-$, 200 are underway, and should be completed
sometime this summer, when personnel are free from other
scheduled projects. The sanitary sewer won' t be done this
year due to a lack of funds.
Council then discussed briefly whether it would be cost
effective to lightly tar and chip the road until construction is
complete, or; to oil the road to keep the dust down. Manager
Plunkett felt it would be counterproductive to tar and chip the
road, and felt that covering the strip in the long run would be
more cost effective.
The petitioners present thanked Council once again for the
new water line and said whatever they could do about the dust
problem as soon as possible would be appreciated by all the residents.

The Mayor' s Reports for April and May, 1988 were presented and
reviewed. A copy of those reports are hereby attached as part of
these minutes.
The Manager' s Report for May 1988, was presented. Manager
Plunkett reviewed the report with members of Council. Following
review, Councilmember Avery moved that the Manager' s Report be
approved. Motion seconded by Councilmember Morrow. Motion
Development Commission -Councilmember Malcuit reported on the
Commission' s meeting of June 8, 1988. At that meeting members
expressed frustration regarding "after the fact applications",
and stressed the need to be more consistent in cutoff time for
accepting applications for review. This would allow members time
to review the applications prior to the meeting. Ms. Malcuit
stated that members wanted to treat all applicants equally and
that they have a rule that all applications for review must be
submitted one week prior to the next regularly scheduled meeting.
Ms. Malcuit also reported that the Commission has a fence
ordinance they have been looking at and would like to know
Council' s feelings about a section on fencing, before they put
more time on this item.
A brief discussion followed and consensus of Council was
that it was time for a joint meeting of Council and the Development
Commission. They tentatively scheduled one for July 6,
1988, immediately following the regular Council meeting.
Utilities/Status of Wastewater Facility
Mike Atherine, Poggemeyer Design Group, presented a status report
on the wastewater plant facility and what progress was being made
with the modifications to date.
A lengthy question and answer session between Mr. Atherine,
Village Council and Manager Plunkett followed.
Council thanked Mr. Atherine for coming and giving his
report orally.

Personnel -The Personnel Committee met Monday, June 13th, to
discuss ways to resolve an overload of work on the Clerk of
CourtR/ eceptionistD/ ispatcher position, and how to free up some
time for the clerk to work on the Mayor' s Court material. It was
recommended to offer a part-time night dispatcher full time
hours which would overlap the day-time clerk' s to free her from
the phones twice a week. This would be without a change in the
night-time dispatcher' s grade, but would include benefits not
included as a part-time employee.
Forsythe Appeal -Council agreed to decide the Forsythe Appeal
this evening. Following a lengthy debate on the request and the
Zoning Ordinance, the following motion was made: Councilmember
Avery moved that Council overrule the Board of Zoning &
Building Appeals' ruling on the Forsythe variance request
May 19, 1988) because unusual circumstances exist which justify
the variance, and that Mr. Forsythe be granted his request
per application and plat drawing attached to his letter dated
5/30/88 to Village Council, to construct his proposed room
addition, and that said addition be no less than 4 feet from his
rear lot line. Motion seconded by Councilmember Morrow. Motion
carried. This motion will be put into resolution form and
given the number 88-28, passed by Village Council 6/15/88. A copy
of Mr. Forsythe' s letter with plat drawing, letter from Jan
Packard, Granville' s Fire prevention Officer dated 4/26/ 88, and
minutes of the Board of Zoning &Building Appeals dated 4/18/88
and 5/19/88 are hereby attached as part of these minutes.
Ordinance No. 5-88, "An Ordinance To Amend Ordinance No. 32-87
Providing For Adjustments Of The Annual Budget For The Fiscal
Year 1988 And Revising Sums For Operating Expenses", was moved
for adoption by Councilmember Morrow. Motion seconded by Councilmember
Avery. Discussion: Manager Plunkett went over the appropriations
and gave a brief summary of each. Roll call on the
motion: Morrow-yes, Avery-yes, Hughes-yes, Malcuit-yes,
Schnaidt-yes, Eisenberg-yes, Radermember
absent. Six yes votes, one
Motion carried. Ordinance No. 5-88 duly adopted.
Resolution No. 88-25, "To Authorize The Village Manager To Enter
Into An Easement Agreement With Archie Shafer And Keith
Newhouse", was introduced and read in its entirety by Councilmember

Councilmember Malcuit moved for passage of Resolution No.
88-25. Motion seconded by Councilmember Schnaidt. Motion carried.
Resolution No. 88-25 duly passed. Archie Shafer, who was present
for the passage of this resolution, thanked everyone for their
help and commented that he was glad to get things going on the
drainage problem.
Resolution No. 88-26, "To Award The Bid For The Demolition Of The
100, 000 Gallon Elevated Storage Tank And Erection Of A 500, 000
Gallon Water Standpipe In Accordance With The Provisions Of
Granville' s Agreement With The Ohio Water Development Authority",
was introduced and read in its entirety by Councilmember Hughes.
Councilmember Hughes moved for passage of Resolution No.
88-26. Motion seconded by Councilmember Morrow. Discussion: Joe
Hickman, Granville Utilities Director, was present this evening
to answer questions from Council. He commented that the wells are
holding up well and the Village is in good shape for water. He
said while the tank is being torn down, he has made plans to rent
a generator for two months so that they can pump from the clear
well during this period if needed. Members of Council discussed
this and suggested to Mr. Hickman that he rent a generator for
two months with option, for one additional month in case there
might be any delays in the demolition of the 100, 000 gallon water
storage tank and contruction of the new 500, 000 gallon water
standpipe. Motion carried. Resolution No.88-26 duly passed.
Resolution No. 88-27, "A Resolution To State Village Policy
Regarding Services To Be provided In Territory Proposed For
Annexation Upon Annexation", was introduced and read in its
entirety by Councilmember Avery.
Councilmember Avery moved for passage of Resolution No.
88-27. Motion seconded by Councilmember Schnaidt. Motion carried.
Resolution No. 88-27 duly passed.
Ordinance No. 6-88, "An Ordinance Authorizing Cooperative
Agreement For Construction, Maintenance And Operation Of Water
Storage Facilities Project Between The Village Of Granville And
The ohio Water Development Authority And Declaring An Emergency",
was introduced and title read in its entirety by Councilmember
Councilmember Morrow moved for passage of the Emergency
Clause Section III, and read this section in its entirety.
Motion seconded by Councilmember Avery. Roll call vote: Morrowyes,
Avery-yes, Hughes-yes, Malcuit-yes, Schnaidt-yes, Eisenbergyes,
Rader-absent. Six yes votes, one member absent. Motion
carried. Emergency Clause Section III passed.

Motion carried. Ordinance No. 6-88 duly adopted.
Manager Plunkett distributed draft copies of the proposed 1989
County Tax Budget to members of Council for review. Council then
scheduled a public hearing on the proposed 1989 County Tax
Budget for July 6, 1988, at 7: 30 p.m..
Letter from College Street Residents -Council was in receipt of
a letter addressed to Charles Kimsey from the residents of East
College Street, protesting the condition of a home he owns, left
in very poor condition by Denison Students, depreciating not only
their properties but his as well.
Sara Baker, Office of the Dean of Student Life, Denison
University, was present to review with members of Council what
they are doing to educate senior students eligible for the
off-campus housing lottery. She explained that this past year
they have looked at both the judicial and academic records of
those who will become eligible; have had open forums with those
students, informing them of valuable information and rules when
they live off-campus. She explained that they have done a lot
this year and have other areas they are working on to have good
citizen type students in the lottery process. There have been
neighborhood meetings with residents, students, and Manager
Plunkett, in key sections of the Village where there is a
heavier concentration of homes rented to students.
Council recognized Denison' s efforts this year, Village
residents, Manager plunkett for his personal efforts on behalf of
the Village, and; the Granville Police Department. Everyone felt
disheartened, but would continue their efforts again next year. A
comment was made however that it was distressing that it didn' t
work this year.
Council thanked Ms. Baker for coming to the meeting and
outlining what her office is striving to accomplish in making
for better relations between the students living off campus and
the Village residents.
Discussion this evening also included the following items:
Disaster Services -A letter was received from the Licking
County Disaster Services, Newark, Ohio. The letter discusses a
Resolution creating a County Wide Disaster Service Agreement and
asking if the Village would be interested in being a party to
this agreement.

Members discussed this at length, and consensus was that
they would like to keep this service local. Councilmember
Schnaidt felt the Granville volunteer Fire Department, Inc.,
would probably pay a portion of the training to keep the
disaster service program local. It was noted as well, that if
Council should decide that they would like to become part of this
county wide disaster service agreement, they could do so at that
1, 2 and 3 Building Code -Manager Plunkett is continuing to
pursue information on this item and will make a recommendation to
Council when he has all the material needed.
Newark-Granville Road -Manager Plunkett mentioned to Council
that he had spoken with Jerry Wray, County Engineer, and Wray
explained to him that he will not get getting the money to pave
Newark-Granville Road this year. Mr. Wray did however tell him
that Kokosing will scrape the road, dress the edges, and fix the
potholes, and put a half inch levelling course to the corporation
limit (East College and Broadway). The Village' s cost for this
will be $10, 000. An additional one inch will be applied next
4th of July Parade -Mr. Plunkett reminded members that he
needed a census of those who plan to ride in the 4th of July
Manager Plunkett also mentioned to Council the excellent job
Molly Pheneger, Village Tax Commissioner, and; Ann Wright, Fiscal
Clerk, are doing in collections and overall performance.
Councilmember Morrow asked Manager Plunkett to relay to
Betty Apollonio that she is doing a good job with the Development
Commission minutes.
Council discussed a joint worksession with the Granville Development
Commission and tentatively scheduled one for July 6th
immediately following the Regular Council Meeting. Manager
Plunkett said he would contact the Chairman and see if that date
would be compatible for everyone.
