Mayor Eisenberg called the meeting to order at 7: 36 p.m.

PUBLIC HEARING
Ordinance No. 28-92, "An Ordinance To Amend Subsection 921.04(c)
Of The Codified Ordinances Of Granville, Ohio, Establishing
Sanitary Sewer Regulations And Charges And To Repeal Existing
Subsection 921. 04(c) Of Said Codified Ordinances."
No one appeared to speak for or against Ordinance No. 28-92.
Public hearing closed. Action on the ordinance was held for old
business.
Ordinance No. 29-92, "An Ordinance To Amend Section 925. 13 Of The
Codified Ordinances Of Granville, Ohio, Establishing Water
Regulations And Charges And To Repeal Existing Section 925. 13 Of
Said Codified Ordinances."

Public hearing closed. Action on the ordinance was held for old
business.
Ordinance No. 31-92, "An Ordinance To Amend Ordinance No. 35-91
Providing For Adjustments Of The Annual Budget For The Fiscal
Year 1992, And Revising Sums For Operating Expenses."

Ordinance No. 32-92, " An Ordinance To Vary The Road And Sidewalk
Widths In The Village Green Section Of The Erinwood Planned Unit
Development."

Jack Harden of Harden, Reid &Jahnes Architects, Inc.,noted
that Licking County recently reworded their Subdivision
Regulations on subdivision streets or collector streets to 28
feet widths, and sidewalks to four (4) feet. Mr. Harden had
another guidebook on the issue which also listed collector
streets as 26 feet wide, and sidewalks at four (4) feet.
Mr. Harden further stated that the variances before Council
come with the Granville Planning Commission' s recommendation for
approval after holding their public hearing, and receiving
written input from the Village' s consulting engineer. He urged
passage of the ordinance.
Hearing no further comments, concerns, or questions Mayor
Eisenberg declared the public hearing on Ordinance No. 32-92
closed. Action on the ordinance was held for old business.
MINUTES
September 2, 1992, Regular Council Meeting -Councilmember Vance
moved that the minutes be approved as written. Motion seconded by
Councilmember Herman. Motion carried.

COMMITTEE REPORTS

Planning Commission -the following recommendations and requests
were received and acknowledged by Village Council:
Rezoning recommendation for the property located at 527
Newark- Granville Road.
Recommendation for Village Council to allow a structure
wall) similar to one at the Robbins Hunter Museum along Broadway
to be constructed.
Village Council acknowledged the Planning Commission' s
recommendation to allow the construction of a front wall in the
right-of-way at 233 East Broadway, but noted with the
construction of that wall would mean the elimination of some offstreet
parking.
Following a lengthy discussion, consensus of Council was
that the request needed further review and study before making a
final decision on the recommendation.
A recommendation that Village Council give the Granville
Planning Commission jurisdiction over fences and walls placed in

the right-of-way in Village Districts only, and some jurisdiction
to the Planning Commission over pavement in the Village
Districts.
Following a brief discussion on the Planning Commission' s
recommendation to rezone the property located at 527 East
Broadway, a public hearing on that recommendation was set for
October 7, 1992, at 7: 30 p.m.
Other recommendations and requests proposed by the Granville
Planning Commission were acknowledged, but no action or
directions were issued at this time.
Streets &Sidewalks Committee -Councilmember Vance noted that
the Request For Proposals for the Parkway System Feasibility
Study are due in Friday, September 18, at 4: 30 p.m.
Councilmember Garrett directed Council' s attention to a memo
she had written on the parking issue. A copy of that memo is
attached as part of these minutes.
MAYOR' S REPORT
The Mayor' s Report for August 1992, was presented and reviewed.
Following review the Clerk was directed to file the report. A
copy of that report is attached as part of these minutes.
MANAGER' S REPORT
The Manager' s Report for August 1992 was presented. Following
review, Councilmember Vance moved that the Manager' s Report be
approved. Motion seconded by Councilmember Freytag. Motion
carried. A copy of that report is attached as part of these
minutes.
OLD BUSINESS
Ordinance No. 28-92, "An Ordinance To Amend Subsection 921. 04(c)
Of The Codified Ordinances Of Granville, Ohio, Establishing
Sanitary Sewer Regulations And Charges And To Repeal Existing
Subsection 921. 04(c) Of Said Codified Ordinances."
Councilmember Garrett moved for the adoption of Ordinance
No. 28-92 as amended. Motion seconded by Councilmember Vance.
Discussion: Councilmember Freytag said he was in favor of the
ordinance the way it' s presently written on the books. He
contended that the new amendment would create a hardship for
people who already have homes in the Fern Hill area who should be
allowed to pay for taps over a period of time. Mr. Freytag said
most people, when building new homes, allow for tap/ capacity fees
for utilities, but those who already have homes have invested in
site wells and septic systems.

Following a lengthy discussion, Councilmember Freytag moved
that ordinance No. 28-92 be further amended and that the
following paragraph be inserted after the last paragraph in
Section I as follows: Upon proper proof of hardship, the Village
Manager may arrange for a payment schedule for the foregoing
capacity charge.
The motion was seconded by Councilmember Herman. Roll call vote:
Freytagy-es, Hermany-es, Garrettn-o, Vancen-o, Eisenbergy-es.
Three yes votes, two no votes, two members absent. Motion
carried. Amendment duly adopted.
Roll call vote on passage of Ordinance No. 28-92 as further
amended: Garretty-es, Vancen-o, Hermany-es, Freytagy-es,
Eisenberg- yes, Marshall- absent, Shulman- absent. Four yes votes,
one no vote, two members absent. Ordinance No. 28-92 as further
amended duly adopted.
Ordinance No. 29-92, " An Ordinance To Amend Section 925. 13 Of The
Codified Ordinances Of Granville, Ohio, Establishing Water
Regulations And Charges And To Repeal Existing Section 925. 13 Of
Said Codified Ordinances."
Councilmember Garrett moved for the adoption of Ordinance
No. 29-92 as amended. Motion seconded by Councilmember Vance.
Discussion ensured along the same lines as discussion under
Ordinance No. 28-92. Councilmember Freytag moved to amend
Ordinance No. 29-92 as follows: to amend Section II and insert
the following language after paragraph (a):Upon proper proof of
hardship, the Village Manager may arrange for a payment schedule
for the foregoing capacity charge. Motion seconded by
Councilmember Herman. Roll call vote: Freytagy-es, Hermany-es,
Vance- no, Garrett- no, Eisenberg- yes, Shulman- absent, Marshallabsent.

Ordinance No. 319-2, A"n Ordinance To Amend Ordinance No. 359-1
Providing For Adjustments Of The Annual Budget For The Fiscal

Councilmember Herman moved for the adoption of Ordinance No.
31-92. Motion seconded by Councilmember Garrett. Roll call vote:
Hermany-es, Garretty-es, Freytagy-es, Vancey-es, Eisenbergy-es,
Shulmana-bsent, Marshalla-bsent. Five yes votes, two members
absent. Ordinance No. 31-92 duly adopted.

Ordinance No. 329-2, A"n Ordinance To Vary The Road And Sidewalk
Widths In The Village Green Section Of The Erinwood Planned Unit
Development."
Motion for adoption was made by Councilmember Freytag,
seconded by Councilmember Herman. Discussion. Councilmember
Garrett spoke in opposition to the four foot sidewalk variance
and based her opinion by walking with her husband, and that four
foot sidewalks were not wide enough for two people together
walking side- by-side. Councilmember Vance expressed his thoughts
on the issue of variances. With Council being constantly faced
with requests for variances there seemed to be a need to look at
the code, then either bring it up to date or abide by it.
Councilmember Garrett moved to amend Ordinance No. 32-92 by
striking out wording related to a variance to the sidewalk
regulations. Motion seconded by Councilmember Freytag. Roll call
vote: Garretty-es, Freytagy-es, Vance yes, Hermany-es, Eisenbergno,
Marshall- absent, Shulman- absent. Four yes votes, one no vote,
two members absent. Amendment to Ordinance No. 32-92 duly
adopted.
Roll call vote on the motion for adoption of Ordinance No.
32-92 as amended: Freytag- no, Herman- yes, Vance- no, Garrett- yes,
Eisenberg- yes, Marshall- absent, Shulman- absent. Three yes votes,
two no votes, two members absent. Motion carried. Ordinance No.
32-92 as amended duly adopted.
NEW BUSINESS
Resolution No. 92-52, " To Authorize The Village Manager To Submit
Grant Applications For 1993-1994 Capital Improvement Projects To
District 17, Ohio Public Works Commission, For Funding, On
Granville' s Behalf," was introduced, read in its entirety, and
moved for passage by Councilmember Herman. Motion seconded by
Councilmember Garrett. Motion carried. Resolution No. 92-52 duly
passed.
Mt. Parnassus Residents/ Request
Village Council received a letter from Marianne Masterson on
behalf of the residents of Mt. Parnassus seeking permission to
block the back hill (starting at the cemetery gates to the
intersection of "Old Orchard Drive"to),allow for a neighborhood
picnic Sunday afternoon, September 20.
Request was approved by consensus of Village Council.
Legislation drafts prepared by Village Law Director Rufus Hurst
covering the library alley issue, and; and fines for after- thefact
zoning applications. Mr. Hurst asked members to review the
drafts and make comments prior to the next regular meeting.

September 21, 1992 -Planning Commission Meeting. 7: 30 p.m.
October 7, 1992 -Regular Council Meeting, 7: 30 p.m. -Public
hearing on rezoning request for "Old Club House"property.
