ORDINANCE TO AMEND SECTIONS 909. 02
AND 909. 03 OF THE CODIFIED ORDINANCES OF
GRANVILLE, OHIO, PROVIDING FOR THE REMOVAL OF TREES
WITHIN A PUBLIC RIGHT- OF-WAY, AND DECLARING AN EMERGENCY
WHEREAS, existing Section 909. 02 of the Codified Ordinances
of Granville, Ohio provides for the charging of one-half of the expense of removal of the trees within a public right-of-way to the abutting property owners; and
WHEREAS, the Council of the Village of Granville believes
that the expense of such removal should be borne by the Village,
OHIO, THAT:
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF GRANVILLE,

Section III:
The second, third, and fourth sentences
of Section 909. 02 of the Codified Ordinances
of Granville, Ohio are hereby
repealed.
The following language is hereby made part of Section a 909. 02 of the Codified
Ordinances of Granville, Ohio:
Such notice shall be given by
the Manager in writing at least
fifteen (15) days prior to removal,
unless the Manager should
determine that immediate removal
is required to protect the public
health, safety, and welfare. Any
such removal shall be accomplished
by the Village or its agents at
the sole expense of the Village,
and the Village shall promptly
remove or cause to be removed all
wood from the public righto- fw-ay, which wood shall be the property of the Village.
Section 909. 03 of the Codified Ordinances
of Granville, Ohio is amended by adding
the following sentence to such Section:
If any tree is removed, treated,
or trimmed as provided in this
Section at the expense of the
abutting property owner, then
such property owner shall promptly
remove or cause to be removed all
wood from the public property or public right-of-way, and such wood shall be the property of the abutting property owner.

1 Section IV: This ordinance is hereby declared to be
an emergency measure, necessary for the
preservation of the public health, safety,
and general welfare, in that it is necessary
to provide tree maintenance during the
winter season, and therefore it shall take
effect immediately on passage.
