AN ORDINANCE CONFIRMING, RATIFYING AND MAKING DETERMINATIONS
AND ACTIONS WITH RESPECT TO THE IMPROVEMENTS TO CERTAIN PROPERTY
IN THE VILLAGE OF GRANVILLE, OHIO, AS DESCRIBED IN RESOLUTION NO.
91-56, LEVYING SPECIAL ASSESSMENTS FOR SUCH IMPROVEMENTS, AND
DECLARING AN EMERGENCY.
WHEREAS,
Resolution No.
this Council on November 6, 1991, duly adopted
91-56, the "Resolution of Necessity",declaring
the necessity of improving certain described property in the
Village of Granville, Ohio, (the "Municipality")by constructing
improvements consisting of water line extensions and
appurtenances thereto (the "Project")and declaring an emergency;
and
WHEREAS, no claims for damages alleged to result from said
improvements were filed within the period provide by law for
filing such claims; and
WHEREAS, no objections to said improvements were filed
within the period provided by law for filing such objections; and
WHEREAS, the portion of the Project to be financed with
special assessments is substantially completed; and
WHEREAS, the calculation of revised assessments for the
Project has been completed and such revised assessments are on
file in the office of the Clerk of Council;
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village
of Granville, Ohio (hereinafter called the M" unicipality") a t (
least five-sevenths of all members elected or appointed thereto
concurring) that:

I: That the determination to proceed with the
improvement of certain properties in the
Municipality by constructing the Project, all as
described in the Resolution of Necessity, is hereby
confirmed, ratified and made.

That it is hereby determined that the improvements
constituting the Project were made in accordance
with the provisions of the Resolution of Necessity,
and in accordance with the plans, specifications,
profiles and estimates of cost of the Project,
approved pursuant to the Resolution of Necessity,
and now on file in the office of the Clerk of
Council. All actions of employees and officers of
the Municipality in constructing the Project are hereby approved, ratified and confirmed.
That the assessable portion of the cost of the project shall be assessed against the benefitted
properties, in the manner and in the number of
annual installments as provided in the Resolution of Necessity.
That the estimated assessments heretofore prepared and filed in the office of the Clerk of Council in
accordance with the Resolution of Necessity, be and the same are hereby adopted and confirmed. The revised assessments for the Project heretofore prepared and filed in the office of the Clerk of Council are hereby adopted and confirmed as the final special assessments for the Project and such final special assessments are hereby levied and

assessed upon the properties listed in the
Resolution of Necessity as benefited by the
Project. Such final special assessments are hereby
determined to be in the same proportion to the
estimated assessments as originally filed as the
actual cost of Project is to the estimated cost of
the Project as originally filed, in the proportion
to the special benefits received, and not in excess
of any statutory limitation. The final special
assessments hereby levied against such property may
be paid in cash during the thirty (30) day period
immediately following passage of this Ordinance, or
at the option of the property owner, in twenty (20)
annual installments, with interest on the unpaid
principal amount at the same rate borne by bonds,
notes or other obligations of the Municipality
issued in anticipation of the collection of such
unpaid assessments. All cash payments shall be made
to the Director of Finance of the Municipality.
All assessments and installments thereof remaining
unpaid at the expiration of such thirty (30) day
period, shall be certified by the Clerk of Council
to the County Auditor as provided by law to be
placed on the tax duplicate and collected as other
taxes are collected.
V: That the Clerk of Council be and is hereby directed
to deliver a certified copy of this Ordinance to
the County Auditor within fifteen (15) days after
the date of passage hereof.

That the Clerk of Council shall cause a notice of
passage of this Ordinance to be published once in a
newspaper of general circulation in the
Municipality and to continue said final special
assessments on file in her office.
That it is found and determined that all formal
actions of this Council concerning and relating to
the passage of this Ordinance were passes in an
open meeting of this Council, and of its committees
that resulted in such formal action, were in
meetings open to the public, in compliance with the
law, including Section 121. 22 of the Ohio Revised
Code.
That this Ordinance is hereby declared to be an
emergency measure necessary for the immediate
preservation of the public peace, health, safety
and welfare of the Municipality, for the reason
that the immediate effectiveness of this Ordinance
is necessary for the orderly financing of the
Project, and so that all legal prerequisites to the
Project and the assessments relating to the Project
can be completed as soon as possible thereby
avoiding increases financing costs; therefore, this
Ordinance shall be in full force and effect from
and immediately after its passage.
