AN ORDINANCE TO REQUIRE THE CLOSURE OF VEHICLE ACCESS TO
SHANNON LANE FROM NEWARK-GRANVILLE ROAD UPON COMPLETION
OF DONEGAL DRIVE WITHIN THE VILLAGE GREEN SECTION OF THE
ERINWOOD PLANNED UNIT DEVELOPMENT.
WHEREAS, this Village Council allowed construction of Shannon Lane within
the Village Green section of the Erinwood Planned Unit Development as a private drive
rather than as a public street, and;
WHEREAS, Shannon Lane is therefore not designed to accept through vehicle traffic from Newark-Granville Road, and;
WHEREAS, The Murphy Group, developer of the Erinwood Planned Unit
Development has asked for and received a delay in the required construction of
Donegal Drive, primary access to Shannon Lane, until such time as Donegal Drive is constructed to serve that section of the Village Green at Erinwood, and;
WHEREAS, The Murphy Group has further acknowledged its obligation to eliminate vehicular access to Shannon Lane within three calendar years from the date of passage of this ordinance or upon completion of Donegal Drive, whichever comes first,
NOW, THEREFORE, be it ordained by the Council of Granville, Ohio:
Section I: That vehicular access to Shannon Lane from Newark-Granville Road
shall be terminated by erection of appropriate fencing or landscaping and elimination of pavement at Newark- Granville Road at its juncture with Shannon Lane by the Murphy Group, developer of the Village Green at Erinwood, at the developer's expense.
Section 11: That said termination of access shall take place upon the completion of construction of Donegal Drive or three years from the date of passage of this ordinance, whichever comes first.
Section 111: That this ordinance shall take effect and be in force from and after the earliest date allowed by law.
