WHEREAS, by Ordinance No. 15-98, the Council authorized the Village Manager, Law Director, or other designee to proceed with the presentation of a formal offer to purchase that property which is commonly known as 200 East Broadway, and to cause the preparation and execution of any and all documents necessary or appropriate to such offer; and
WHEREAS, the Village Manager has presented a formal offer to purchase the property in the form of a Real Estate Purchase Agreement, a copy of which is attached to this Ordinance as Exhibit "A", which has been agreed upon and signed by the owner of such property, as well as the Village Manager; and
WHEREAS, in accordance with Ordinance No. 15-98 and paragraph 5(B) of the Real Estate Purchase Contract, the provisions of such Real Estate Purchase Contract are subject to final approval of Council; and
WHEREAS, the Council has determined that the terms of the Real Estate Purchase Contract are acceptable, and as a result thereof desires to approve the Real Estate Purchase Contract and the purchase of the property by the Village under the terms contained therein.
NOW THEREFORE BE IT RESOLVED by the Council of Granville, Ohio:
Section I: That the Real Estate Purchase Contract as attached to this Ordinance as Exhibit "A" is approved by Council in accordance with Ordinance No. 15-98;
Section II: That the Village proceed to purchase the property that is the subject to the Real Estate Purchase Contract, and take any and all actions contemplated or appropriate by the Village under the terms of the Real Estate Purchase Contract;
Section III: That the Village Manager, Mayor, and/or Law Director, or any one of them, be, and hereby are, authorized on behalf of the Village to take all actions that may be necessary or appropriate to effectuate the purchase of the property under the terms of the Real Estate Purchase Contract.
