ORDINANCE NO. 06-2010
AN ORDINANCE TO AMEND SECTIONS 1307.01, 1309.01, 1309.03, 1311.01, 1311.02, AND 1311.03 OF THE CODIFIED ORDINANCES OF GRANVILLE, OHIO AND TO REPEAL EXISTING SECTIONS 1309.06 AND 1311.04 OF THE CODIFIED ORDINANCES OF GRANVILLE, OHIO
WHEREAS, the Council of the Village of Granville, Ohio, has determined that it is necessary to modernize and update the Building Code of the Village in order to better protect the general health, safety, and welfare of the citizens of the Village.
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF GRANVILLE, OHIO, THAT:
Section I. Existing section 1307.01 is hereby amended as follows:
1307.01 ESTABLISHED; AUTHORITY.
(a) The Municipal Building Department is hereby established.
(b) Such department shall have full authority to enforce all laws, statutes and regulations as provided and authorized in the Ohio Revised Code and the Ohio Administrative Code including plumbing inspections as set forth in 4101:3-3-312 of the Ohio Administrative Code.
Section II. Existing sections 1309.01 and 1309.03 of the Codified Ordinances of Granville, Ohio are hereby amended as follows:
(a) The owner, agent, lessee, occupant or other person having control of any building within the city to which street numbers have been assigned shall cause the proper Arabic numbers to be placed in a conspicuous place on the front of each dwelling. The numbers shall be displayed in such a manner that they shall at all times be legible and visible from the street pavement in front of such dwelling. If a dwelling stands back more than 45 feet from the front lot line, the number shall be conspicuously displayed at or near the walk, driveway or common entrance to such dwelling at street line on a gate post, fence, mailbox or other appropriate place which will make it legible and visible from street pavement and when approaching can be seen from either direction. As stated in this section, "front" means that side of the dwelling which faces the street on which the number has been allotted.
(b) The numbers shall be four inches minimum in height and shall be in contrasting color to that surface on which they are placed.
(a) All the dwellings situated within the corporate limits of the Village shall be numbered in the manner and according to the system herein prescribed.
(b) No person without just cause shall remove, alter or deface any house number properly assigned and placed on or near a dwelling. Nor shall any person without just cause place or retain on any dwelling any number other than the one duly assigned if such number could be reasonably mistaken for the assigned street number.
(c) No person shall negligently fail to install or maintain the proper numbers as required by this subchapter. This subchapter shall also be retroactive and affect all dwellings within the Village.
Section III. Existing sections 1311.01, 1311.02 and 1311.03 of the Codified Ordinances of Granville, Ohio are hereby amended as follows:
1311.01 ADOPTION BY REFERENCE.
There is hereby adopted by reference the 2006 Residential Code of Ohio, as may be amended from time to time, which shall be known as the Granville Residential Code. Such Code is hereby adopted and incorporated as if fully set out at length herein, and from the date on which this chapter shall take effect, the provisions thereof shall be controlling within the limits of the Village.
1311.02 FILE AND DISTRIBUTION COPIES.
Copies of the 2006 Residential Code of Ohio adopted herein are on file with the Licking County Building Code Department for inspection by the public. The Clerk also has copies available for distribution to the public at cost.
Except as otherwise specifically provided for in this chapter, in all other cases of conflict between the Residential Code of Ohio and any other Municipal ordinance or technical code adopted thereby, the more restrictive provision shall govern.
Section IV. Existing sections 1309.06 and 1311.04 of Chapter 13 of the Codified Ordinances of Granville Ohio are hereby repealed.
Section V. This ordinance shall become effective upon the earliest date allowed by the laws of the State of Ohio and the Charter of the Village of Granville.
