ORDINANCE NO. 09-2011
AN ORDINANCE ADOPTING THE RACCOON VALLEY AQUIFER WELLHEAD PROTECTION OVERLAY DISTRICT ZONE AREA
WHERAS, the Village Council views the protection of the Raccoon Valley Aquifer as critical to the future of the Village of Granville; and
WHEREAS, it is the desire of the Village Council to amend the official zoning map of the Village of Granville to identify said Raccoon Valley Aquifer Wellhead Protection Overlay District; and
WHEREAS, included in that Raccoon Valley Aquifer Wellhead Protection Overlay District was a reference to the area of the Wellhead Protection Overlay as shown and described on the official zoning map, even though this area has not previously been shown or identified on the zoning map, as the term is defined in Section 1135.01(a)(114) of the Codified Ordinances; and
WHEREAS, the Source Water Protection Team has received an endorsement from the Ohio EPA for their plan which includes the 1-year inner protection zone for the existing well field area; and
WHEREAS, the Village Council is in agreement with the Ohio EPA and endorses the One Year Inner Protection Zone as the Wellhead Protection Overlay District area.
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Granville, State of Ohio that:
Section I: Upon the endorsement of the Ohio EPA of the Source Water Protection Plan and after a public hearing by the Village Council, the proposal to designate the 1-year inner protection zone as the Wellhead Protection Overlay District area on the zoning map is hereby approved and this area is identified in accordance with Section II of this Ordinance.
Section II: The Zoning Map of the Village of Granville, Ohio, is hereby amended and revised to designate the 1-year inner protection zone as the Wellhead Protection Overlay District area. Said area is shown on Exhibit A, which is attached hereto and made a part hereof.
Section III: The Village Manager is hereby authorized and directed to make this change on the zoning map maintained under Section 1155.02 of the Codified Ordinances.
Section IV: This Ordinance shall take effect and be in full force and effect upon the earliest date allowed by law.
