AN ORDINANCE to APPROVE SUBDIVISION REGULATIONS VARIANCE APPLICATION #2016-54
WHEREAS, on May 23, 2016, the Granville Commission heard Subdivision Regulations Variance Application #2016-54, submitted by property owners Tod and Evelyn Frolking, for variances regarding their proposed Village Roots neighborhood development. The requested variances would: (1) Reduce the minimum width of Local Streets from twenty-six feet (26’) to twenty-two feet (22’) and twenty feet ten-inches (20’ 10”) respectively; and (2) Reduce the minimum right-of-way width on said streets from sixty feet (60’) to fifty-two feet (52’) and fifty-eight feet (58’) respectively, as indicated on the sketch plan submitted with Application No. 2016-54; and
WHEREAS, the Planning Commission reviewed and applied the statutory criteria for Subdivision Regulations variance requests as set forth in Section 1109.08 of the Granville Codified Ordinance; and
WHEREAS, the Planning Commission determined that unique conditions or special circumstances make it impractical and infeasible for the Applicants to satisfy the applicable Subdivision Regulations; and
WHEREAS, the Planning Commission recommends that Council approve Application
#2016-54, subject to the condition that each developed lot in the Village Roots neighborhood shall include a requirement for a minimum of four (4) vehicle off street parking per lot to be memorialized by deed restrictions.
NOW, THEREFORE, be it resolved by the Council of the Village of Granville, Ohio, that:
Section I: Council hereby follows the recommendation of the Granville Planning Commission and APPROVES Subdivision Regulations Variance Application #2016-54 as to the street width and right-of-way variances, with the condition that each developed lot in the Village Roots neighborhood shall include a requirement for a minimum of four (4) vehicle off street parking per lot to be memorialized by deed restrictions.
Section II: This Ordinance shall take effect on the earliest date allowed by the laws of the State of Ohio and the Charter of the Village of Granville.
