New Business:

First Baptist Church, 115 West Broadway - Sign
 We had given approval for another sign and now they have decided they need a modification for the freestanding sign in front of the Education Building.  The wood sign will be light brown and dark brown with black letters and will be 5' from the edge of the pavement.
 
MR. MITCHELL MOVED TO APPROVE. MR. WILKENFELD SECONDED, AND MOTION WAS UNANIMOUSLY APPROVED

Northstar Realty, Galway Drive - Sign
 The applicant wishes a temporary 4.8' freestanding sign for Galway, identical to the one approved for the property next to Bob Evans.  The size is correct on the drawing.

MR. WILKENFELD MOVED TO APPROVE 06-009 FOR A TEMPORARY SIGN WITH THE STIPULATION THAT THE SIGN WILL BE 4.8 RATHER THAN THE DIMENSIONS ON THE PAGE IN THE APPLICATION.  MR. MITCHELL SECONDED AND MOTION WAS UNANIMOUSLY APPROVED.

Bruce Westall, 231 East Maple Street - Addition
  The applicant wishes to replace one-car garage demolished by a tree with two rooms and a bath. Mr. Strayer added that for anything in the SRD, if it goes over 20% of existing square footage, it has to come before GPC. There is nothing in the AROD except for massing, and it has to be consistent with other structures in the area.  
Mr. Westall said it's technically a garage but the since the tree demolished it, there is a place he wants to put a one-story addition. The footprint is 30'x30' and the addition will be 32' x 20'.
 Mr. Mitchell asked whether he will match windows and trim, and he was told Yes. The siding will be cedar or cement board, lap siding. It will rest on the slab with an extension further in the rear.
 Mr. Wilkenfeld noted it is to be set way back off the street and asked whether it will go all the way to the edge of the building, and Mr. Westall said it will be lined up with the neighbor.
 Ms. O'Keefe asked about the massing ornamentation, and Mr. Strayer said it will be similar to other buildings in the area.
 Mr. Riffle felt that as long as he is matching siding, trim, and windows he sees nothing that detracts from the plan.

MR. MITCHELL MOVED TO APPROVE 06-010 AS SUBMITTED. MR. WILKENFELD SECONDED, AND MOTION WAS UNANIMOUSLY APPROVED.

INT Business Company, 117 North Prospect - Signs
For changes to the projecting sign and wall sign at Town and Gown, the applicant wishes to repaint them showing the new owner.

MR. MITCHELL MOVED TO APPROVE SIGNS CONTINGENT UPON THEIR BEING THE SAME SIGNS WITH NEW DECORATIONS AND HAVING A WHITE BORDER.  MR. WILKENFELD SECONDED, AND MOTION WAS UNANIMOUSLY APPROVED.

Sharon Phelps, 120 West Broadway - Sign
 The applicant wishes additional signage attached to the existing sign. It is in the AROD so it is nonconforming and needs a variance.  They came in earlier for work sessions, but we never approved a sign.  There will be three different signs with one freestanding sign. 
 Ms. Phelps said the new sign tags will match the existing sign, with the same dimensions, same width, same type, and same color.

Mr. Wilkenfeld applied the application to the criteria:
A.  That special circumstances or conditions exist which are peculiar to the land or structure(s) involved and which are not applicable to other lands or structures in the same zoning district.  This applies because there is more than one business in the location.  
 B. That a literal interpretation of the provisions of this Zoning Ordinance would deprive the applicants of rights commonly enjoyed by other properties in the same zoning district under the provisions of this Ordinance.  There are other hand-written signs in the district
C. That the special conditions and circumstances do not result from the actions of the applicant.  True. 
D. That the granting the variance will not confer on the applicant any undue privilege that is denied by this Ordinance to other lands or structures in the same zoning district. True.
E. That the granting of the variance will in no other manner adversely affect the health, safety, and general welfare of the persons residing or working within the vicinity of the proposed variance.  It would not adversely affect health, safety, and general welfare. 

MR. WILKENFELD MOVED TO APPROVE VARIANCE FOR NONCONFORMING SIGN.  MR. MITCHELL SECONDED AND MOTION WAS UNANIMOUSLY APPROVED

MR. WILKENFELD MOVED TO APPROVE 06-012 WITH CONDITION THAT THE BORDER BE THE SAME COLOR AS THE EXISTING ONE. MR. MITCHELL SECONDED AND MOTION WAS UNANIMOUSLY APPROVED.

Mark Clemente, 215 West Broadway - Addition
 The application is for a second story, two floor addition.  Marty Caruso, Architect, added that the home was built in 1855, and the addition will be for Mr. Clemente's mother.  The first floor will be extending to the center 3'4" and to the west, 6'8".  The second floor goes right above that, and they will keep the architectural style of the home and match the roof line and windows.
 Ms. O'Keefe noted the former owner added a bedroom, and Mr. Caruso said Yes they added a room and converted the third floor and added a bath.  What is proposed in the future is turning the master bedroom west. It will hardly be visible from the street.  The back of the building is 6'8"
 Mr. Mitchell asked whether they will copy the soffits and was told Yes.  It would be half the original because he decreased the freeze board.  The little porch on the east will not be modified.
 Mr. Riffle asked whether the window above the sink could be centered, and Mr. Clemente said his wife refuses to push it farther out because it goes into the flower bed.  Mrs. Clemente was called on the cell phone and she adamantly refused to move the window. 

MR. MITCHELL MOVED TO APPROVE 06-013 AS SUBMITTED, HOWEVER, WITH A STRONG RECOMMENDATION THAT THE WEST ELEVATION EAST KITCHEN WINDOW BE AS CLOSE AS PRACTICALITY TO THE SOUTH RELATIVE TO THE WINDOW ABOVE.  MR. WILKENFELD SECONDED, AND MOTION WAS UNANIMOUSLY APPROVED.

Old Business:

Brews, 116 East Broadway - modification
 The Acting Village manager recommended that we take another look at the location of the A.C. units and tie it in with the cellar door to make it look nicer 
 Jerry Martin said the entrance to the basement is more important than the drive-through.
 Mr. Riffle asked what is in the back of the building that precludes putting the A.C. there and was told there are fans, electricals, and grease traps.  Why not take off the drive-through and drop in the A.C. and add landscaping, Mr. Riffle asked.  The problem with A.C. units on the side, even screened, is that it is right across from the church entrance. 
 Mr. Strayer said Village Council would like to see the drive-through and cellar doors removed.  But Mr. Martin wants access to the basement.  He recommended putting landscaping and fencing for appearance and lessening of noise. 
 Mr. Mitchell thought the A.C. can be in the rear by moving the tank further out and the A.C. close to the building.  But Mr. Martin said he would have to run the coolant line across the side.
 Mr. Wilkenfeld said we would rather have it in the back but in fairness, we should give Mr. Martin an alternative.
 Mr. Riffle would prefer the A.C. on the roof, but Mr. Martin said that is inefficient.   Mr. Strayer thought the neighbors might not want it on the side, but do it and add landscaping and fence.
 Mr. Mitchell asked about the screening for the dumpster
 Mr. Mitchell suggested approving what we are doing and ask them to come back with screening.  Perhaps add a black wrought iron fence to match other fence screening inside.

MR. MITCHELL MOVED TO APPROVE MODIFICATION OF PREVIOUS APPROVAL OF 05-197 WITH STIPULATIONS:  (1) REMOVE EXISTING DRIVE-THROUGH; (2) PATCH BUILDING TO MATCH EXISTING STUCCO MATERIAL; (3) ALLOW 3 A.C. UNITS TO BE LOCATED BETWEEN THE OLD DRIVE-THROUGH AND NEW DOOR CUT IN AS PER DRAWINGS; (4) VISUAL SCREENING WILL BE SUBMITTED BY APPLICANT AT A FUTURE DATE AND APPLICANT WILL BRING IT TO THE PLANNER FOR APPROVAL.  MR. WILKENFELD SECONDED, AND MOTION WAS UNANIMOUSLY APPROVED.

Finding of Fact:   MR. WILKENFELD MOVED TO APPROVE THE FINDINGS FOR ITEMS A, B,C,D,E,F  UNDER NEW BUSINESS AND ITEM A UNDER NEW BUSINESS AND WE FIND THEM CONSISTENT WITH RELEVANT SECTIONS OF THE CODE AS OUTLINED IN THE VILLAGE PLANNER'S MEMO OF FEBRUARY 13, 2006.  MR. Old Business:

Village Baker, 212 S. Main Street - Sidewalk Sign
 This was tabled at the last meeting.  Mr. Strayer and Mr. Burriss met and came up with a design for the sign that would seem to be acceptable to all.  They will use the existing sign and put on a border and take the top two lines for "Village Baker."  The next 4 lines are changeable copy with Plexiglas cover to provide protection from the elements.  If we proceed with approval, he would want to have a variance for changeable copy.  It is a special situation with the size and nature and the location along the road.

MR. WILKENFELD MOVED TO UNTABLE.  MR TYLER SECONDED AND MOTION WAS UNANIMOUSLY APPROVED.

 The applicant showed a picture of what they want to do with a border and 4 lines of copy.  She described the sign in detail.
  Mr. Wilkenfeld applied the application to the criteria:

MR. WILKENFELD MDOVED TO APPROVE 05-172 WITH CONDITION THAT THE APPLICANT BRINGS THE FINAL DESIGN TO THE VILLAGE PLANNER AND MR. BURRISS.  MR. MITCHELL SECONDED AND MOTION WAS UNANIMOUSLY APPROVED.


Innocent Wodzisz, 136 East Broadway - Sign

 The application was tabled pending further design review.
MR. WILKENFELD MOVED TO UNTABLE. MR. MITCHELL SECONDED, AND MOTION WAS UNANIMOUSLY APPROVED
 Mr. Wodsisz brought in the newly designed neon "OPEN" sign, and Mr. Strayer said we are trying to encourage the use of second-floor businesses.  The sign will only be on when the business is open, 12-5 p.m. and until 7 on Thursday. 
 Ms. O'Keefe asked what the artistic element is, and the applicant said it's a contemporary setting, a Mondrian element.  She thought this was pretty industrial.
 Mr. Tyler said we wanted more of an artistic piece, but now we have to be objective.
 Mr. Wilkenfeld said the coffee shop made an artistic neon sign.  This design is not appealing to him, but it fits the criteria.
 Mr. Tyler asked if he could redesign a bit further, and Mr. Wodsisz said No, this is it.  If you deny it, that is it.  He has spent a lot of time on this.

MR. WILKENFELD MOVED TO APPROVE 05-194.  MR TYLER SECONDED AND IT WAS UNANIMOUSLY APPROVED.

Mary Thurlow-Collen, 329 West Elm - Addition

 The applicant wishes to enclose her door stoop.  Ned Roberts said it will be frame, board and batten lap siding like the house.  It's difficult to see it from the road; it's below grade.  She does not have any entranceway and she just wants a small vestibule.  We will replace the roof.  The pad is 4', and there will be a 4" overhang.  We may be putting in another double-hung window. The trim will match the existing trim.

MR. WILKENFELD MOVED TO APPROVE 06-001 AND (1) THEY WILL ADD TWO DOUBLE-HUNG WINDOWS ON WEST ELEVATION TO BE THE SAME SIZE AS THE ONE ON THE NORTH; (2)  TRIM WILL MATCH EXISTING TRIM; (3)  ADD 4" OVERHANG; (4) AND SIDING WILL MATCH EXISTING SIDING.  MR. MITCHELL SECONDED AND MOTION WAS UNANIMOUSLY APPROVED.

Finding of Fact:   MR. Old Business:

Village Baker, 212 S. Main Street - Sidewalk Sign
 Mr. Strayer said the applicant asked that this be tabled again tonight.

Granville Golf Course, Trinity Court - Lot Split

 Mr. Strayer said the Law Director reviewed the application and determined this should be handled at the county level.  Mr. Strayer has not received anything formally withdrawing the application. 
 Tom Cumminsky from PNB said the county will not approve since anything less than 5 acres is not a subdivision. Mr. Strayer said we have nothing to base approval or denial on.  It is exempt from our regulations. It will not come back to us and may have to go to the county prosecutor.  Our definition of subdivision is over 5 acres, and under 5 acres we don't deal with.
Mr. Riffle said we will keep this on the table.  Mr. Strayer told the audience that any approvals for lot split will be done at the county level and any disagreements will be taken up with the county prosecutor.  The preliminary plat is still on the table.
 Mia Law wanted to know what the owner intends to do with the 94 acres, and Mr. Cumminsky said no plans have been made.  The Granville Golf Course was the agent for PNB, not an interested party.  GGC has an option.  Mr. Burris added that preliminary plat will be brought in here for review and people can ask questions then.

New Business: 

Denison University - freestanding signs
 Mr. Chonko explained the signage for (1) at the physical plant, "shipping and receiving" and (2) at the fine arts building in the tree lawn close to the entrance at Broadway and Cherry. This is typical of other signs we have approved.

MR. WILKENFELD MOVED TO APPROVE 05-201 FOR TWO SIGNS AT THE PHYSICAL PLANT AND AT BROADWAY AND CHERRY FACING SOUTH.  MR. BURRISS SECONDED, AND MOTION WAS UNANIMOUSLY APPROVED. 

Denison University - parking and lighting
 Mr. Chonko said there will be a new road off Pearl Street and they hope eventually to put up two pillars.  Ms. O'Keefe asked whether they will require a traffic study and was told No.  They held a meeting for the neighbors and only one showed up.  The off lighting will be no more than a full moon.  It probably will be on until 11 p.m. Mr. Strayer said the lighting falls within our lighting requirements.

MR. WILKENFELD MOVED TO APPROVE 05-202 AS PRESENTED. MR. BURRISS SECONDED AND IT WAS UNANIMOUSLY APPROVED.

Julie Smith, 332 West Elm - Shed
 Mr. Strayer said this was approved by BZBA for variance from 10' to 7' from lot line.
 Ms. Smith said it will have shutters and be attractive.  They have no other place to store lawn equipment, and they placed it there because it is the flattest spot and least disruptive to the gardens.  You won't see it beyond the trees. It will be on a skid, moveable.

MR. MITCHELL MOVED TO APPROVE 05-181 AS PRESENTED.  MR. TYLER SECONDED AND MOTION WAS UNANIMOUSLY APPROVED.

William York, 119 N. Granger Street - freestanding sign

 Mr. Strayer said this is across from the school district office and will go where the "apartment for rent" sign is now.  Ms. O'Keefe asked whether they would be able to add "Apartment for rent" to the sign, and the answer was No, not as this is presented.  Mr. Tyler requested adding approval for hanging sign saying "apartment for rent" as appropriate.

MR. TYLER MOVED TO APPROVE WITH THE PROVISION THAT MR. STRAYER WILL GET WITH THE APPLICANT TO SET UP SO HE MAY HAVE PERMISSION TO ADD A "FOR RENT" SIGN ATTACHED TO THE BOTTOM. THE FONTS WILL MATCH, AND IT WILL HAVE APPROPRIATE LANDSCAPING.  MR. WILKENFELD SECONDED, AND MOTION WAS UNANIMOUSLY APPROVED.

Chase Bank, 484 South Main - Signs
 Mr. Strayer explained this is for the ATM at the Ross Market because Chase and Bank One have merged and are replacing all signs.  The only condition is on the freestanding sign for the entrance sign; they applied for two sign tags but we have always tried to stick with the existing color design.  Signs cannot be internally lit.

MR. WILKENFELD MOVED TO APPROVE THE FOLLOWING CONDITIONS:  (1) CHASE USES THE SAME COLOR SCHEME, WHITE LETTERS ON DARK BLUE BACKGROUND, AS THE ROSS SIGN AND (2) NO INTERNALLY ILLUMINATED SIGNS.  MR. TYLER SECONDED AND MOTION WAS UNANIMOUSLY APPROVED.

Brandon Lackey, 204 S. Pearl Street - Fence
Mr. Lackey showed where the fence will go, on the west and north sides.  It will have no gates, and the corner posts are similar to those pictured.  It will have the same detail as that at the Darfus house.
 Mr. Strayer encouraged him to keep the fence one foot from the sidewalk.

MR. TYLER MOVED TO APPROVE FOR FENCE WITH PROVISION THAT IT WILL BE SET BACK BETWEEN 6" AND 1' FROM SIDEWALK.  MR. WILKENFELD SECONDED, AND MOTION WAS UNANIMOUSLY APPROVED.

Innocent Wodzisz, 136 East Broadway - Sign
The applicant wishes a neon "open" sign in the window.  Mr. Wilkenfeld stated that if a neon sign is used, it has to be considered artful and identify the business.    Mr. Wodzisz said he could make it artful for a couple of hundred dollars and keep the neon.

MR. WILKENFELD MOVED TO TABLE PER APPLICANT'S REQUEST PENDING SUBMISSION OF AN ARTFUL SIGN. MR. MITCHELL SECONDED AND MOTION WAS UNANIMOUSLY APPROVED.

Kessler Sign Co., 222 East Broadway - sign
 Unizan Bank is changing to Huntington and they need new signage.  They are asking for bronze posts but that would need a variance for four colors.  They also have a design for white posts, but they prefer bronze.
 Ms. O'Keefe asked if the shades of green were very visible.  Doug Gabriel from Kessler brought color samples. 
 Mr. Burriss thought with all the white trim on the building, we should continue that color.  We have tried for consistency in the village and white would be more consistent than bronze.  Mr. Wilkenfeld and others were concerned with the green and would prefer white posts with dark green and white.

MR. TYLER MOVED TO APPROVE 05-195 FORTHE FREESTANDING SIGN WITH PROVISION THAT THEY USE PMS 3435 AND PMS 576 AND THAT THE SUPPORT POSTS BE WHITE AND LETTERING WHITE.  MR WILKENFELD SECONDED, AND MOTION WAS UNANIMOUSLY APPROVED.

Kessler Sign Co., 222 East Broadway - Wall sign
 The bank also needs a new wall sign.

MR. WILKENFELD MOVED TO APPROVE 05-196.  MR. TYLER SECONDED AND MOTION WAS UNANIMOUSLY APPROVED. 

Brews, 116 East Broadway Modification
 Based upon a redesign, Brew's needs modifications for doors.  Some construction has begun and the applicant knows he is at risk if we do not approve.  They want to remove the drive-up, remove cellar door, and add two doors.  They will close one door and window toward the rear and move the AC.
 Jerry Martin stated they will not remove the drive-through window and cellar door.    Mr. Strayer said part of the original application was for removal of elements, and Mr. Wilkenfeld noted that Mr. Martin does not have to do all these things if he chooses not to do them within two years.
 Mr. Riffle would prefer the AC in a different location than right on the side.  Mr. Martin replied that they put it there so as to not block the driveway.  Mr. Burriss suggested putting it on the roof.  If they put it farther back on the driveway, what would they use for screening?  Mr. Martin said the first preference is in the rear, and screening should match the dumpster.   Second choice would be behind the existing drive-through, with screening consistent with that used at the dumpster.  Problem with the rear is the proximity to grease and the possibility of fire and not enough room for the truck.  Mr. Riffle said if there is a problem with the rear location with the engineer, he should bring back a different proposal to the Village Planner.

MR. MITCHELL MOVED TO APPROVE 05-197, SPECIFICALLY:  (1) MOVE EXIT DOOR ON THE WEST SIDE 10' NORTH TO CORNER; (2) MOVE PROPOSED EXIT DOOR 14' EAST; (3) REMOVE AC TO THE REAR AND ADD ONE AC UNIT, SPECIFICALLY PER DRAWING A-31 DATED JULY 13, 2005; (4) ADD SCREENING COORDINATE WITH SCREENING BEHIND DUMPSTER; (5) BALCONY DEPTH WILL BE AT 8', NOT DIMENSIONS PER REVIEW DRAWING. MR. WILKENFELD SECONDED AND MOTION WAS UNANIMOUSLY APPROVED.

Prudential Integrity One, 120 East Broadway - Change of Use
 The applicant wishes to change the use from specialty shop to professional office.  Patty Urbatis said she will stay upstairs for an office.

MR. TYLER MOVED TO APPROVE 05-198 AS SUBMITTED.  MR. WILKENFELD SECONDED, AND MOTION WAS UNANIMOUSLY APPROVED.

Prudential Integrity One, 120 East Broadway - Awning
The applicant has two storefronts and wishes an awning up at the top, but it would cover the architectural windows, so it will substitute the Home Pleasures awning.  The problem in bringing the awning down it gets to be fairly low. She might be able to change the angle of the awning, coming down more straight.  She asked whether she has to have an awning and the answer was No. 

MR. WILKENFELD MOVED TO APPROVE 05-199 FOR (1) ONE CONTINUOUS AWNING; (2) THE APPLICANT AGREES THAT IT WILL BE BROUGHT BELOW THE HISTORICAL ARCHITECTURE; AND (3) SHE WILL WORK WITH THE VILLAGE PLANNER ON THE ANGLE SO THAT NOBODY GETS INJURED GOING THROUGH THE DOOR.

 The applicant said this sign would be the same as the existing wall sign but longer.    She also wants to add "Prudential" to the awning drop with final design to be approved by Village Planner.  Mr. Burriss wanted it centered on the awning drop.  Mr. Strayer said the wall sign and awning might be OK, but a window sign would be over the maximum. 

MR. WILKENFELD MOVED TO APPROVE 05-200 FOR WALL SIGN.  THEY WILL TAKE THE WALL SIGN AND CENTER IT ON THE FRONT OF THE BUILDING IN FRONT OF THE SPACE; (2) APPLICANT CAN ALSO INCLUDE AS PRESENTED IN THE APPLICATION AN AWNING SKIRT IN BLUE AND WHITE.  MR. MITCHELL SECONDED AND MOTION WAS UNANIMOUSLY APPROVED.

Work Session:

South Galway Drive

 Gary Smith and Tom Brakeman described the proposed development for 17 acres at Galway and Cherry Valley.  It is zoned for retail, but they want a mixed use for office, residential, and retail in three buildings.  They foresee quasi-retail, condos, a bank, and a two-acre park with heavy landscaping.  Small local businesses will serve the city.
 They went through the code and tried to create a mixed use plan in a village concept with mix of architecture to block up the massing.  It will have low intensity uses and pedestrian appeal with retail at the street and condos behind.  They expect 54 residential units. The plan is for starter-outers and empty nesters, and probably few or no children would be involved.
 Mr. Wilkenfeld would rather have the whole piece presented to us at once rather than piecemeal.
 Mr. Burriss said they have done a great job, especially with pedestrian momentum.  But they should move toward the shops, for people don't want to walk across parking lots.  He would like to see even bigger islands.  Look at a change in paving materials.  Lighting will be an issue.
 Ms. O'Keefe asked about civic uses and was told maybe they could use an empty office.  Signage will match Granville's. They will do a traffic study.
 
Finding of Fact:   MR. WILKENFELD MOVED TO APPROVE THE FINDINGS FOR ITEMS A,B,C,D,E,F,H,I,J,K,L, AND M UNDER NEW BUSINESS AND WE FIND THEM CONSISTENT WITH RELEVANT SECTIONS OF THE CODE AS OUTLINED IN THE VILLAGE PLANNER'S MEMO OF JANUARY 9, 2006.  MR. BURRISS SECONDED, AND MOTION WAS UNANIMOUSLY APPROVED.
