RESOLUTION 09-02

A RESOLUTION EXPRESSING THE VILLAGE'S WILLINGNESS TO ACCEPT WASTEWATER FROM CRENO'S PIZZA, 1256 COLUMBUS ROAD, AND AUTHORIZING THE VILLAGE MANAGER TO SEND A RELATED LETTER TO THE OHIO ENVIRONMENTAL PROTECTION AGENCY 

WHEREAS, the existing National Pollution Discharge Elimination System (NPDES) permit for the Creno's Pizza restaurant, located at 1256 Columbus Road, is scheduled to expire on July 31, 2009; and

WHEREAS, a provision in that existing permit provides that the permittee shall abandon its disposal system and shall connect to a publicly owned treatment works whenever such publicly owned system becomes available and accessible; and

WHEREAS, while Creno's Pizza is located in Granville Township, it is adjacent to the sewer line that was constructed to serve Kendal at Granville; and

WHEREAS, the Ohio Environmental Protection Agency (OEPA) has asked the Village whether it is willing to provide sanitary sewer service to the Creno's Pizza restaurant located at 1256 Columbus Road; and

WHEREAS, the Village presently has surplus utility services that it can provide to the restaurant; and

WHEREAS, it is in the best interest of the Village to accept the wastewater from Creno's because, according to the OEPA, the discharge permit for the package plant that serves the restaurant would not be renewed.

NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of Granville, State of Ohio, that:

Section 1. The Village Council hereby expresses its willingness to accept wastewater from the Creno's Pizza restaurant, 1256 Columbus Road.

Section 2. The Village Manager is hereby authorized to send a related letter to the Ohio Environmental Protection Agency stating the Village's willingness to accept wastewater from Creno's Pizza.

Section 3. The Village Manager is further authorized to prepare a draft agreement for providing surplus sanitary sewer services to Creno's Pizza that will provide the rights, duties, and responsibilities of the respective parties with regard to the sewer services.

Section 4.  This Resolution shall take effect from and after the date of its passage, the earliest period allowed by law.
