A RESOLUTION AUTHORIZING THE VILLAGE MANAGER TO ENTER INTO A CONTRACT WITH THE LICKING COUNTY AREA TRANSPORTATION STUDY (LCATS) AND THE OHIO DEPARTMENT OF TRANSPORTATION (ODOT) FOR THE RESURFACING PROJECT OF CHERRY VALLEY ROAD FROM STATE ROUTE 16 SOUTH TO THE GRANVILLE CORPORATION LIMITS 

WHEREAS, the Ohio Department of Transportation (ODOT) and Licking County Area Transportation Study (LCATS) have identified the need to resurface and complete all related work to Cherry Valley Road south of State Route 16 to the Granville corporation limit; and 

WHEREAS, the Ohio Department of Transportation (ODOT) through the Licking County Area Transportation Study (LCATS) has agreed to provide funding in the amount of eighty percent (80%) of the total funds to resurface the portion of Cherry Valley Road south of State Route 16 to the Granville corporation limit (“the Project”); and 

WHEREAS, the Village of Granville agrees to assume and contribute the entire cost and expense of the improvement less the amount of federal-aid funds set aside by ODOT/LCATS; and 

WHEREAS, the Village of Granville agrees to bear one hundred percent (100%) of the cost for added items required to complete detail design; and

WHEREAS, the Village of Granville agrees that all right-of-way required for the  Project will be acquired and/or made available in accordance with current state and federal regulations including eligible utility costs; and 

WHEREAS, the Village of Granville agrees, upon completion of the Project, to maintain the roadway and public rights-of-way.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF GRANVILLE, OHIO, that:

Section 1.  The Village Manager is hereby authorized and directed to enter into a contract with the Ohio Department of Transportation (ODOT) and Licking County Area Transportation Study (LCATS) for the resurfacing project of Cherry Valley Road from State Route 16 South to the Granville corporation limits.          

Section 2.  The Village of Granville shall cooperate with the ODOT Director of Transportation to assume and contribute the entire cost and expense of the improvement less the amount of federal-aid funds set aside by ODOT/LCATS for the financing of this improvement from funds allocated by the Federal Highway Administration and to bear one hundred percent (100%) of the cost for added items required to complete detail design, rights-of-way, and all costs for added construction items generating extra work contracts under Ohio Laws, unless performance is approved by the State of Ohio and the Federal Highway Administration before work is authorized.  It is understood that ODOT/LCATS shall pay a maximum of $125,558.00 for the Project.

Section 3.  The Village of Granville agrees that all right-of-way required for the Project will be acquired and/or made available in accordance with current state and federal regulations.  The Village of Granville also understands that right-of-way costs include eligible utility costs.  The Village of Granville agrees that all utility accommodation, relocation and reimbursement will comply with the current provisions of 23 CFR 645 and the ODOT Utilities Manual. 

Section 4.  Upon completion of the Project, and unless otherwise agreed, the Village of Granville shall provide adequate maintenance for the Project in accordance with all applicable state and federal law including, but not limited to, 23 USC 116, shall provide ample financial provisions, as necessary, for the maintenance of the Project, shall maintain the right-of-way keeping it free of obstructions and hold said right-of-way inviolate for public highway purposes. 

Section 5.  This resolution shall take effect immediately upon passage.
