RESOLUTION NO. 2012-36 

A RESOLUTION AFFIRMING THE DECISION OF THE COUNCIL OF THE VILLAGE OF GRANVILLE TO REMAND TO THE BOARD OF ZONING AND BUILDING APPEALS THE APPLICATION FOR A LOT SPLIT SUBMITTED BY TERRA NOVA PARTNERS, LLC AND ADOPTING DECISION FINDINGS AND CONCLUSIONS OF FACT  

            WHEREAS, on April 12, 2012, the Village Board of Zoning and Buildings Appeals approved, with conditions, Application #2012-34 submitted by Terra Nova Partners, LLC for a lot split for property located at 198 Welsh Hills Road; and 

            WHEREAS, the decision of the Village Board of Zoning and Buildings Appeals was appealed and a hearing was conducted before Council on June 6, 2012; and 

            WHEREAS, on June 6, 2012, Council decided to remand Application #2012-34 submitted by Terra Nova Partners, LLC, directing the Board of Zoning and Buildings Appeals to clarify findings regarding the variance criteria in Section 1147.03 of the Zoning Code that was not sufficiently clear to allow Council to determine the merits of the appeal as presented.  It was unclear as to how much weight was given by the BZBA to each of the variance criteria, and how those criteria were considered in balancing the competing interests at issue.  Council further found that a better understanding of how the BZBA applied and considered the variance criteria in reaching a decision would be beneficial toward the resolution of this matter; and 

            WHEREAS, Council has made decision findings and conclusions of fact supporting its decision, attached hereto and incorporated herein as Exhibit “A.” 

            NOW, THEREFORE, be it resolved by the Council of the Village of Granville, Ohio, that: 

Section   I:  Council hereby affirms its decision to remand to the Village Board of Zoning and Buildings Appeals Application #2012-34 submitted by Terra Nova Partners, LLC for a lot split for property located at 198 Welsh Hills Road to clarify the record as to how much weight was given to each of the variance criteria and how those criteria were considered in balancing the competing interests at issue, and hereby adopts the decision findings and conclusions of fact attached hereto and incorporated herein as Exhibit “A.” 

Section II:  This Resolution shall take effect and be in force immediately upon passage.
