RESOLUTION NO. 2013-11 

A RESOLUTION TO AUTHORIZE THE VILLAGE MANAGER TO SIGN A MEMORANDUM OF UNDERSTANDING WITH THE LICKING COUNTY HUMAME SOCIETY

 

WHEREAS, the parties hereto mutually recognize the importance of investigating and prosecuting any person guilty of an act of cruelty to animals; and, 

WHEREAS, one of the objects of Licking County Humane Society (LCHS) is the inculcation of humane principles and the enforcement of the laws for the prevention of cruelty to animals; and, 

WHEREAS, LCHS is authorized to appoint agents for the purpose of prosecuting any person guilty of an act of cruelty to animals; and, 

WHEREAS, LCHS has entered into an agreement for an individual to perform the duties of a humane agent pursuant to Ohio Revised Code Section 1717.06; and, 

WHEREAS, LCHS has appointed a humane agent and the Licking County Probate Court has approved that appointment; and, LCHS desires to assume the responsibility for enforcing the animal cruelty laws and for prosecuting violators thereof; and, 

WHEREAS, the Village supports the endeavors of LCHS to enforce the animal cruelty laws; and, 

WHEREAS, Ohio Revised Code Section 1717.07 provides that the Village of Granville shall be responsible for a reasonable portion of the salary of a humane agent in an amount not to exceed ten ($10) dollars per month; and, 

WHEREAS, the Village and LCHS have agreed that LCHS will commence the work of enforcing the animal cruelty laws on March 1, 2013 and that the Village will be responsible for the payment of a reasonable salary for the work performed by a humane agent, not to exceed ten ($10) dollars per month. 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of Granville, Ohio in consideration of the foregoing, and by the requirements of the Ohio Revised Code, the Village and LCHS do hereby agree that: 

Section 1. The Village Manager is hereby authorized to enter into a Memorandum of Understanding with the Licking County Humane Society relating to the enforcement of the laws for the prevention of cruelty to animals. A copy of the Memorandum of Understanding is attached hereto and marked as Exhibit A. 

Section 2. This resolution shall take effect immediately upon passage.
