RESOLUTION NO. 2013-46
A RESOLUTION AUTHORIZING THE VILLAGE MANAGER TO ENTER INTO A CONTRACT WITH THE OHIO DEPARTMENT OF TRANSPORTATION (ODOT) FOR A RESURFACING AND RELATED WORK TO SOUTH CHERRY STREET FROM BROADWAY SOUTH TO THE CORPORATION LIMIT
WHEREAS, the Ohio Department of Transportation (ODOT) has identified the need to resurface and complete all related work to mill and resurface the following streets:
South Cherry Street from Broadway to the South Corporation Limit
WHEREAS, the Ohio Department of Transportation (ODOT) has agreed to provide funding in the amount of eighty percent (80%) of the total funds to complete the Project; and
WHEREAS, the Village of Granville (Local Public Agency/LPA) agrees to assume and contribute the entire cost and expense of the improvement less the amount of federal-aid funds set aside by ODOT/LCATS; and
WHEREAS, the Village of Granville agrees to bear one hundred percent (100%) of the cost for added items required to complete detail design; and
WHEREAS, the Village of Granville agrees that all right-of-way required for the Project will be acquired and/or made available in accordance with current state and federal regulations including eligible utility costs; and
WHEREAS, the Village of Granville agrees, upon completion of the Project, to maintain the roadway and public rights-of-way.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF GRANVILLE, OHIO, that:
Section 1. The Village Manager is hereby authorized and directed to enter into a contract with the Ohio Department of Transportation (ODOT) and Licking County Area Transportation Study (LCATS) for the milling and resurfacing project of:
South Cherry Street from Broadway South to the Corporation Limit
Section 2. Being in the public interest, the LPA gives consent to the Director of Transportation to complete the above described project
Section 3. The LPA shall cooperate with the Director of Transportation in the above described project as follows:
The LPA does hereby propose to assume and contribute the entire cost and expense of the improvement less the amount of federal-aid funds set aside by the Director of Transportation for the financing of this improvement from funds allocated by the Federal Highway Administration, U. S. Department of Transportation, and further, the Village agrees to bear one hundred percent (100%) of the cost of the following items:
- All cost for added items required to complete detail design,
- All costs for added construction items generating extra work contract under Ohio Law, unless performance is approved by the State of Ohio and the Federal Highway Administration before work is authorized.
- LCATS Federal Maximum $173,830.00
Section 4. The LPA agrees that all right-of-way required for the described project will be acquired and/or made available in accordance with current state and federal regulations. The LPA also understands that right-of-way costs include eligible utility costs. The LPA agrees that all utility accommodation, relocation and reimbursement will comply with the current provisions of 23 CFR 645 and the ODOT Utilities Manual.
Section 5. Upon completion of the described Project, and unless otherwise agreed, the LPA shall:
- Provide adequate maintenance for the described Project in accordance with all applicable state and federal law including, but not limited to, 23 USC 116;
- Provide ample financial provisions, as necessary, for the maintenance of the described Project;
- Maintain the right-of-way, keeping it free of obstructions;
- Hold said right-of-way inviolate for public highway purposes.
Section 6. This resolution shall take effect immediately upon passage.
